This property is legally described as follows, to wit: The North 42 feet o£ the South 84 feet of the East'h of Lots 20 and 21, Dittmanns Subdivision of Lot 5 of the Subdivision of the East Half of the South West Quarter of Sec 20, Town 29 North, Range 22 West of the 4`� Principal Meridian, the above being more particularly described as follows: North 22 feet of the East %z of Lot 21 and the South 20 feet of the East % of Lot 20 in Dithnanns Subdivision of Lot 5 of the Subdivision of the East Half of the South West Quarter of Sec 20, Town 29 North, Range 22 West of the 4�' Principal Meridain. WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Division of Code Enforcement on or before September 18, 2000, the following are the now known interested or responsible parties far the Subject Properiy:Ruthie White, 1205 Edgerton Street, St. Paul, MN 55101; Chase Manhattan Bank, c/o Olson, Usset, and Weingaxden, PLLP, 4500 Park Glen Rd. #310, Mpls., MN 55416; Mila Inc., 3400 188` Street S.W., Ste. 305, Lynnwood, WA 98037; Lereta Corp., 19321 C US 19 North # 602, Cleazwater, FL 33764 WHEREAS, Division of Code Enforcement has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated November October 31, 2000; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the shucture located on the Subject Property by November 30, 2000; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolirion; and WHEREAS, this nuisance condition has not been corrected and Division of Code Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties haue been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and Council File # O�� �1� Green Sheet # l l� �319. o� -'1'1 1 WHEREAS, a hearing was held before the Legislative Aearing Officer of the Saint Paul City Council on 2 Tuesday, January 2, 2001 to heaz testimony and evidence, and after receiving testunony and evidence, 3 made the recommendation to approve the request to order the interested or responsible parties to make the 4 5ubject Property safe and not detrimental to the public peace, health, safety and welfare and remove its 5 blighting influence on the community by rehabilitating this structure in accordance with all applicable 6 codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with 7 all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed 8 within fifteen (15) days after the date of the Council Hearing; and 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, January 24, 2001 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 1205 Edgerton Street: That the Subject Properry comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 2. 3. 4. 5. 6. � That the costs of demolition and removal of this building(s) is estimated to exceed three tl�ousand dollars ($3,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Properry. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible pazties to correct the deficiencies ar to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Division of Code Enforcement has posted a placard on the Subject Property which declazes it to be a nuisance condition subject to demolition. That this building has been routinely monitored by the Citizen Service Offices, Division of Code Enfarcement, Vacant/Nuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ardinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinan�e�s�Th�re bil�taf on r��erL�olition and removal of the structure must be completed within � aays arier tn�o date oi ine Council Hearing. Room 330 Courthouse Gerry Strathman, Legislative Heazing Officer The meeting was called to order at 10:00 a.m. STAFF PRESENT: Steve Magaer, Code Enforcement Logan Moore, Code Enforcement 1. Resolurion ordering the owner to remove or repair the building at 964 WoodbridQe treef. If the owner faits to eomply, Code Enforcement is ordered to remove the building. Tom Severin, owner of the property, appeared. (Steve Magner presented photographs of the property to Gerry Strathman for his review) Steve Magner reported this property is a two story, wood frame duplex, with a detached two stall wood frame gazage. According to their files this has been a vacant building since November 29, 1449. The current property owner is Duane Thomas Severin, per Ramsey County Property Records and Revenue. There have been four summary abatements which � were the following: to secure the dwelling, remove brush, cut tall grass and weeds, and remove snow and ice from the sidewalk. On November 1, 2000, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condirion was developed and photographs were taken. An order to abate a nuisance building was issued on November 14, 2000, with a compliance date of December 14, 2000. As of this date (January 16, 2001), this property remains in a condition which comprises a nuisance as defined by the Legisiative Code. The vacant building fees are due and owing, real estate tases are paid, and Taxation has placed an estimated market value of $58, 300. As of this date, code inspection has not been applied for and a bond has not been posted. Code Enforcement Officers estimate the cost to repair this structure in excess of $60,000 and demolition to be between $8,000 - $9,000. Tom Severin, owner, said he pians to sell his house as soon as possible and has listed it with a Rea1 Estate Agent. Gerry Strathman asked whether or not Code Enforcement had any problems with tlus property so that enforcement could wait a while in order for this sale to be completed. Mr. Magner responded the City doesn't have a problem with laying this matter over for a short period of time in order to close on a purchase agreement; however, his main concern is that the new purchaser is made awaze of the requirements, such as the vacant building fees, the code inspection and posting of a bond. � Since the plan is to sell ttris building for rehabilitation, Mr. Strathman recommended to layover this matter to the February 20, 2001, I.egislative Hearing. Tlus has been a problematic property in the neighborhood and they have received numemus calls and complaints. Paul Weingarden said lus client, Option Oae Mortgage Compaay, has ordered the properly to be inspected, secured, aad a complete appraisal to determine the extent of the damages. Dawn Anderson, current owner, clarified that tt►ere was a fire in her home on February 5, 2000, wluch she filed a claim with her insuzance company. Option One Mortgage still holds � some of the money from the claim, wtuch has been applied to her mortgage. Ms. Anderson hired a conhactor to do the repair work but he absconded with the money. Page 3 In response to Mr. Weingarden's question, Mr. Magner estimated the cost for rehabilitation of the house to be around $50,000. The contractor had replaced a few of the windows, but the interior of the house is gutted. This pmperiy has had numerous violarions and issues over the yeazs and will need a lot of maintenance. Mr. Weingarden requested that the Legislative Hearing Officer grant additional time to finish the appraisal and inspection to determine if the building can be rehabilitated. Gerry Sh�athman recommended approval of the order to remove or repair within fifteen days and his recommendation wili be presented at the City Council Meeting on February 7, 2001. According to their files, the building was condemned and has been a vacant building since May 25, 1999. The current pmperry owner is Ruthie White, per Ramsey County Properiy Records and Revenue. Information has been received that Ms. White lost the building to a mortgage company. There have been ten summary abatement notices issued, which are the following: to secure the building, cut the grass, remove broken tree limbs, remove snow and ice from the sidewalk. On October 25, 2000, an inspecrion of the building was conducted, a list of deficiencies which constiYUte a nuisance condition was developed and photographs were taken. An order to abate a nuisance building was issued on October 31, 2000, with a compliance date of 23ovember 30, 2000. As of this date (January 16, 2001) this properry remains in a condition which comprises a nuisance as de5ned by the Legislative Code. The City Itas had to board this building to secure it against trespass, the vacant building fees are due and owing, real estate taaces have been paid; and Taxation has placed a sstimated market value of $64,500. As of this date, a code compliance inspection and bond have not been applied for. Code Enforcement Officers estimate the cost to repair tlus shvcture is $30,000 with the esrimate cost to demolish is between $7,000 -$8,000. Paui Weingazden, representing the Chase Manhattan Bank, said they were advised of a fire at this pmperty and filed a fire claim along with Ms. White. The fire was deemed by the insurance company to be of suspicious origin and ultimately her claim was denied, however, the bank's claim was approved. Under the terms of the mortgage Chase Manhattan Bank had to give Ms. White notice that the claim money was applied to the loan. Thus, Chase Manhattan commenced a foreclosure and the period of redemption will expire the first week in February. Ms. White has left the state and her last known address was in Indiana. One ottier note of interest to tius building is fhat there has been a long history with maintenance issues and with problematic occupants in this dwelling. It also has a foundation failure, which is difficult to see on the photographs. Paul Weingazdea said Option One Mortgage Company fias ordered that ttus building be secured, reviewed and ordered an appraisal to determine whether or not the property can be saved. He requested approximately one month's time so this matter can be reviewed. This also has been sent to his office for foreclosure. (Laid over from December 19, 2000) Thien Van Tran, owner of the properry, appeared. Steve Magner said tius property was laid over from December 19, 2000. Per the Legislarive Hearing Officer's request on December 19, 2000, he and Don Wagner inspected the properiy on Januazy 4, 2001, and found the property to be occupied by the owner without running water and heated with a heating unit that does not vent into the chimney or to the outside of the dwelling which constitutes an unsafe, hazazdous condition. The only work that has been completed by the owner on the house, is the main roof covering, some floor covering, and some minor painting. Subsequently, he and another inspector went out to the dwelling on Tanuary 10, 2001, and met with the owner, who admitted that he had been staying on the property. Mr. Tran has been issued a citation for illegal occupancy in a condemned registered vacant building. Mr. Magner said he has tried to explain to the owner that this is a safety issue and he needs to vacate. �J Mr. Magner recommends appmval of the request to repair or remove within fifteen days due to the Iack of work completed witl�in one year. There aze numerous deficiencies and violations that aze outstanding. Thien Van Tran said the informafion he received from the company that manufactured the heater indicates that it is not necessary to vent. Gerry Strathmau indicated after hearing Mr. Magner's report it suggests Mr. Tran is still a long way from accompTishing the repairs and asked what his plans were to rehabilitate. Mr. Tran responded th3t he has had financial difficulties due to expenses associated with travel arrangements for his wife to visit her father who was ill and then he later passed away. The money he had saved for the purpose ofrehabilitation had to be used for these eacpenses, and he requested additional time to try to get funding. Mr. Magner said he believes the properiy could be rehabilitatecl, but he believes the owner is dealing with a monetary issue and doesn't have the financial resources to do the work and post the bond. Gerry Strathman said he is recommending at the January 24, 2001, City Council Meeting to remove or repair the building within 15 days and if Mr. Tran has a plan to rehabilitate the building, including the finances, he should be present at this meeting. According to their files this has been a vacant building since November 29, 1449. The current property owner is Duane Thomas Severin, per Ramsey County Property Records and Revenue. There have been four summary abatements which � were the following: to secure the dwelling, remove brush, cut tall grass and weeds, and remove snow and ice from the sidewalk. On November 1, 2000, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condirion was developed and photographs were taken. An order to abate a nuisance building was issued on November 14, 2000, with a compliance date of December 14, 2000. As of this date (January 16, 2001), this property remains in a condition which comprises a nuisance as defined by the Legisiative Code. The vacant building fees are due and owing, real estate tases are paid, and Taxation has placed an estimated market value of $58, 300. As of this date, code inspection has not been applied for and a bond has not been posted. Code Enforcement Officers estimate the cost to repair this structure in excess of $60,000 and demolition to be between $8,000 - $9,000. Tom Severin, owner, said he pians to sell his house as soon as possible and has listed it with a Rea1 Estate Agent. Gerry Strathman asked whether or not Code Enforcement had any problems with tlus property so that enforcement could wait a while in order for this sale to be completed. On October 25, 2000, an inspecrion of the building was conducted, a list of deficiencies which constiYUte a nuisance condition was developed and photographs were taken. An order to abate a nuisance building was issued on October 31, 2000, with a compliance date of 23ovember 30, 2000. As of this date (January 16, 2001) this properry remains in a condition which comprises a nuisance as de5ned by the Legislative Code. The City Itas had to board this building to secure it against trespass, the vacant building fees are due and owing, real estate taaces have been paid; and Taxation has placed a sstimated market value of $64,500. As of this date, a code compliance inspection and bond have not been applied for. Code Enforcement Officers estimate the cost to repair tlus shvcture is $30,000 with the esrimate cost to demolish is between $7,000 -$8,000. Paui Weingazden, representing the Chase Manhattan Bank, said they were advised of a fire at this pmperty and filed a fire claim along with Ms. White. The fire was deemed by the insurance company to be of suspicious origin and ultimately her claim was denied, however, the bank's claim was approved. Under the terms of the mortgage Chase Manhattan Bank had to give Ms. White notice that the claim money was applied to the loan. Thus, Chase Manhattan commenced a foreclosure and the period of redemption will expire the first week in February. Ms. White has left the state and her last known address was in Indiana. Per the Legislarive Hearing Officer's request on December 19, 2000, he and Don Wagner inspected the properiy on Januazy 4, 2001, and found the property to be occupied by the owner without running water and heated with a heating unit that does not vent into the chimney or to the outside of the dwelling which constitutes an unsafe, hazazdous condition. The only work that has been completed by the owner on the house, is the main roof covering, some floor covering, and some minor painting. Subsequently, he and another inspector went out to the dwelling on Tanuary 10, 2001, and met with the owner, who admitted that he had been staying on the property. Mr. Tran has been issued a citation for illegal occupancy in a condemned registered vacant building. Mr. Magner said he has tried to explain to the owner that this is a safety issue and he needs to vacate. �J Mr. Magner recommends appmval of the request to repair or remove within fifteen days due to the Iack of work completed witl�in one year. There aze numerous deficiencies and violations that aze outstanding. Thien Van Tran said the informafion he received from the company that manufactured the heater indicates that it is not necessary to vent. Gerry Strathmau indicated after hearing Mr. Magner's report it suggests Mr. Tran is still a long way from accompTishing the repairs and asked what his plans were to rehabilitate. Mr. Tran responded th3t he has had financial difficulties due to expenses associated with travel arrangements for his wife to visit her father who was ill and then he later passed away. The money he had saved for the purpose ofrehabilitation had to be used for these eacpenses, and he requested additional time to try to get funding. Mr. Magner said he believes the properiy could be rehabilitatecl, but he believes the owner is dealing with a monetary issue and doesn't have the financial resources to do the work and post the bond. Gerry Strathman said he is recommending at the January 24, 2001, City Council Meeting to remove or repair the building within 15 days and if Mr. Tran has a plan to rehabilitate the building, including the finances, he should be present at this meeting. Tom Severin, owner of the property, appeared. (Steve Magner presented photographs of the property to Gerry Strathman for his review) Steve Magner reported this property is a two story, wood frame duplex, with a detached two stall wood frame gazage. According to their files this has been a vacant building since November 29, 1449. The current property owner is Duane Thomas Severin, per Ramsey County Property Records and Revenue. There have been four summary abatements which � were the following: to secure the dwelling, remove brush, cut tall grass and weeds, and remove snow and ice from the sidewalk. On November 1, 2000, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condirion was developed and photographs were taken. An order to abate a nuisance building was issued on November 14, 2000, with a compliance date of December 14, 2000. As of this date (January 16, 2001), this property remains in a condition which comprises a nuisance as defined by the Legisiative Code. The vacant building fees are due and owing, real estate tases are paid, and Taxation has placed an estimated market value of $58, 300. As of this date, code inspection has not been applied for and a bond has not been posted. Paul Weingarden said lus client, Option Oae Mortgage Compaay, has ordered the properly to be inspected, secured, aad a complete appraisal to determine the extent of the damages. Dawn Anderson, current owner, clarified that tt►ere was a fire in her home on February 5, 2000, wluch she filed a claim with her insuzance company. Option One Mortgage still holds � some of the money from the claim, wtuch has been applied to her mortgage. Ms. Anderson hired a conhactor to do the repair work but he absconded with the money. The contractor had replaced a few of the windows, but the interior of the house is gutted. This pmperiy has had numerous violarions and issues over the yeazs and will need a lot of maintenance. Mr. Weingarden requested that the Legislative Hearing Officer grant additional time to finish the appraisal and inspection to determine if the building can be rehabilitated. Information has been received that Ms. White lost the building to a mortgage company. There have been ten summary abatement notices issued, which are the following: to secure the building, cut the grass, remove broken tree limbs, remove snow and ice from the sidewalk. On October 25, 2000, an inspecrion of the building was conducted, a list of deficiencies which constiYUte a nuisance condition was developed and photographs were taken. An order to abate a nuisance building was issued on October 31, 2000, with a compliance date of 23ovember 30, 2000. As of this date (January 16, 2001) this properry remains in a condition which comprises a nuisance as de5ned by the Legislative Code. The City Itas had to board this building to secure it against trespass, the vacant building fees are due and owing, real estate taaces have been paid; and Taxation has placed a sstimated market value of $64,500. As of this date, a code compliance inspection and bond have not been applied for. Code Enforcement Officers estimate the cost to repair tlus shvcture is $30,000 with the esrimate cost to demolish is between $7,000 -$8,000. Paui Weingazden, representing the Chase Manhattan Bank, said they were advised of a fire at this pmperty and filed a fire claim along with Ms. White. The fire was deemed by the insurance company to be of suspicious origin and ultimately her claim was denied, however, the bank's claim was approved. Under the terms of the mortgage Chase Manhattan Bank had to give Ms. White notice that the claim money was applied to the loan. Thus, Chase Manhattan commenced a foreclosure and the period of redemption will expire the first week in February. Ms. White has left the state and her last known address was in Indiana. Per the Legislarive Hearing Officer's request on December 19, 2000, he and Don Wagner inspected the properiy on Januazy 4, 2001, and found the property to be occupied by the owner without running water and heated with a heating unit that does not vent into the chimney or to the outside of the dwelling which constitutes an unsafe, hazazdous condition. The only work that has been completed by the owner on the house, is the main roof covering, some floor covering, and some minor painting. Subsequently, he and another inspector went out to the dwelling on Tanuary 10, 2001, and met with the owner, who admitted that he had been staying on the property. Mr. Tran has been issued a citation for illegal occupancy in a condemned registered vacant building. Mr. Magner said he has tried to explain to the owner that this is a safety issue and he needs to vacate. �J Mr. Magner recommends appmval of the request to repair or remove within fifteen days due to the Iack of work completed witl�in one year. There aze numerous deficiencies and violations that aze outstanding. Thien Van Tran said the informafion he received from the company that manufactured the heater indicates that it is not necessary to vent. Gerry Strathmau indicated after hearing Mr. Magner's report it suggests Mr. Tran is still a long way from accompTishing the repairs and asked what his plans were to rehabilitate. Mr. Tran responded th3t he has had financial difficulties due to expenses associated with travel arrangements for his wife to visit her father who was ill and then he later passed away. The money he had saved for the purpose ofrehabilitation had to be used for these eacpenses, and he requested additional time to try to get funding. Mr. Magner said he believes the properiy could be rehabilitatecl, but he believes the owner is dealing with a monetary issue and doesn't have the financial resources to do the work and post the bond. Gerry Strathman said he is recommending at the January 24, 2001, City Council Meeting to remove or repair the building within 15 days and if Mr. Tran has a plan to rehabilitate the building, including the finances, he should be present at this meeting.
