WHEREAS, REF, LLC, a Minuesota limited liability company, and F& R Development, a
Minnesota general partnership, commenced an inverse condemnation action agaixtst the City of

Saint Paul on or about October 5,�, Court File No. C1-00-8690, concerning property set forth in the
Complaint and hereina8er referred to as the "subject propert}�', and
WHEREAS, the City of Saint Paul commenced an eminent domain action regarding the subject
properiy held by Frank M. Frattalone, REF, LLC, and F& R Development on or about May 14, 2001,
Court File No. C3-00-3878, and
WHETZEAS, the parties have reached a settlement of the above-referenced legai actions;
NOW THEREFORE BE IT RESOLVED, that the City of Saint Paul City Council approves the
purchase of the subject property, except for an approximate 3/4 acres to be retained by Frank Frattalone,
for the sum of $3.2 xnillion dollars under the terms and condirions negotiated by the City's attorney.
