1 BE IT RESOLVED, that, upon the petition of Scott Ferguson for Cayuga Street L.L.C., as documented
2 in TMS-Rea1 Estate File Number 03-2001, public properties hereinafter described are hereby vacated
3 and discontinued as public property: and, subject to the herein stated exceptions, the easements within
4 those public properties are hereby released.
6 The property to be vacated is described as follows:

8 That part of the a11ey in Block 2, Edmund Rice's Second Addition, according to the recorded plat
9 therof and situated in Ramsey County, Minnesota lying between the westerly extensions of the
10 north and south lines of Lot 6, said Block 2.

12 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
13 Saint Paui Legislative Code as amended, and to the following conditions:

That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Xcel Energy.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Communications by maintaining service to 850 Agate Street which is provided through
this easement.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of A T& T Broadband.
That the petitioners sha11 obtain a build permit for the fence construction and possibly the
retaining wa11 depending on wall height and shuctural considerations.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any

employees.

resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution

I recommend that a public hearing before the City Council be held on July ll, 2001.
The purpose of this hearing is to consider a resolution to vacate city alley right of way to construct
a privacy fence in order to screen a proposed off-street parking lot to the east for the benefit of the
adjacent residential neighbors.
This property is located in City Council District 5, Planning District 6.

I recommend that a public hearing before the City Council be held on July ll, 2001.
The purpose of this hearing is to consider a resolution to vacate city alley right of way to construct
a privacy fence in order to screen a proposed off-street parking lot to the east for the benefit of the
adjacent residential neighbors.
