01-725ORIGI�IAL CouncilFile# O\� �i�.s Green Sheet # �O 3 '�� � RESOLUTION �INT PAi�„ D�IINNF,SQTA Presented By Referred To Committee: Date WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and 40 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on an applicant,,other persons or on the community; and WHEREAS, Skinner's Pub, represented by Peter & Molly Skinner, owners, who have been designated as the responsible persons on the application, has applied for a variance to allow live music at 919 Randolph Avenue, on October 5 and 6, 2001 as part of a grand opening celebration; and WHEREAS, applicant is seeking a variance for the hours of 5:00 p.m. to 10:00 p.m. on October 5, 2001 and from noon until 10:00 p.m. on October 6, 2001; and WHEREAS, if applicant is not granted a variance it will not be able to present the live music; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council grants a variance for those two to the following conditions: of the City of Saint Paul hereby dates to Skinner's Pub, subject 1) The variance shall be for the hours of 5:00 p.m. to 10:00 p.m. on October 5, 2001, and for the hours of noon to 10:00 p.m. on October 6, 2001. 2) Al1 electronically powered equipment used in conjunction with the event shall not exceed 95 dBA as measured at the closer of the sound mix or at a distance of 50 feet from the front of the stage. � R I G � fl�� � The applicant shall provide personnel and �,�1� equipment who shall provide continuous sound 4 level monitoring between 5:00 p.m. and 10:00 5 p.m. on October 5, 2001 and between noon and 6 10:00 p.m. on October 6 to ensure compliance 7 with Condition #2. 8 9 4) All electronically powered equipment, PA 10 systems, loudspeakers or similar devices 11 shall be turned off no later than 10:00 p.m. 12 on both dates. 13 14 FURTHER RESOLVED, that any violation of the conditions set 15 forth above on the October 5, 2001 date may result in revocation 16 of the grant of a variance for the October 6, 2001 date in 17 addition to any criminal citation which might issue.
