RESOLVED, that upon the filing of a "Stipulation of Dismissal
With Prejudice" with the Clerk of United States District Court for
the District of Minnesota, Third Division, in the matter of Ethel
Brossard vs. City of St Paul, the proper city officers are hereby
authorized and directed to pay out of the Tort Liability Fund 09070-
420-000 to Ethel Brossard and Richard E. Leonard, attorney, the sum
of Six Hundred Seventy-five ($675.00) Dollars in full settlement of
plaintiff' s claim for damages resulting from an accident occurring on
June 15, 1973 and as more fully set out in the Notice of Claim
presented to the City Council on July 3, 1973.

SUBJECT: Claim of Ethel Brossard
Mrs. Brossard' s claim against the City arose out of an
accident that occurred on June 15, 1973 when she tripped
and fell at the Ford Parkway branch library. Mrs. Brossard
alleged that she fell over a bench that was protruding into
an aisle. As a result of the fall, she suffered a fracture
of the left hip and incurred hospital and medical expenses
in excess of $3000.00. The facts of the accident involve
a dispute that could be resolved against the City.
Therefore, I would recommend approval of the settlement
of the claim in the amount of $675.00.
