Presented By Referred To Committee: Date Out of Committee By Date In the ma.tter of hazardous buildings being that 12 story frame single family dwelling known and described as 741 Fuller in the City of Saint Paul, situated on those premises legally described as Lot 22, Block 3, Butterfield Syndicate Addition No. 1, t° according to the plat on f ile and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Minnesota WHEREAS, pursuant to Resolution C.F. 258878, approved June l, 1972, a public hearing was scheduled for 10:00 a.m. on June 22, 1972 before the Council of the City of Saint Pau1, said hearing pertaining to the condition of the structure located at 741 Fuller, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing± c�nsisting of , , photographs, inspection reports and the recommendation of the - Division of Housing and Building Code Enforcement, it is found and � determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record owners of the above described property are Ma.bel and Jacob Schmitt; and that there is a State of Minnesota tax lien against the property; and that it is further determined tha.t the above described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463. 15 for the following reasons: �.. The exterior condition of the building is as follows : The mortar is loose in the chimney. The front porch roof and pieces of the cornice are rotten. Pieces of asphalt si_ding are missing. c. The interior condition of the building is as follows: The first and second floors have been vandalized. The plaster is broken and missing. The windows and interior trim have been vandalized. The plumbing fixtures have been�_� removed. The electrical system is inadequate. The hot water, oil fired heating system has been damaged by freezing. d. The building is unfit for human habitation in its present condition and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable. e. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation and inadequate mai ntenance. now, therefore, be it RESOLVED, that in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER l. The owners of the above described building shall ma.ke the same safe and not detrimental to the public peace, health, safety and welfare by having the said building razed and the materials there£rom removed from the premises within thirty (30) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with ' this order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of District Court of Ramsey County, Minnesota within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be made to the Ramsey County District Court; 3.
