Schwartz and Ethel M. Schwartz, that Thomas E. Nowicki is the contract purchaser of the property, and that there is a mortgage on the property to Midwest Federal Savings and Loan; and that it is further determined that the above desc�tibed building constitutes a hazardous building within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The building is standing vacant, abandoned and is subject to being entered by unauthorized persons. The ext�rior condition of the building is as . follows: There are holes in the roof of the dwelling and : cornice and fascia are missing in man3r places causing it to be open to animals and the weather. The side walls of the building are uneven and the front porch roof rafters are rotted. There is a 10' x 10' partial baseme�t with a dirt floor which is not adequately supportive in many places. The flaoring above is rotted and in a dangerous condition. There is evidence of water seepage through -the foundation wall which. has stone missing. The basement steps are rott�n ar.�d broken. c. The interiar condition cff the building is as. foll.ows: The front room, kitchen and bathroom floors on the first floor ar�e rotten and have holes in them. The other three rooms have poured concrete floors on the ground. . They are : - uneven and the�e is evidence of water seepage through the walls. Ceiling tile is missing in the front room. The side entry r�8�i.: ha.s completely robted away. The plumbing, electrical and heating systems are deteriorated. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the Di�trict Court, all personal property or fixtures which ma.y,unreasonably inter- fere with the razin and removal of this building shall be removed within ten �10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal prope�ty and fixtures as provided by law; 4. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above described real estate and collected as other taxes; and be it FURTHER RESOLVED, That a certified copy of this resolution and incorporated Order herein be served upon the last record owners of the above described property in the manner provided by law. Fourth St. File #2490 Hearing Nov. 7, 1974 Honorable Council: The Division of Housing and Building Code Enfoxcement is hereby submitting its report on the condition of the structure at the location referred to above. The owners of record are Thomas E. Nowicki and Frank C. Schwartz. The legal description of the property is Lot 18, Black 96 , Stinson' s. Sub. of Block 96 of Lymand Dayton' s Addition. , The building is a 26' x 42 ' frame dwelling. There are holes in the roof of this dwelling and cornice and fascia are missing in many places causing it to be open to aminals and the whether. The side walls of the building are uneven and front porch roof rafters are rotted. This structure has a partial basement 10' x 10' with a dirt floor, as we11 as not being adequately supported in many places. The flooring above is rotted and in dangerous condition. There is evidence of water seepage through the foundation wall which has stone missing. The basement steps are rotten and broken. On the first floor the front room, kitchen and bath floors are rotten and have holes. The other three rooms have poured concrete floors on the ground. They are uneven and there� is evidence of water seepage through the walls. Ceiling tile is missing in the front room. The side entry door has completely rotted away. There is open and improper wiring in the electrical system. There is no heat in the house, space heaters were used and have been removed. The aluminum liner in the chimney is corroded and is not useable. The Housing and Redevelopment Authority does not intend to acquire this property. The submect property has been boarded by the city since April 11, 1974. Inasmuch as the inadequate maintenance, physical damage and dilapidated conditions outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contributes a blighting influence on the neigh.borhood, it is the recommendation of this bureau that this matter be referred to the City Attorney' s office for razing and removal through District Court proceedings.
