MINiTTES OF THE LEGISLATIVE HEAIZING
EVEREST ON GRAND - 1278 GRAND AVENUE
Monday, July 2, 2001
Room 330 Courthouse
Gerry Strathman, Legislative Hearing Officer
The meeting was called to order at 3:02 p.m.
STAFF PRESENT: JeffHawkins, LIEP (License, Inspections, Environmental Protection);
Cluistine Rozek, LIEP
Gerry Strathman stated this meeting is being held to hear objections that haue been raised
regarding the issuance of licenses to Everest on Grand.
Chrisfine Rozek reported this is an application by Everest on Grand at 1278 Grand Avenue for
Sidewalk Cafe, Strong Beer, and Wine Licenses. LIEP is not requesting any conditions placed
on the license. All requirements have been met. There are no pending adverse actions. The
sidewalk cafe is for food only; wine and beer are not allowed on the sidewalk. LIEP's
recommendation is for approval.
Mr. Strathman asked how the area of the sidewalk cafe is controlled. Ms. Rozel responded the
ordinance is very specific: the tables have to be contiguous to the building and there has to be
enough space for pedestrians to pass by comfortably.
Jean Havlik, 1279 Lincoln Avenue, appeazed and stated that she understood the restrictions
would be put back on this license like it was for a previous business at this loca6on. She asked
could they close at 10:00. Ms. Rozek responded the only limitafion is they cannot serve between
1:00 a.m. and 8:00 a.m.
Mr. Strathman stated he received a letter objecting to this license from Robert A. and Jean E.
Havlik. He asked did they say what they wish in the letter. Mrs. Havlik responded yes.
Padam Sharxna, owner, appeared with his wife, daughter, and son. He stated they run the
restaurant as a family business. He has met the Hauliks. Mr. Shanna intends to sell wine and
beer to responsible adults who prefer to drink alcoholic beverages while enjoying the spicy food
offered on their menu. In the Havlik's letter, they wrote that they ob}ected to strong liquox being
served, but Mr. Shanna does not plan to serve it. Alcohol is served to sit in clients only after
they hae ordered. His business closes at 930 p.m., and the last customers aze out at 1030 p.m.
They do not have a sidewalk cafe license at this time.
Mr. Shaima went on to say that clients from Crreen Mill and Pasqual's do not predict how his
clients will behaue. He will do his best to educate his clients regarding the noise concerns of the
neighbors. His family opened this business on Grand Avenue because they like the family
friendly environment there. They want to add diversity to the businesses there.

EVEREST ON GRAND - LEGISLATIVE HEARING - June 2, 2001 Page 2
Mr. Strathman asked were their questions answered and do they still object to the license being
issued. Mrs. Havlik responded she has no other questions, and she does not object to the licenses
any longer.
Ms. Rozek addec3 that Green Mill has a fullliquor license so people can go there and have
alcohol without food. Crreen Mill is open until 1:OQ a.m. It is a different status.
Gerry Strathman recommended approval of the license application.
The meeting was adjourned at 3:09 p.m.
