WHEREAS, pursuant to Resolution, C. F. 266$04, approved
December 18, 1975, a pubiic hearing was schedul d for 10:00 a.m.
on December 30, 1975 before the Council of the �ity of Saint Paul,
said hearing pertaining to the condition of the structure at 164
Charles, Saint Paul, Minnesota; and
WHEREAS, upon facts presented at said hearing consisting of
photographs, inspection reports and the recomme dation of the
Division of Housing and Building Code Enforceme�it it is found
and determined by the City Council that accordir�.g to the records
and files�in the office of the Register of Deed , the last record
owners of the above described property are Gert�ude Eischens and
Betty M. Swanson, and that there are no lien holders of record;
and that it is further determined that the abov described
building constitutes a hazardous building withi� the definition
of Minnesota Statutes Section 433.15 for the fo�lowing reasons:

a. The building is standing vacant, abandpned and
is subject to being entered by unauthorized per�ons;
b. The condition of the building is as fo lows:
Due to age, deterioration, vandalism and lack o proper
maintenance, the building is beyond rehabilitat on and �
in a hazardous condition. The exterior and int ' rior have
been vandalized. Walls, stairways, electrical,�heating
and plumbing fixtures are broken and missing; �
c. The building is unfit for huma,n habitai�ion in its
present condition; !
d. The building const�tutes a nuisance an�. a hazard
to the public health; safety a�d welfare becaus� of its
physical damage, dilapidation and inadequate ma.�ntena.nce;
now, therefore, be it
RESOLVED, That i� sccordance with Minn.esot�. Statut�s
Sections 463. 15 througYi� 463. 26, an.d b�sed upon he forego�tng
findings of the City Council, the Council of th City of
Saint Paul does hereby make the following Order
ORDER;�° I
1. The owners of the above described builc�ing shall make
the same safe and not detrimental to the publiclpeace, health,
safety and welfare by having the said building azed and the
materials therefrom removed from th,e premises w�th in thirty (30)
days from the date of the service of this Order�
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul ara.d
filed in the Off ice of the Clerk of District C �rt of Ramsey
County, Minnesota within twenty (20) days from he date :of the
service of this Order, a Motion for Summary Enf rcement of this
Order to raze and remove the said b�u.ilding will 'be made to t3�;e
Ramsey County District Court;

3. In the event that the building is to be razed by the
City of Saint Paul pursua.nt to judgment of the �istrict Court,
all personal property or fixtures which may unr asonably inter-
fere with the razin and removal of this buildi�g shall be
removed within ten �10) days from the entry of judgment; and
if not so removed, the City of Saint Paul shall �remove and
dispose of such personal property and fixtures �.s provided
by law;
4. If the City of Saint Paul is compelled ,to take any
corrective action herein, all necessary costs e�pended by the
' City will be assessed against the above described real estate
' and collected as other taxes; and be it
� FURTHER RESOLVED, that a certified copy oflthis resolution
and incorporated Order herein be served upon th� last record
owner of the above described property in the manner provided
by law. ,

THEREFORE , BE IT RESOLVED, that a public hearing be held by and be-
fore the Council of the City of Saint Paul in the Council Chamber of
the Court House in said city at 10 :00 A.M. on De,�Cember �..Q , 1975 to con-
sider the advisability and necessity of ordering' the correction or
wrecking and removal of said structure on the above described property
inasmuch as said structure is reported to constitute a hazard to public
health, safety and welfare; be it
FURTHER RESOLVED, that the Division of Housing and Building Code
Enforcement, on behalf of the City Council , notify by mail the record
owners of the property in question at the last k�own address, as well
as other interested persons of record, of the date and time of the
hearing.
