Dear Mr. Segal:
Enclosed are the origiaal and four copies of the Utility Easement executed bp
th2 ILR.�. This easement is necessary in order to provide public and private
utility service to the first homes being presently const�ructed in the Model
haras of the "Csntral Village Additioa" in the Northeast Quadrant of the _
Summit-University Area.
Along with the copies of the Utility Easement I am transmitting the original
and four copies of the Report to the Cor�anissioners and the Certificate of
the Secretary regarding this Easement.
If acceptable please have them executed, file the ori.gina3. and re^ain one copy. .
Transmit a copy to the Bureau of Valuations and return two copies to the AitA.
� On July 17, 1975 I transmitted to you the original and four copies o� anothex
Utility Easement executed by the HRA. As of today the HRA has not received �
the two executed copies from the city that we requested. Will yQU p2ease

THIS INDENTURE made this 27th day of August, 1975, by and
betwee:� the HOUSING AND REDEVELOPMENT AUT�iORITY� OF THE CITY OF SAINT
PAliL, �-SINNES01^A, a public body corporate and politic, under the laws
of t�!e State of r�innesota, hereinafter the "Authority" , and the
CITY OF SAINT PAUL, I�IIi�TNESOTA, hereinafter the ', "City" .
WITNESSETH:
�v'HEREAS, the Authority is the owner in fee simple of that parcel
of Iand situated in the County of Ramsey, Stat� of P�tinnesota,
described as follows, to-wit:
Lot 25 except the West 10 feet thereof, Lots 26 and 27, the

NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED to, by and between
the parties to this instrument as follows: '
1. The Authority, in consideration of the sum of One Dollar
($1. 00) and other good and valuable consideration, to it in hand
�aid by the City, receipt and sufficiency whereof is hereby
acknowledged, does hereby grant unto the City a perpetuai utiyit�T
easement in, on, under, across and through the following described
parcel of land:

2 . It is further mutually agreed upon by and betw�zn the parties
to this instrument that the following conditions and re�ervations , as
to the above described utility easement area, shall be maintained:
a) The City maintains the right to install, maintain, and
operate publie sewers, water mains, or service connec-
tions in or upon the utility easement area more tully
described above, and to enter upon such property or any
portion thereaf at any time and from time to time for
the purpos� of reconstructing, inspecting, maintaining
or repairing same.
b) The Authority, its successors and assigns, shall make no
change to the existing grade within the utility easement
are a.
c) The Authority, its successors and assigns, shall construct
no building or other permanent structures within the
utility easement area.
d) The Autnarity, its successors and assigns, s2za11 make no
chang� to the existing surface within the utility ease-
ment area.
e) The Authority, its successors and assigns, sh�ll fully
indemnify, defend and save harmless the City, �ts officers ,
agents , employees and servants from all suits, actions
or claims wnich shall arise from .any injuries or damages
received or sustained by any person, persons ar property
by any break or leak in any public sewers, water mains or
service connections in said dedicated easement.

WHEREAS, the City desires a utility easement on, under, across
and through a portion of that land; and
WHEREAS, the Authority desires to grant unto the City a certain
utility easement as set forth more particularly hereinafter to
satisfy the needs of the City. '
NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED to, by and between
the parties to this instrument as follows:
1. The Authority, in consideration of the sum of One Dollar
($1. 00) and other good and valuable consideration, to it in hand
paid ?�y the City, receipt and sufficiency whereaf is hereby
acknowledged, does hereby grant unto the City a per�etuai ui.�lity
easement in, on, under, across and through the following described
parcel of land:
Lot 25 except the West 10 feet thereof, Lots 26 and 27, the '
West 2. 5 feet of Lot 28, and that part of ',Lot 6 except the
West 1G feet thereof, Lots 5 and 4, and tYie West 2, 5 feet of

Lots 16 and 17, Block 9 , P�ackubin and Marshall' s Addition
to St. Paul, and that part of the East 44.20 feet of vacated
Kent St. , lying betw�en the North line of Central Ave. and
the ilorth line of Lot 3�, Block 10, in said Addition extended
Easterly to a point on th2 Easterly line of vacated Kent St. ,
said �oint being the Northwesterly corner bf said Lot 16 .
2. It is further mutually agreed upon by and betwe`n the parties
to this instrument that the following conditions and re�ervations , as
to the above described utiZity easement area, shall be maintained:
a) The City maintains the right to install, maintain, and
operate public sewers, water mains, or servi.ce connec-
tions in or upon the utility easement area more fully
described above, and to enter upon such property or any
portion thereof at any time and from time to time for
the purpos� of reconstructing, inspecting, maintaining
or repairing same.
b) The Authority, its successors and a�signs, shall make no
change to the existing grade within the utility easement
area.
c) The Authority, its successors and a�signs, shall construct
no building or other permanent stru�tures within the
utility easement area.
d) The Autnority, its successors and assigns, shall make no
change to the existing surface within the utility ease-
ment area.
e) The Authority, its successors and assigns, shall fully
indemnify, defend and save harmless the City, its officers ,
agents, employ�es and servants from all suits, actions
or claims wnich shall arise from any injuries or damages
received or sustained by any person, persons or property
by any break or leak in any public sewers, ��ater mains or
service connections in said dedicated easement.
IId WITVESS WHEREOF, the parties have hereunto set their hands
