WHEREAS, The Minnesota Street Rod Association, Clear Charmel/KOOL 108, and
Nemer Fieger are sponsoring "Classic Cruisers, " a street rod event; and
WHEREAS, the event is taking place from June 2 through September 29, 2001 from 6-9
p.m. every Saturday evening; and
WHEREAS, The Minnesota Street Rod Association, Clear Channel/KOOL 108, and
Nemer Fieger would like to use the public right of way located on Kellogg Boulevard between
Robert and Wabasha Str�ets for the event; and
WHEREAS, The Minnesota Street Rod Association, Clear Channel/KOOL 108, and
Nemer Fieger wish to have the City indemnify and hold them harmless from claims related to the
use of the public right of way for the named event; and
WHEREAS, provision of this event serve a legitimate public purpose by bringing
entertainment into the downtown area; and
WHEREAS, the expenditure of public funds, which includes the promise of
indemnification and defense, for such a purpose will facilitate and allow the City to provide such
opportunities, now therefore, be it
RESOLVED, that the City Council of the CiTy of Saint Paul on behalf of the City of
Saint Paul hereby agrees to defend, indemnify and hold harmless the Minnesota Street Rod
Association, Clear ChanneUKOOL 108, and Nemer Fieger from any and all damages they may
be required to pay as a result of suits, claims, actions, or judgments arising out of the use of the
public right of way on Kellogg Boulevard beriveen Wabasha and Robert Streets from June 2-
September 29, 2001.
