1 WHEREAS, the NAACP and the Saint Paul Polic�epartment have engaged in discussions mediated by the U.S.
2 Department of Justice Community Relations Service from Mazch through June 2001; and
3 WHEREAS, these discussions were in lazge part initiaYed based on discrepancies found in data voluntarily collected
4 and disseminated by the Saint Paul Police Department which indicated that racial minority drivers, often males, had
5 their persons and vehicles seazched at a lugher rate than racial majority drivers; and
6 WHEREAS, these discussions led to the articulation of many azeas of common concern where agreements could be
7 reached and a formal agreement developed; and
8 WHEREAS, this formal agreement provides for, among othet things, that the Saut Paul Police Deparhnent will
9 provide a"consent search advisory" in order to ensure citizens' right to remain secure in their personal effects; and
10 WHEREAS, the consent search advisory will be issued by the departmenYs officers in cases where they wish to
11 perForm a consent search and will be phrased as follows: I would like to search you (or your vehicle). You should
12 know that you have the right to refuse to allow me to search you and your vehicle. If you do grant me permission,
13 you may stop the search at arry time. Ifl find arrything illegal, you will likely be arrested and prosecuted. Do you
14 understand what I have just told you? May I search you? May I search your vehicle?
15 WFIEREAS, this change in Saint Paul Police Department policy and practice needs to be communicated broadly to
16 residents, workers and drivers in the City of Saint Paul; now therefore be it �� c � ��
17 RESOLVED, tttat the Saint Paul City Council hereby directs Council Research to develop by�en�st�; 2001, in
18 consultation with the Police Department and Adininish�ation, a proposal for a program to educate members of the
19 community on the provisions of the agreement, specifically the consent search advisory.
