WHEREAS, pursua.nt to Resolution, G. F. 266731, approved
February 5, 1976, a public hearing was scheduled for 10:00 a.m,
on February 5, 1976, before the Council of the Gity of Saint
Paul, said hearing pertaining to the conditinn of the structure
located at 1440 Edgerton, Saint Paul, Minnesota; and
�EREAS, upon facts presented at said h�earing consisting
of photographs, inspection reports and the recommendation of the
Division of Housing and Building Code �nforcement, i.t is found
and determined by the City Council that acco�ding to the records
and files in the office of the Register of Dleeds, the last
record owners of the above described propert�r are Ellyn and
Russell Burkhart, and that there is a mortgage on the property
to Northwestern State Bank; and that it is further determined
that the above described building constitutes a hazardous building
within the definition of Minnesota Statutes Section 463.15 for
the following reasons:

a. The building is standing vacant, abandoned and
is subject to being entered by unauthorized persons;
b. The condition of the building is as follows:
The building has been badly damaged by fire. The roof is
burned through and the entire structure is old and dilapidated.
The foundation of limestone is in poor condition and the re-
taining walls and steps and walks are broken and falling;
c. The building is unfit for human habitation in its
present condition;
d. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
physical dama.ge, dilapidation and inadequate maintenance;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes
Sections 463. 15 through 463. 26, and based upon the foregoing
findings of the City Council, the Cou�cil of the City of
Saint Paul does hereby make the following Order:
ORHER
1. The owners of the above described building shall ma.ke
the same safe and not detrimental to the public peace, health,
safety and welfare by having the said building razed and the
ma,terials therefrom removed from the premises within thirty (30)
days from the date of the service of this Order;
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint �Paul and
filed in the Office of the Clerk of District Court of Ramsey
County, Minnesota within twenty (20) days from the date of the
service of this Order, a Motion for Summary �nforcement of this
Order to raze and remove the said building w�ll be made to the
Ramsey County District Court;

3. In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Gourt,
all personal property or fixtures which may unreasonably inter-
fere with the razin and removal of this bu ilding shall be
removed within ten �10) days from the entry of judgment; and
if not so removed, the City of Saint Paul shall remove and
dispose of such personal property and fixtures as provided
by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against. the above described real estate
and collected as other taxes; and be it
FURTHER RESOLVED, that a certified copy of this resolution
and incorporated Order herein be served upon. the last record
owners of the above described property in thie manner provided
by law.

Honorable Council:
The Division of Housing and Building Code Enf4rcement is hereby submit-
ting its report on the condition of the structure at the location re-
ferred to above.
The owners of record are Ellyn P. Yardeen and Russell Burkhart, 5333
80th Avenue No. , Brooklyn Park, Minnesota 55443.
The legal description of the property is Lot 17, Speiser's Addition
to St. Paul, Minnesota.
' The building is a two-story frame dwelling which has been badly damaged
by fire. The roof is burned through and the �ntire structure is old
and dilapidated. The foundation is of limestone and in poor condition
and the retaining walls and steps and walks are broken and falling. We
believe this building to be beyond feasible rehabilitation and should
be removed as soon as possible.
Inasmuch as the conditions outiined above constitute a public hazard
and the owner has made no attempt to sati�fact�orily repair the damage
despite our warnings, and the continued vacant and boarded up condition
contributes a blighting influence on the neighborhood, it is •Lhe recom-
mendation of this Division that this matter be referred to the City
Att ey's Office for razing and removal through District Court pro-
ce ngs.
