That a permanent drainage easement shall be retained on, over, under and across the vacated
area on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the
City to maintain and operate any sewer in or upon said easement and to enter upon said easement
or any portion thereof at any time and from time to time, for the purposes of future construction,

reconstruction, inspecting, maintaining or repairing the same or any part thereo£ Any
development or use of the property shall be subject to the following condiUons:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit norxnal access to utility facilities for maintenance purposes
will be pemutted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written pernussion from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

3 the Ciry of Saint Paul, its officers and employees from all suits, actions or claims of any character
4 brought as a result of injuries or damages received or sustained by any person, persons or
5 properiy on account of this vacation or sustained due to drainage within the vacated azea or the
6 petitioners' use of this property, including but not limited to, a claim brought because of any act
7 of omission, neglect, or misconduct of said petitioners or because of any claims or liability
$ arising from any violation of any law or regulation made in accordance with the law, whether by
9 the petitioners or any of their agents or employees.

12 That the petitioners, their successors and assigns shall, within 60 days of the effective date of
13 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
14 resolution and shall, within the period(s) specified in the terms and conditions of this resolution,

The Department of Public Works has reviewed the above-referenced request. This portion of the
street is unimproved and there is a steep grade change between this portion of the street and the street
to the west. Currenfly Hill Street to the west drains across the proposed vacated area. Hill Street to
the west is currently ciassified as an oiled or paved alley for maintenance purposes. There is no sanitary
sewer currently available to the abutting property.
The Department of Pubiic Works has no objections to the proposed vacation subject to the following:
1. A permanent drainage easement shall be retained on, over, under and across the vacated area, on
behalf of the City of Saint Paul, Department of Public Works and subject to the foliowing conditions:
a. No buildings, structures, or trees are pernutted within the easement area, nor any temporary
structure, material storage, fixture, or other objects that will prohibit normal access to utility facilities for
maintenance purposes.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved easement rights may be allowed by obtaining written permission from the
Department of Public Works with the understanding that the restoration and costs of such

improvements shall be the sole responsibility of the petitioner, its successors and assigns in the event the
City exercises its reserved easement rights.
c. No change from the existing grade is permitted within the easement azea without the written
permission from the Department of Public Works.
d. No change in surfacing within the easement azea is permitted without the written permission from the
Depariment of Pubiic Works.
e. That the petitioner, its successors and assigns shall indemnify, defend, and save hamiless the City of
Saint Paui, its officers, agents, and employees from all suits, actions, or claims which shall arise from
any injuries or damages received or sustained due to drainage within or of said reserved easement area
arising out of, or resulting from, any action or negligence of the petitioner, its employees, agents, or
business invitees.

As I mentioned by phone City Council will consider a resolution as early as April 4, 2001 requesting all City
dept to finish the vacation process of Hi{I Street so that the Armstrong Hsg may be relocated on the former
Plastics Parking Lot site.
Currentiy there is no site plan for exactly where the Nouse wilf be situated.
John if, you have additional questions please call. I'm also not recalling how Eagle Parkway is currently
park land. since from the Railroad tracks north the platting is not yet complete as city street ROW and we
(City Real Estate, Bob Simon and myself) bought or assisted in the condemnation of the additional
properties in which all Eagle Parkway was constructed from private parties (Plastics - condemnation for
street ROW, West publishing, WJW Properties and Walsh etc.) ??

That a permanent drainage easement shall be retained on, over, under and across the vacated
area on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the
City to maintain and operate any sewer in or upon said easement and to enter upon said easement
or any portion thereof at any time and from time to time, for the purposes of future construction,

development or use of the property shall be subject to the following condiUons:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit norxnal access to utility facilities for maintenance purposes
will be pemutted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written pernussion from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

License, Inspection, Environmental Protection Office (LIEP) before any construction occurs.

3 the Ciry of Saint Paul, its officers and employees from all suits, actions or claims of any character
4 brought as a result of injuries or damages received or sustained by any person, persons or
5 properiy on account of this vacation or sustained due to drainage within the vacated azea or the
6 petitioners' use of this property, including but not limited to, a claim brought because of any act
7 of omission, neglect, or misconduct of said petitioners or because of any claims or liability
$ arising from any violation of any law or regulation made in accordance with the law, whether by
9 the petitioners or any of their agents or employees.

12 That the petitioners, their successors and assigns shall, within 60 days of the effective date of
13 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
14 resolution and shall, within the period(s) specified in the terms and conditions of this resolution,

The Department of Public Works has reviewed the above-referenced request. This portion of the
street is unimproved and there is a steep grade change between this portion of the street and the street
to the west. Currenfly Hill Street to the west drains across the proposed vacated area. Hill Street to
the west is currently ciassified as an oiled or paved alley for maintenance purposes. There is no sanitary
sewer currently available to the abutting property.
The Department of Pubiic Works has no objections to the proposed vacation subject to the following:
1. A permanent drainage easement shall be retained on, over, under and across the vacated area, on
behalf of the City of Saint Paul, Department of Public Works and subject to the foliowing conditions:
a. No buildings, structures, or trees are pernutted within the easement area, nor any temporary
structure, material storage, fixture, or other objects that will prohibit normal access to utility facilities for
maintenance purposes.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved easement rights may be allowed by obtaining written permission from the
Department of Public Works with the understanding that the restoration and costs of such

e. That the petitioner, its successors and assigns shall indemnify, defend, and save hamiless the City of

As I mentioned by phone City Council will consider a resolution as early as April 4, 2001 requesting all City
dept to finish the vacation process of Hi{I Street so that the Armstrong Hsg may be relocated on the former
Plastics Parking Lot site.
Currentiy there is no site plan for exactly where the Nouse wilf be situated.
John if, you have additional questions please call. I'm also not recalling how Eagle Parkway is currently
park land. since from the Railroad tracks north the platting is not yet complete as city street ROW and we
(City Real Estate, Bob Simon and myself) bought or assisted in the condemnation of the additional
properties in which all Eagle Parkway was constructed from private parties (Plastics - condemnation for
street ROW, West publishing, WJW Properties and Walsh etc.) ??

That a permanent drainage easement shall be retained on, over, under and across the vacated
area on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the
City to maintain and operate any sewer in or upon said easement and to enter upon said easement
or any portion thereof at any time and from time to time, for the purposes of future construction,

development or use of the property shall be subject to the following condiUons:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit norxnal access to utility facilities for maintenance purposes
will be pemutted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written pernussion from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

6 petitioners' use of this property, including but not limited to, a claim brought because of any act
7 of omission, neglect, or misconduct of said petitioners or because of any claims or liability
$ arising from any violation of any law or regulation made in accordance with the law, whether by
9 the petitioners or any of their agents or employees.

13 this resolution, file with the City Clerk an acceptance in writing of the conditions of this

The Department of Public Works has reviewed the above-referenced request. This portion of the
street is unimproved and there is a steep grade change between this portion of the street and the street
to the west. Currenfly Hill Street to the west drains across the proposed vacated area. Hill Street to
the west is currently ciassified as an oiled or paved alley for maintenance purposes. There is no sanitary
sewer currently available to the abutting property.
The Department of Pubiic Works has no objections to the proposed vacation subject to the following:
1. A permanent drainage easement shall be retained on, over, under and across the vacated area, on
behalf of the City of Saint Paul, Department of Public Works and subject to the foliowing conditions:
a. No buildings, structures, or trees are pernutted within the easement area, nor any temporary
structure, material storage, fixture, or other objects that will prohibit normal access to utility facilities for
maintenance purposes.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved easement rights may be allowed by obtaining written permission from the
Department of Public Works with the understanding that the restoration and costs of such

improvements shall be the sole responsibility of the petitioner, its successors and assigns in the event the
City exercises its reserved easement rights.
c. No change from the existing grade is permitted within the easement azea without the written

Depariment of Pubiic Works.
e. That the petitioner, its successors and assigns shall indemnify, defend, and save hamiless the City of
Saint Paui, its officers, agents, and employees from all suits, actions, or claims which shall arise from
any injuries or damages received or sustained due to drainage within or of said reserved easement area
arising out of, or resulting from, any action or negligence of the petitioner, its employees, agents, or
business invitees.

The purpose of this right of way vacation is to develop the northerly half of Hili Street west of
Chestnut into a pazking area for housing improvements in the azea.
This property is located in City Council District 2, Planning District 9.

As I mentioned by phone City Council will consider a resolution as early as April 4, 2001 requesting all City
dept to finish the vacation process of Hi{I Street so that the Armstrong Hsg may be relocated on the former
Plastics Parking Lot site.
Currentiy there is no site plan for exactly where the Nouse wilf be situated.
John if, you have additional questions please call. I'm also not recalling how Eagle Parkway is currently
park land. since from the Railroad tracks north the platting is not yet complete as city street ROW and we
(City Real Estate, Bob Simon and myself) bought or assisted in the condemnation of the additional
properties in which all Eagle Parkway was constructed from private parties (Plastics - condemnation for
street ROW, West publishing, WJW Properties and Walsh etc.) ??
