WHEREAS, the Council, pursuant to the provisions of Section 12. 09 of the Saint Paul City Charter and the Public Employment Labor Relations Act of 1971, as amended, recognizes that for the �urpose of ineeting and negoti- ating the terms and conditions of employment, the United Slate and Tile and Composition Roofers, Damp and Waterproof Workers Associaia.on is the ex- clusive representative for City employees falling within the unit as certified by the Bureau of Mediation Services under Case No. 73-PR-511-A; and WHEREAS, the City through designated representatives and the exclusive representative have met in good faith, negotiated conditions and terms of em- ployment for the year through April 30, 1977, for such personriel as are set forth 9� the agreemE�t betv�+een the City and the exclusive repreaentative, now, therefore, THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: �,�: Section 1. That the agreement created as of the effective date of this ordinance between the City of Saint Paul and the United Slate axid Tile and Composition Roofers, Damp and Waterproof Workers Association, Local 96 on file in the office of the City Glerk is hereby approved and the authorized administrative officials of the'City are hereby authorized and directed to execute said agreement on behalf of the City. Section 2. In f�zll settlement of 1976 negotiations, the parties hereto have agreed as follows: (1) Except as herein modified, the Agreement between the parties, entered into September 15, 1975, shall be the basis of the forth- coming I,abor Agreement. (2) Appendix C of said Agreement shall be replaced with Appendix C which is attached hereto and made a part hereof. (3) Appendix D of said Agree�ent sh�11 be replaced with Ag�Zend�x D which - - is attached hereto and made a part hereof. (�) The 1976 Agreement shall become effective May 1, 197E, (5� It i� also agreed that the duration of the 1976 Agreement shall be through April 30, 1977, and that said termination date shall be set forth in Section 30.1 of the new collective bargaining Agreement. It is understood that the above settlement shall be recommended by the City Negotiator, but is subject to approval by the City Administration and adoption by the City Council and the Civil Service Commission. The EMPLOYER shall establish Wor�nan's Compensation and Unemployment Compensation programs as required by Minnesota Statutes. Participating employees as defined in Articles 12.3, 12.4 and 12.5 covered by this AGREEI�'1ENT, shall not be eligible for, governed by, or accumulate vacation, sick leave, heliday, flzneral leave, jury duty, or insurance fringe benefits that are or may be established by Personnel Rules, Council Ordinance, or Council Resolutions. The EMPLOYER'S fringe benefit obligation to participsting employees as defined in Articles 12.3, 12.b and 12.5 is limited to the contributions and�or deductions established by this AGREEMENT.
