WHEREAS, The Council of�'the City of Saint Paul by Resolution
258724 adopted May 23, 1972 did� vacate a porti.on of Edgemont Street
and a portion of the public a21ey in Block 3, 'Da�rson' s 5th Addition
to the City of Saint Paul, Rait►sey County, M�.nnesc�ta, subj ect to the
reservation to the City of Sai�nt Paul of a 30 ft,. wide permanent
sewer easement over the entire length of vacated Edgemont Street
and a construction easement reserved over a portion of Edgemont
Street; and +

WHEREAS, The Council by ��ts Resolution C.F. 260049 adopted
November 7, 1972, as amended b� :Resolution C.F. 261252 adopted
May 11, 1973, did vacate a por�ion of East Idaho Avenue and
Arkwright Street, also the alleys .in Biock 1 and Block 4,
Dawson' s 5th Addition and also �v�cated a part of Lot 6, Block l,
Dawson' s Sth Addition to the Cit�r of Saint Pau1, Ramsey County,
Minnesota, subject to the retention of utility easEments in favor
of the City being a permanent se�ver easement reserv�d over the
entire length of va�cated Idaho� Ayenue and also a permanent ease-
ment reserved over the vacated �Ark�ar�.ght �t�ee�; and

WHEREAS, The Council of t�. ;City of 5aint Paul has been
requested to waive the retained easements in the above two
resolutions and any other easements that may have been retained
by the said resolution, and the affected City departments,
Northern States Power Company and Northwestern Bell Telephone
Company have filed written cer�ificates of intended non-use of
reserved rights and easements which certificates are on file in
the off ice of the City Clerk; and _
WHEREAS, The Departments of the City have advised and
recommended that the Council grant this request and waive the

RESOLVED, That the Council of the City of Saint Paul,
pursuant to Section 228.06 of the Saint Paul I,egisl.ative Code,
as amended, does hereby waive any and al� retained easements
contained in Resolution C.F. 258724 adopted May 23, 1972, and
Resolution C.F. 260049 �dopted November 7, 1972, as amended by
Resolution C.F. 261252 adopted May llr 1973, in the following
described property:
l. East Tda�o Avenue from the east line of Edgemont Street to
the west line of Arkwright Street;
2. Arkwright Street from the south line of Wheelocx Parkway to
the Soo �.ine Railroad right-of-way;
: . The alley in Block 1, Dawson' s 5th Addition to the. City of
Saint Paul Ramssey County Minnesota from the south line of
Wheelock Parkway to the south line of E. Idaho Avenue;
�3. The alley in Block 4, Dawson' s 5th Addition to the City of
Saint Paul Ramsey County Minnesota froma the south line of E.
Tdaho Avenue to the 50o Line Railzoad right-of�way;

Lot 15, Block 3, said Dawson�s 5th Addition, as extended
easterly across Edgemont Street and northwesterly of the Soo
Line Railroad Company Right-of-Way and south of the arc of a
circle having a radius of 60 feet, the center of said circle
being located on the centerline of Edgemont Street at a point
51. 97 feet m.o.,l. southerly of the extended north line of
Lot 5, Block 3, said Dawson' s 5th Addition;
5. Also, that part of the alley in Block 3, Dawson' s 5th Addition
- to the City of Saint Paul Ramsey County Minnesota, which lies
north of the south line of Lot 15, Block 3, said Dawson' s 5th
Addition as extended westerly across said alley and south of
a line 20 feet south of and parallel to the northerly line
of Lot 6, Block 3, said Dawson' s 5th Addition, as extended
across said alley.

easements is for the City of Sairit Paul and fbr those persons for
whom the City has reserved easements in said vacated streets and

mentality.
