2 WHEREAS, the deparhnent of planning and economic development has recently initiated
3 a study of Arcade Street between Nevada Avenue on the north and York Avenue on the south
4 (hereinafter the "Arcade Street Study Area"); and

6 WHEREAS, the said study may lead to the adoption of amendments to the City's
7 comprehensive municipal plan and to its official zoning controls within the Arcade Street Study
8 Area; and

WHEREAS, development within the Arcade Street Study Area while the study is in
progress could result in land uses which would not be consistent with the present goals and
requirements of the City's comprehensive municipal plan and official zoning conirols any
recommendation to amend such plans and controls; and
WI3EREAS, the potential far incompatible or inconsistent development within the
Arcade Street Study Area raises substantial questions relating to the ability of the City's present
official controls to assure compliance with the City's comprehensive plans or amendments
thereto; and
WHEREAS, in light of the pending Arcade Street Area study and far the purpose of
identifying an overall vision for this pivotal area and the immediate need to preserve the status
quo with respect to land use in order to protect the general health, welfaze and safety of the
public pending the conciusion of the said study, the Council of the City of Saint Paul desires to
immediately temporarily prohibit development on any parcel of land or part thereof within the
areas of the Arcade Street Study Area until such time as the aforementioned study has been
completed and the Council of the City of Saint Paul has taken action on the recommendations
contained therein:
NOW, THEREFORE, BE IT RESOLVED, that under separate ordinance, the Council of
the City of Saint Paul will prohibit on any parcel of land or part thereof within the areas of the
Arcade Street Study Area, the issuance or approval of zoning and building permits, plat
approvals or lot splits, until the expiration of twelve months as provided in Minn. Stat. §
462.355, Subd.(4), or until such earlier time as the Council of the City of Saint Paul has taken
action on the recommendations contained in the study; AND,
BE IT FURTHER RESOLVED, that pending the adoption of the intenim ordinance
prohibiting any development inconsistent with the pending study and any amendments to the
City's zoning code within the boundaries of the described azeas, no zoning or building permits,
1 plat approvals or lot splits may be issued or approved, uniess exempted as provided under the �\ -�i �{►
2 terms set forth in Section Three of that same separate ordinance noted above, from this date and
3 until the expirarion of twelve months as allowed by Minn. Stat. § 462355, Subd.(4), or until such
4 eazlier time as the Council of the City of Saint Paul has taken action on the recommendarions
5 contained in the study; AND
7 BE IT FINALLY RESOLVED, that the reshictions contained in this resolution and in the
8 said interim ordinance may be extended by action of the Council of the City of Saint Paul for
9 those additional time periods not to exceed the time provided in Minn. Stat. § 462.355, Subd. (4)
10 in the event such study and recommendations and the deliberarions of the Council requires such
11 extensions of time.
