WHEREAS, pursua.nt to Resolution, C. F. 266922, approved
Mar h 23, 1976, a public hearing was scheduled for 10:00 a.m.
on rch 23, 1976, before the Council of the, City of Saint Paoul,
sai hearing pertaining to the condition of the structure at
730 Wells Avenue, Saint Paul, Minnesota; and '
WfiEREAS, upon facts presented at said hearing. consistYng
of hotographs, inspection reports and the recocnnendation of the
Div' sion of Housing and Building Code Enforcement it is found
and determined by the City Council that according to the records
and files in the office of the Register of Deeds, the last record
own rs of the above described property are Maxvin Holtslander and
Leo a Triemert, that Armand and Sharon Acciarari have an unknown
. int rest in the property, and that Ma.plewood Plumbing and Heating
Co any has filed a mechanic' s lien against the property; and
th it is further determined that the above described building

cons itutes a hazardous building within the definition of
Minn sota Statutes Section 433. 15 for the following rea.sons:
a. The building is standing vacant, abandoned and is
subj ct to being entered by unauthorized persons;
b. The condition of the building is as follows: The
stru ture has sustained extensive fire damage, has been
vand lized, and is littered with debris . Due to age, de-
teri ration, and improper maintenance the structure is in a
haza dous condition and should be removed as soon as possible;
c. The building is unfit for human habitation in its
pres nt condition;
d. The building constitutes a nuisance and a hazard
to t e public health, safety and wel�are because of its
phys 'cal damage, dilapidation and inadequate maintenance;
now, therefore, be it _
RESOLVED, That in accordance with Minnesota Statutes
Sect'ons 463. 15 through 463. 26, and based upon the foregoing
find' gs of the City Council, the Council of the City of
Saint Paul does hereby ma.ke the following Order:
ORDER
1. The owners of the above described building shall ma.ke
the s me safe and not detrimental to the public peace, health,
safet and welfare by having the said building razed and the
ma.ter'als therefrom removed from the premises within thirty (30)
days rom the date of the service of this Order;
. Unless such corrective action is taken to comply with
th is rder or an answer served upon the City of Saint Paul and
filed in the office of the Clerk of District Court of Ramsey
Count , Minn.esota within twenty (20) days from the date of the
servi e of this Order, a Motion for Summary Enforcement of this
Order to ra¢e and remove the said building will be made to the
Ramse County District Court;

3. In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Court,
all ersonal property or fixtures which may unreasonably inter-
fere with the razin and removal of this building shall be
remo ed within ten �10) da.ys from the entry of judgment; and
if n t so removed, the City of Saint Paul shall remove and
disp se of such personal property and fixtures as provided
by 1 w;
4. If the City of Saint Paul is compelled to take any
corr ctive action herein, all necessary costs expended by the
City will be assessed against the above described real estate
and ollected as other taxes; and be it
URTHER RESOLVED, that a certified copy of this resolution
and ' corporated Order herein be served upon the last record
owne s of the above described property in the manner provided
by 1 .

The D'vision of Housing and Building Code Enforcement is hereby sub-
mitti g its report on the condition of the structure at the location
refer ed to above.
The o ers of record are Marvin Holtslander, 378 E. Geranium Ave. ,
Leola Triemert, 1351 N. White Bear Avenue, Armand Acciarari, 758
Jessi St. , Sharon Acciarari, 1604 A. Timberlake Rd. , and Maplewood
Plumb ng and Heating Company.
The 1 gal desaription of the property is:
Lot l, Block 38, Schurmeier's
Subdivis�on of Blocks 38 and 39.
Due t abandonment, age, deterioration, improper maintenance and
sever fire damage, this 1� story frame dwelling is in a hazardous
condi ion and should be condemned and removed as soon as possible.
Inasm ch as the conditions outlined above constitute a public hazard
and t e owner has made no attempt to satisfactorily repair the dam-
age d spite our warnings, and the continued vacant and boarded up
condi ion contributes a blighting influence on the neighborhood, it
is th recommendation of this Division that this matter be referred
to th City Attorney's office for razing and removal through District
Cour proceedings.
