THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Map of the City of Saint Paul, Sheet No. 20, as inco orated by reference in Section 60.401 of the Saint Paul Legi lative Code, is hereby amended as follows: The property owned by Pleasant Hill Nursing Home, Inc., located on the North side of Pleasant Avenue between Western venue and I-35E, more particularly described as Lots 26, 27 and 28, and that portion of vacated alley adjoining said property, Block 86, Dayton and Irvine's Addition, subject to highway right- of way, ' s rezoned from RT-2 to RM-2. This matter was heard by the Current Planning Committee on January 29, 19 6. A letter was read from the Ramsey Hill Association opposing the ex ansion of the structure and requesting that the matter be tabled. Co cern was expressed about garbage on the site and the traffic problem. Ar hur Peabody, the petitioner, explained that there was no intent to de elop other than the office space. A otion to recommend approval of the rezoning carried by a vote of 4 0 1. ISTORY: In 1974, an appeal was granted to construct an addition to n existing nursing home, to increase the bed capacity from 52 beds 0 70 beds, and to relax the required 16 foot setback from Irvine treet to 14 feet. In 1963, an appeal to construct and operate a 2 bed nursing home and an application for a permit for a 37-car arking lot were granted. This property was rezoned from "A" to ' C" Residence in 1963. In 1974 a permit to construct an office addition o the existing nursing home was granted. B. OPOSAL: The petitioner proposes to expand the existing nursing home. C. F ONTAGE AND AREA: The site has a frontage of 112 feet on Pleasant, 5 feet on Irvine, and a depth of 307 feet at its deepest point, for a area of 24,694 square feet. D. S TE CONDITIONS: A substantial portion of the site has extreme steep s ope conditions which renders the property difficult to develop. T e site is bounded on the Southeast by the Pleasant Avenue highway c rridor and on the Northwest by Irvine Avenue. The existing structure i about 10 years old and the structure and grounds are maintained i good condition. E. A EA CONDITIONS: Over the past several years, acquisition and demolition o structures in the vicinity has virtually eliminated the commercial u e in the i�snediate area. Residential uses in the area are mixed in t rms of density, condition and age. F. F DINGS: The requested zoning involves three lots, two of which are either partially occupied by structure, or have permits for expansion ap roved. The remaining parcel, according to our records, is owned by the Minnesota State Highway Department. It appears that the zoning sh uld have been extended to cover the subject property at the time th new Zoning Ordinance was passed. McGuire showed slides of the site and read the staff report. aren Avaloz, representing the Ramsey Hill Association, came forward. he read a letter from the President of the Ramsey Hill Association tating that they oppose the expansion of the structure and request hat the matter be tabled. She expressed concern about the unsightly g rbage on the site and of the bad traffic problem there. She asked w at kind of guarantee there would be that the site will be kept up. M . Sipkins stated that the City Attorney's office considers this kind o request as a request for conditional zoning and advised the board t at this kind of conditional zoning is sub,ject to attack. He stated t at most states hold this zoning to be invalid. M . McGuire stated that this is a special condition use and that the P1 nning �ommission can set the conditions. He stated if these conditions ar not met, that they will be in violation and legal procecures wi 1 be taken against them. Lu y Fricke, of 360 Summit Avenue, came forward. She expressed concPrn ab ut how high the building could be. • Mr. McGuire stated that the maximum height allowed is five stories or fif y feet. He stated that a building engineer would ha.ve to decide the height c.apacity of the present structure if any vertical expansion wer to be considered. Art ur Peabody came forward and stated that he has not madE application for an addition to this facility.
