AN ORDINANCE GRANTING PERMISSION TO WHIRLPOOL CORPORATION,
850 ARCADE STREET, SAINT PAUL, MINNESOTA, TO CON�TRUCT,
MAINTAIN, AND OPERATE AN OVERHEAD CONVEYOR BRIDGE ACROSS
ARCADE STREET SOUTH OF WELLS STREET, MORE ACCURATELY
DESCRIBED AS LYING 60 FEET SOUTH OF THE NORTH END OF
MINNESOTA HIGHWAY DEPARTMENT BRIDGE NUMBER 5514.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 . That permission and authority are hereby granted to
irlpool Corporation, 850 Arcade Street, Saint Paui , Minnesota, to con-
s ruct, maintain, and operate an overhead conveyor bridge across Arcade
S reet south of Wells Street, more accurately described as lying 60 feet
s uth of the north end of Minnesota Highway Department Bridge Number 5514.
Section 2. That the Director of Public Works is hereby authorized
t issue necessary permits to Whirlpool Corporation for the construction, _
intenance, and operation according to the plans and specifications
pproved by and on file with the Department of Public Works for said
erhead conveyor bridge, subject to the following terms and conditions.
a. That said permittee and/or its successors in lnterest shall
urnish and deliver unto the City of St. Paul a Surety Bond in the amount
f fifty thousand dollars ($50,000.00) , for said overhead conveyor bridge
ade and executcd by said permittee and/or its successors in interest as .
rincipal , and a Corporate Surety Company duly authorized to transact
usiness in the State of Minnesota as Surety, to and in favor of the City
f St. Paul as obligee, conditioned upon the permittee and/or its suc-
essors in interest complying wTth the terms and conditions of this
rdinance, and also conditioned that, in the event the permittee and/or
ts successors in interest fait to maintain, repair or replace the over-
ead conveyor bridge to a reasonable standard of safety, or fail to
anove said overhead conveyor bridge upon order by the Council , the City

o St. Paui may undertake the maintenance, repair, replacement or
� r oval thereof and may recover its reasonabte cost incurred thereby
f om said surety, which Surety Bond shall remain in force and effect
� a long as said overhead conveyor bridge or any part thereof remains
i that portion of Arcade Street as shown on plans on file with the
D partment of Public Works. The Surety Bond shall be in such form as
s all be approved by the City Attorney, and shall have such Surety as
s all be approved by the Director of Finance and Management Services;
b. That said permittee and/or its successor in interest shall ,
a its own cost and expense and in accordance with all applicable
o dinances of the City of Saint Paul , Statutes of the State of Minne-
s ta and regulations of public authority having cognizance, construct,
intain, and operate said overhead conveyor bridge hereunder;
c. That said permittee and/or its successors in interest shall
ake out and maintain during the period of this permit a comprehensive
rotective public liability insurance which shall remain in force and
ffect as long as said overhead conveyor bridge or any portion thereof is
aintained and located on the public right-of-way of Arcade Street.
his liability insurance shall fully indemnify, hold harmless, and
efend the City of St. Paul , its agents, officers and employees from
ny and all damages, claims, losses, judgments, suits or expense on
ccount of all claims of whatever nature arising out of or connected
ith the construction, maintenance, operation and/or subsequent removal
f said overhead conveyor bridge.
The liability insurance shall be issued by an insurance company
licensed to do business in the State of Minnesota and the premium and
11 expenses incidental thereto shall be paid promptly by the permittee
initially and upon renewal . A certificate of this insurance policy
shall be submitted to the Office Engineer, Department of Public Works,
and must be of a form acceptable to the City Attorney. Before any
expiration, said permittee shall deposit with the City of St. Paul a
new certificate to replace any expiring insurance. The permittee and
the City shall be named as Jointly insured with limits of liability
indicated as follows:
Bodily injury insurance (including death) in an amount of not
tess than $250,000.00 for all damages arising out of bodily
injuries to or death of one person, and, subJect to the same
limit for each person, in a total amount of not less than
$500,000.00 on account of any one accident. Property damage
insurance in an amount of not less than $150,000.00 for all
damages to or destruction of property in any one accident, and
subject to that limit per accident, further subject to a total of
not less than $200,000.00.
d. That said permittee shall submit the necessary bond and in-
surance documents to the Office Engineer of the Department of Public
Works. The Office Engineer shall submit said documents to the City
Attorney for review and, if said bond and insurance are acceptable,
said documents shall be filed with the Department of Finance and
Management Services;

' � � rees and shall undertake to fully indemnify, hold harmless, and defend
, he City of Saint Paul , its agents, officers and employees from any and
il damages, claims, losses, Judgments, suits or expenses of whatever
_ ature for inJury to person and/or property arising out of or connected
• ith the construc�ion, erection, maintenance, operation and removal of
aid overhead conveyor bridges;
f. That said permlttee shall pay the cost of publication of thfs
rdinance and all resolutions passed in relation to sa.id ordinance;
g. That said permittee shall pay the costs of administration, engi-
eering and inspection incurred by the Department of Pubiic Works because
f this undertaking; said costs are estimated as a sum of $900.00 and shall
e accounted for under Department of Public Works Project Number E-1232;
h. That said permlttee shail construct said overhead conveyor bridge
ntirely at its own expense, in accordance wlth the plans and specifications
f said permittee which have been approved by and are on file in the Depart-
ent of Public Works and identified as Public Works Project Number E-1232;
uch construction shall be made in strict compliance with the City of Saint
aul Building Code and be authorized under a permit issued by the Department
f Community Services;
i. That said permittee shall notify in writing the Bridge Engineer of
the Depattment of Pubiic Works five (5) working days before construction be-
gins and notify the same said Engineer when construction has been completed
to allow for a final inspection; �
j . That in the event the Saint Paui City Council shall determfne, by
resolution, that the conti�ued presence of the overhead conveyor bridge con-
fiicts with the public's use of the dedicated public street, the petitioner
or its successors in interest sha) 1 remove the overhead conveyor bridge at
its own expense and at no expense to the City.
k. That said permittee shall notify the Traffic Operations Bureau of
the Department of Public Works five (5) working days in advance if the con-
struction, or maintenance of said overhead conveyor bridge shall make neces-
sary the closing of Arcade Street or any part thereof; all expenses incurred
by the Traffic Operations Bureau in furnishing,, installing, or removing of
barricades, signs, and other control devices, shall be paid by the permittee
and accounted for under Department of Publtc Works Project Number E-1232; '
1 . That said permittee and/or its successors in interest shall not use
any part of said overhead conveyor bridge for any advertisement or display
' purposes and the appllcation thereto of �any advertising material or display
shaii be deemed prohibited bY this ordinance; Prov�ded, hoWeVel^, that the
permfittee may place on the br7dge its company`s name.
m. That said permittee. and/or its successors 1n interest shall complete
the construction and erection of said overhead conveyor brldge hereunder and
in accordance wtth these requirements by no later than 6 months after corrnnence-
� ment of constructton; �
� �n. That said permittee and/or its successors in interest expressly agrees
to corr,ply with Chapter 216 6f the Saint Paul Legislative Code as amended per-
taining to street obstructions;

ut. Upon completion of such structural repairs approved by the Department

howing the work done and ma�ked with any "as butlt" changes, as well as
rints of shop drawings of the same;
q. That said permittee and/or its successors in interest shall , among
ther things, at their own cost and expense, make adequate and effective
rovisions therefor and drain all moisture, ratn and snow which shall ac-
umulate thereon by proper devices through said overhead conveyor bridge
nd in a manner so that the flowing and/or spilling of same on any part of
aid section of Arcade Street shall be prevented at all times. Said per-
ittee and/or its successors in interest shall matntain and operate said
verhead conveyor bridge at its sole cost and expense in a safe condition;
r. That said permittee shall , withln twenty (20) days from and after
he passage of this ordinance, file written acceptance thereof, specifically
greeing to all tl� provtsions, terms and conditions herein, with the City
lerk.
Section 3.
That this ordinance shail take effect and be tn force thirty (30) days

Attached please find an amended page 3 for Ordinance No..
267057 pertaining to permit to Whirlpool Corporation,
allowing them to build an overhead bridge across Arcade
Street, The change is to paragraph 1 when the following
words were added at the end of that paragraph, to-wit:
"provided, however, that the permittee may place on the
bridge its company` s name."
This should be presented to the City Council at its meet-
ing on Thursday, April 22nd, so that they may consider
amending the proposed ordinance at that time. This draft
was prepared in accordance with the City Council' s action
on Ap il 15, 1976.
