RESOLVED, That the proper City officials are hereby authorized
d directed to enter into a Lease Agreement with La.nce P. Crowley,
net K. Crowley, Ma.rlys M. Crowley and Janice M. Kerna.l, a partner-
s ip, whereby the partners will conduct a course in women' s gymna.s-
t'cs for a period of one year at the Mounds Park Recreation Center,
copy of said agreement to be kept on file in the Department of
F'nance and Mana.gement Services.

LEASE AGREE?�1ENT
THIS AGREEMEIV'T, Dated thi s day of ,
1 76, by and between the CITY OF SAINT PAUL, l�Iinnesota, hereina.fter
r ferred to as "City", and LANCE P. CROWLEY, JANET K. CROWLEY,
RLYS M. CROWLEY and JANICE M. KERNAL, herei�after referred to as
" artners", for the lease of portions of the City' s Mounds Park
R creation Center, 1000 Pacific Street, Saint Paul, rlinnesota, here-
i fter referred to as "Facility";
WITNESSETH:
IT IS MITTUALLY AGREED BY AND BETWEEN THE CITY AND PARTNERS
A FOLLOWS:
1. In consideration of Seven Hundred Fifty and no/100 Dollars �
( 750.00) to be paid by Partners, the City hereby leases to Partners
t ose portions of its Facility for the dates and times set forth
b lotiv. The sum payable by the Partners to the City shall be remitted
i equa.l installments of One Hundred Eighty-seven and 50/100 Dollars
( 187.50) on August 1 and November 1, 1976, and February l and May
1 1977.
2. During the months of Ma.y, 1976 and September, 1976 through
A ril, 1977, Partners shall ha.ve the exclusive use of the main gym-
sium at the Facility as follows:
a) Monday 4:30 P.M, to 6:30 P.M,
b) Tuesday 4:30 P.M. to 6:30 P.M.
c) Wednesday 4:30 P.M. to 8 :00 P.M.
d) Saturday 8 :30 A.M. to 1:00 P.M.
3. During the months of July and August, 1976, Partners sha.11
ve the exclusive use of the main gyrnnasium at the Facility as

a) Tuesday 4:30 P.M. to 9:00 P.M.
b) Thursday 4:30 P.M. to 9:00 P.M.
4. During the months referenced in paragraphs 2 and 3,
P rtners sha.11 also have the use of two (2) connectin.g classrooms
a d the ma.in ha.11way in the classroom section at the Facility on
a exclusive basis at the following hours:
a) Monday through Friday - 2 :00 P.M, to 10:00 P.M.
b) Saturday - 9 :00 A.M. to 1:00 P.M.
5. Any alterations to the portions of the Facility granted
t Partners hereunder shall only be done with the prior approval of �
t e City' s superintendent of Parks and Recreation and performed
u der his direction and control.
6. Partners' use hereunder is for the purpose of conducting a
c urse of instruction in gymnastics and tumbling for which Partners
s 11 make a reasonable charge therefor to members of the public.
7. While Partners' use is to be primarily for instruction to
w men in gymnastics and tumbling, Partners will offer enrollment in
i s courses to persons of the ma.le gender who ma.y apply and will
f rther abide by the provisions of Chapter 74 of the City's Legis-
1 tive Code commonly known as the "Human Rights Ordinance."
8. Partners will save and hold harmless the City from any
a d all claims of wha.tever kind tha.t ma.y arise out of its and its
s aff' s and students ' participa.tion in the course of instruction
r ferenced herein. In order to give this indemnification of the
C ty by Partners full force and effect, Partners agree to provide,

a its own expense, general public liability insurance in the
ount of One Hundred Thousand Dollars ($100,000.00) per indivi-
d 1 injury or death, and Three Hundred Thousand Dollars ($30d,000.00)
i the aggregate. Additionally, Partners will provide, at its own
e pense, Workers' Compensation Insurance in the statutory amounts
a d property dama.ge liabiiity insurance in the amou-nt of Fifty
T ousand Dollars ($50,000.00) . Such insurance as referenced here-
i shall name the City as a co-insured and shall be presented to
t e City Attorney on rlay 1, 1976.
9. Except as qualified above, it is contemplated tha.t this
a reement sha.11 commence Ma.y 1, 1976, and sha.11 terminate on May 1,
1 77. This agreement sha.11 be renewable on a yearly basis. At any .
t me during the course of this agreement, either pa.rty ma.y terminate
t e agreement without cause upon ninety (90) days ' written notice
0 one party to the other.
10. Partners agree tha.t at all times hereunder they are in-
d pendent contractors, not regular employees of the City, and,
a cordingly, are not entitled to any of the benefits of regular
e ployees of the City.
