WITNESSETH: Wf�REAS, the MTC desires to have prepazed engineering construc- tion plans, specifications, and cost estimates for the cons�ruction of a park-ride lot lxated at Cc�mo Avenue and Eustis Street, St. � Paul, Minnesota, and °- Wt�REAS, it is recognized by the MTC that such work can be performed most rapidly and efficiently by utilizing the services � r of the City experienced in engineering, traffic, related field ser- trices and construction, and WF�REAS, the City and MTC, respectively, own property upon which the park-ride lot is to be developed, and WHEREAS, the City has expressed 'a willingness to provide the required engineerinq and design services, and construction consul- , tation, � � � � � ��'�4��5 . , . . _�_ NOw TF�REFORE, in consideration of the mutual covenants here- n contained, the parties hereto mutually covenant and agree as _ ollows: SECTION T. Services ta be Performed by the City . � � A. The City shall prepare preliminary cost esti.mates, con- struction plans, and specifications generally in accordance with the Metropolitan Transit Commission's Standards for Design and _ � Maintenance of Bus-Related Raad Improvements, dated July 16, 1975, and the Minnesota Standard Specifications for Highway Construction, dated 3anuary 1, 1972, and the Supplemental Specifications for-�. Highway Construction,.dated January 1, 1974. - B. The City shall deal fully with the following features in the glans: 1.. Grading, Paving, and drainage . 2. Bavement constructian 3. Sidewalk reconstruction 4. Landscaping and planting , 5: Signing and striping of auto parking areas 6. Lighti.ng ► . �. C. When private utility relocation or reconstruction is made necessary by either street or sidewalk construction, then City shall . establish appropriate locational criteria to enable concerned com- � �, panies to relocate their facilities. The locational criteria will be presented to the comganies sufficiently in advance of construction contract letting to enable their et�gineers to make the necessary utility adjustment plans. D. The City shall prepare construction drawings and speci- fications in form and number sufficient for all public biddinq pro- cedures and the letting of construction contracts. The City shall prepare a detailed construction cost estimate in sufficient detail to include al2 major items of work. E. The City shall furnish any special services �equired, including, but not limited to, soils investigations and field surveys. � � F. The City shall provide inspection service durinq construc- tion. This service shall include a review of the remaval and con- struction work in progress to assist in obtaininq the quality of . � ' work which will comply with the construction specifications. This � inspection shall be on a part-tiune basis except during such times when the amount of work being performed is sufficient to merit fu11- ti.me inspection services. G. The City sha11 submit to the MTC and Urban Mass Transpor- tation Administration the drawings, specifications, and related bidding documents for review and approval prior to solicitation of bids for construction. . � � : ����� 5 -4- . H. The MTC will advertise for bids and award a contract. I. The City will distribute bidding materials to potential _ . bidders, and evaluate potential bidder's requests for substitutions � and alternative methods, and issue addenda ta a11 potential bidders on changes or clarifications, as approved by the MTC. J. The City shall review and recommend to the MZ,C approval or rejection of contract documents (insurance foxzns, bonds, reports, etc.) submitted by the contractor(s) prior to the awar� of a con- ' tract. , K. The City shall estimate the value of the work in place at the end of ��each month. The City shall review and approve the Contractor's request for periodical and final payment and submit this informatian to the MTC £or review and payment upon MTC approval. Payxaent will be made to the contractor by the MTC. L. Maintenance of Records shall be those commonly used bp the Public Works Department of the City. �Records shall be maintained which show actual time devoted, materials used, and costs incurred. . . SECTION II. Budget The total maxi.mum budget for the design and constructian con- � .� sulting costs shall be confined to a total not to exceed eight thou- sand two hundred and no/100 dollars ($8,200.00) , with payment for . the various phases of the work not to exceed the amounts shown below. Campen�ation . A. Charges for the services required under the Contract shall equal t�o the amount of base salaries of each and all emplogees f the City, plus an increment of overhead which shall be the same s that used by the City in billing for engineeri.ng services to. � ther public agencies and which shall not exceed 25� of the base salary, for the time that said employees shall be engaqed in the roviding of services herein defined. Materials shall be paid for - � at the City's purchase or reproduction costs for such materials. B. The City shall keep detailed time reco-rds and accounts : as shall permit the submission to the MTC of a detailed statement .. .... . .. ._. . . -• adjusted in accordance with sub-paragraph "A" above, showing the amount due the City for all materia2s furnished and for all w�ork • and services performed hereunder by its employees. C. The City shall submit a statement and request for payment - of amount due under this Contract at monthly intervals:fas each such period that work is performecr until completion of the project. Upon receipt and approval of said statements, the MTC shall make payment within 30 days. k ECTION IV. Time of Performance The design phase shall be completed with 60 work days followinq the ollowing the authori2ation to proceed with that phass.
