Ess:t o�-Gts NOTES OF THE SPECIAL LEGISLATIVE HEARING 705 Sims Avenue Monday, June 11, 2001 Room 330 Courthouse Gerry Strathman, Legislative Hearing Officer The meeting was called to order at 2:12 p.m. STAFF PRESENT: Jason Broberg, Steve Magner, and Michael Morehead of Code Enforcement Anneal of Sammar�Abatement Order at 705 Sims Avenue Sherri B. Forrest, owner, appeazed and stated she is trying to bring the house up to code. She has minimal use of her aght arm, and has to have surgery again. She has been applying for loans and grants, but hasn't heard too much yet. On the suminary abatement order, Gerry Strathman stated, the inspector has marked garbage, rubbish, discazded furniture, vehicle parts, scrap wood, metal, recycling materials, household items, building materials, rubble, and tires as being on the property. Ms. Forrest responded people use her yard and the alley as a drop off site, and she is constantly picking up these items. She has a trailer in the reaz of the property, and does not know what other vehicle parts there aze. One car had a flat tire. That has been taken caze of, and the car is operable now. Her own items plus other people's items ue overwhelming. She does not know what to do about that. The electrician comes tomorrow to hook up motion detector lights. Mr. Strathman asked does she live at 705 Snns. Ms. Forrest responded no. The building is not currently secured, stated Mr. Strathman. He asked how she keeps people out. Ms. Forrest responded she locks the doors. She is not there during the day. It is vacant at the moment. Mr. Strathxnan asked was the building and gazage secured by normal means. Ms. Forrest responded yes, Steve Magner reported he opened this file December 6, 2000. The vacant building file was based on a referral by Code Enforcement, who condemned the properry. There aze numerous suuunary abatements and tags plus three outstanding warrauts. This is an ongoing issue, and the property continues to receive complaints. There is a continual flow of things stored in the yard. The law reads that there is no exterior storage of building, conshuction, automotive parts, etc. The only things that should be stored outside aze patio fiuniture, kids toys, and other items for the exterior. On the day the sununary abatement order was issued, the garage was open and the front door was not properly secured. There is illegal occupancy of the property. There was no response from the owner to come to the door. The property should be boarded to ensure that no one is living there. Ms. Forrest can get pernrits and have someone doing repairs. She has been living there and not doing repairs, her daughter and young children are living there and not doing nothing. o�., ��� SPECIAL LEGISLATIVE HEARING, 705 SIMS AVENOE, June 11, 2001 Page 2 Michaei Morehead reported that on May 31, a squad checked out something neaz 705 Sims. Around the corner, a man was unloading carpet that he said he was bringing to Ms. Forrest. The caz she was driving was in the back alley, and it did not have a license. Drugs were found in the man's truck. He said the drugs belonged to Sherrie, and he was taken to j ail. The car in the alley disappeazed. Evidently, Ms. Fonest was in the house that day and did not come out. She had three outstanding warrants. Mr. Morehead went to the house again, lrnocked on the front door, and no one answered. He spoke to some neighbors. Someone told him that Ms. Forrest ran out the back door. Ms. Forrest is not cooperative, stated Mr. Morehead. She got a bondsman to post bail for the man. She may not have the ability to fmance the property and bring it into compliance. If she is in the house after 8:00 p.m, she will be arrested. Boarding the house at this point is an e�rtreme action. Ms. Forrest stated a friend of hers was using her caz. Mr. Strathman responded that is not what today's hearing is about. Ms. Forrest stated she is not working on the house without a permit. The people buying the house had been putting up sheetrock. It was their responsibiliTy to pull permits. She plans on taking them to court over this matter. Mr. Strathman stated his role is to review the actions by the enforcement staff to see if they are in accordance with the law. There does not seem to be any question that it is within their authority to order the exterior cleaned. The order to do that was issued on June 6. Ms. Forrest has uritil 7une 12 to clean up the exterior. As for the boazding, Mr. Strathman agrees it is an unusual measure. Given the exterior, the fact that the properry should be vacant and unoccupied, and ali buildings aze to be secured, requiring it to be boarded is a reasonable exercise of Code Enforcement's authority. Ms. Forrest stated she thought she could not have people working on the property. Mr. Strathman responded she can have people work there. He will deny the appeal. Because of the nature of ttris matter, he will bring this before the City Council on Wednesday, June 6; therefore, Ms. Fonest has until Thursday, June 7, to get the exterior cleaned up or the City will clean it and chazge her. Likewise, the City will do the boarding. It is expensive for the City to do it. Ms. Forrest is better offhaving to do it herself. He encouraged her to use the nea�t few days to clean the outside, secure the doors and windows on the first floor. Mr. Strathman denied the appeal. Ess:t o�-Gts NOTES OF THE SPECIAL LEGISLATIVE HEARING 705 Sims Avenue Monday, June 11, 2001 Room 330 Courthouse Gerry Strathman, Legislative Hearing Officer The meeting was called to order at 2:12 p.m. STAFF PRESENT: Jason Broberg, Steve Magner, and Michael Morehead of Code Enforcement Anneal of Sammar�Abatement Order at 705 Sims Avenue Sherri B. Forrest, owner, appeazed and stated she is trying to bring the house up to code. She has minimal use of her aght arm, and has to have surgery again. She has been applying for loans and grants, but hasn't heard too much yet. On the suminary abatement order, Gerry Strathman stated, the inspector has marked garbage, rubbish, discazded furniture, vehicle parts, scrap wood, metal, recycling materials, household items, building materials, rubble, and tires as being on the property. Ms. Forrest responded people use her yard and the alley as a drop off site, and she is constantly picking up these items. She has a trailer in the reaz of the property, and does not know what other vehicle parts there aze. One car had a flat tire. That has been taken caze of, and the car is operable now. Her own items plus other people's items ue overwhelming. She does not know what to do about that. The electrician comes tomorrow to hook up motion detector lights. Mr. Strathman asked does she live at 705 Snns. Ms. Forrest responded no. The building is not currently secured, stated Mr. Strathman. He asked how she keeps people out. Ms. Forrest responded she locks the doors. She is not there during the day. It is vacant at the moment. Mr. Strathxnan asked was the building and gazage secured by normal means. Ms. Forrest responded yes, Steve Magner reported he opened this file December 6, 2000. The vacant building file was based on a referral by Code Enforcement, who condemned the properry. There aze numerous suuunary abatements and tags plus three outstanding warrauts. This is an ongoing issue, and the property continues to receive complaints. There is a continual flow of things stored in the yard. The law reads that there is no exterior storage of building, conshuction, automotive parts, etc. The only things that should be stored outside aze patio fiuniture, kids toys, and other items for the exterior. On the day the sununary abatement order was issued, the garage was open and the front door was not properly secured. There is illegal occupancy of the property. There was no response from the owner to come to the door. The property should be boarded to ensure that no one is living there. Ms. Forrest can get pernrits and have someone doing repairs. She has been living there and not doing repairs, her daughter and young children are living there and not doing nothing. o�., ��� SPECIAL LEGISLATIVE HEARING, 705 SIMS AVENOE, June 11, 2001 Page 2 Michaei Morehead reported that on May 31, a squad checked out something neaz 705 Sims. Around the corner, a man was unloading carpet that he said he was bringing to Ms. Forrest. The caz she was driving was in the back alley, and it did not have a license. Drugs were found in the man's truck. He said the drugs belonged to Sherrie, and he was taken to j ail. The car in the alley disappeazed. Evidently, Ms. Fonest was in the house that day and did not come out. She had three outstanding warrants. Mr. Morehead went to the house again, lrnocked on the front door, and no one answered. He spoke to some neighbors. Someone told him that Ms. Forrest ran out the back door. Ms. Forrest is not cooperative, stated Mr. Morehead. She got a bondsman to post bail for the man. She may not have the ability to fmance the property and bring it into compliance. If she is in the house after 8:00 p.m, she will be arrested. Boarding the house at this point is an e�rtreme action. Ms. Forrest stated a friend of hers was using her caz. Mr. Strathman responded that is not what today's hearing is about. Ms. Forrest stated she is not working on the house without a permit. The people buying the house had been putting up sheetrock. It was their responsibiliTy to pull permits. She plans on taking them to court over this matter. Mr. Strathman stated his role is to review the actions by the enforcement staff to see if they are in accordance with the law. There does not seem to be any question that it is within their authority to order the exterior cleaned. The order to do that was issued on June 6. Ms. Forrest has uritil 7une 12 to clean up the exterior. As for the boazding, Mr. Strathman agrees it is an unusual measure. Given the exterior, the fact that the properry should be vacant and unoccupied, and ali buildings aze to be secured, requiring it to be boarded is a reasonable exercise of Code Enforcement's authority. Ms. Forrest stated she thought she could not have people working on the property. Mr. Strathman responded she can have people work there. He will deny the appeal. Because of the nature of ttris matter, he will bring this before the City Council on Wednesday, June 6; therefore, Ms. Fonest has until Thursday, June 7, to get the exterior cleaned up or the City will clean it and chazge her. Likewise, the City will do the boarding. It is expensive for the City to do it. Ms. Forrest is better offhaving to do it herself. He encouraged her to use the nea�t few days to clean the outside, secure the doors and windows on the first floor. Mr. Strathman denied the appeal.
