RESOLVED, That the Council of the City of Saint Paul
does hereby approve the Community Development Block Grant `,
Program Year TT agreement with the Housing and Redevelop-
ment Authority of the City of Saint Paul setting forth the
programs and activities to be performed by the Authority i
in Year TT and providing CD funds to the Authority in the
amount of $12,474, 999. 00, and the proper City officers a�e �

The attached CD Year II contract with HRA and resolution
have been approved as to form by myself. You should attach
to all copies of the eontract, including the copy attached
to the resolution, the EXHIBIT A, which E�hibit sets forth ;
the program activities to be undertaken by the Housing ;
Authority. In addition, you should attach to all copies
the corrected budget for HRA.
Paragraph 3 of the contract provides that transfers of '
funds within the approved budget may be made by the Housing
Authority with the prior written approval of the Mayor.
Any additional� funding to be provided to the HRA requires
prior approval of the City Council. This procedure is ;
comparable to the Charter provisions authorizing the Mayor �
to transf er funds within the City Department and any ,�
transfer of fun�s from dzpartment to department must be
made by the Mayor with the approval of the City Council. j

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
AGENCY AGREEMENT
THIS AGREEMENT, entered into this day of ,
1976, by and between the CITY OF SAINT PAUL, a municipal corpo-
ration of the State of Minnesota, hereinafter designated "City" ,
and the HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF SAINT
PAUL, MINNESOTA, a public body corporate and politic created
pursuant to Minnesota Statutes, Sections 462. 411, et seq. , here-
inafter designated "Authority" .
WITNESSETH:
WHEREAS, in compliance with the Federal Aousing and Co�nmunity
Development Act of 1974 (Public Law 93-383) and Rules and Regu-
lations adopted pursuant thereto, the City has duly made application
to the U. S. Department of Housing and Urban Development for
Community Development Grant Program; and
WHEREAS, the City has been awarded a grant for Community
Development Year II for the purpose of carrying on the program
approved by the City Council and submitted to the U. S. Departm�nt
of Housing and Urban Development; and
WHEREAS, the Authority has prepared, approved and submitted
for ratification to the City Council, its Redevelopment Plan for
Corununity Development, which Redevelopment Plan was ratified by
the City Council and which R�development P1an is contained in and
nade a part of the City' s Fed�rally-approved Community Devel.opment
Grant Program; and

WHEREAS, the City and Authority desire to enter into this '
Agreement for the purpose of setting forth their respective
responsibilities in carrying out to a successful conclusion the
City' s approved Community Development Grant Program in accordance ,
with all applicable Federal, State and Local laws. I

NOW, THEREFO_.E, THE CITY AND AUTHORIT O
AGREE AS FOLLOV�7S:
l. Term of Agreement: This Agreement and activities author-
ized hereunder shall take effect and be in force from and after the ,

lst day of June, 1976, and shall be in force and effect for the ;
term af the City' s Community Development Program Year II as
established and as may be extended by the U. S. Department of I�I
� H�using and Urban Development. j

2. Scope of Service: The Authority shall perform all those �I
activities set forth in the City' s Federally-approved Community
Development Grant Program and Authority' s City approved Redevelop-
ment Plan which specifically provide for and require development
and implementation by the Authority. The program activities to be
undertaken or coordinated by the Authority are set forth in the
attached Exhibit A, and shall be undertaken by the Authority in
a�cordance with the provisions contained in the City' s Federally-
approved Community Development Program. In carrying out its
activities under this Agreer.tent, the Authority shall report
periodically to the City on the status of the programs.

3. Fundin : All funds required for these programs undertaken
by the Authority shall be provided by the City with funds derived
I
from its Federally approved Community Development Program Grant.
The Authority shall be entitled to receive advance of funds upon
submission of a request therefor. The request for payment of
advances shall be in such form as may be required by the City to
cor:iply with all Federal, State and Local requirements. All
requ+ests for funds shall conform to the items contained in the
Budget (HUD Form 7015. 5) attached to this Agreement and the
provisions of this Agreement. The City shall make such advance
payments to the Authority within three working days from the
receipt of the Authority' s request.
All requests for funds shall conform to the items contained
in the Budget attached to this Agreement, marked Exhibit A, and any
increases or transfers of funds contained in the Budget and Pr�ogram
items set forth therein shall first require the approval of� the
City Council expressed by its resolutian; provided, ho�aever, that
the Authority Board, with the prior v�rritten approval of the Mayor,
may increase any line sub-category by a total amount not to exceed
$10, 000 without the Council' s consent. Funds may not b� trans-
ferred between the operating portion of the budget and the program �
portion of the budget without the City Council' s approval. Any
change in total budget amount shall require the prior approval
of the City Council expressed by its resolution, provided that
oi the total approved figure of $3,500, 000 Administxation and

other operating expense, the Authority shall not expend in excess
of the amount of $2, 041, 666 without further approval of the City
Council expressed by its resolution. In addition to the quarterly �
report required under pa�agraph 6, of this Agreement, the l�uthority
shall report to the City on a monthly basis respecting all transfers
of f unds authorized hereunder.
4. Independent Contractor. For the purpose of this Agree-
ment, the Authority shall be deemed to be an independent contractor,
and not an employee of the City. Any and all employees of the
Authority or other persons, other than City employees, while
engaged in the performance of any work or services required by
the Authority under this Agreement, shall not be considered
employees of the City; and any and all claims that may or might
arise under the Workmen' s Compensation Act of Minnesota on behalf
of said employees or other persons while so engaged, hospitalization
insurance coverages, Social Security and pension payments and
benef its, other employee obligations and benefits, shall in no
way be the obligation or responsibility of the City. The
Auchority shall pay as they become due all just claims for work,
tools, machinery, skill, materials, insurance premiums, equipment
and supplies, personnel and all other contractual obligations
entered into pursuant to and in the performance of this Agreement.
5. Non-Discriminatio�: The Authority shall be deemed a
contractor for the annlication of all provisions hereof and

ordinances and other laws against unlawful discrimination on '

account of race, creed, sex, age, disability, sexual preference, I
or color. I

This Agreement is subject to Title VI of the Civil Rights �
i
�1ct of 1964 (Public La�a 88-352) and the rules and regulations !,
i
issued pursuant thereto, an� the Authority shall comply with %
I
Executive Order No. 11246, entitled "Equal Employment Opportunity" ,
as supple�nentec] in Department of Labor Regulations (4 CFR, Part 60) .
The Authority agrees to comply with all the terms and conditions
set ic�rth in Chapter 238, Laws of DZinnesota for 1941.
The Authority further agrees to comply with all the terms �,

and conditions of Chapter 74 of the Saint Paul Legislative Code
pertaining to non-discrimination, and specifically, Section 74. 03A
thereof pertaining to affirmative action, the pronisions of Chapter
74 are hereby incorporated herein by reference.
6. Regular Reporting: The Authority shall submit to the
City on a quarterly basis a full account of the status of the
work outlined in the �•�ork program. This status report shall
record the activities of the previous quarter, as well as the
cumulative work and activities performed, and shall be submitted
using such format as the Coznmunity Development Coardinator may
nrescribe.

7. Other Requirements: The Authority shall camply ��ith all '
requirements imposed upon the City pursuant to the "Housing and li
Community Development Act of 1974" (Public Law 93-383) and Rules
i
and Regulations adopted, and as may be amended from time to time,
pursuant to said Act by the Department of Housing and Urban Develop-
ment (a copy of which Rules and Regulations, effective June 9,
1975 is hereto attached, marked Exhibit B, and incorporated h�rein
by reference) . The following Regulations shall specifically
govern the activities of the Authority as the same may be applic-
able:
(a) Section 570. 200 - "Eligible Activities. "
' (b) Section 5?0. 201 -- "Ineligible Activities. "
{c) Section 570. 506 - "Program Income. " All program income
earned by the Authority shall not be retained by the Authority, but
shal.l be remitted to the City. The City reserves the option of
adding such Program Income to Community Development Programs in
accordance with the authority contained in Section 570.50G .

(e) Sectiori 570. 510 - "Retention of Records. "
(f) Section 570. 601 - "Nondiscrimination. "
(g) Section 570. 602 - "Relocation and Acquisition. "

(i) Section 570. 605 - "Labor Standards" which makes applic-
able the Davis-Bacon Act to all laborers and mechanics employed
by contractors or subcontractors on construction work assisted
with funds received from the Housing and Community Development
Act of 1974.
(j) Section 570. 608 - "Hatch Act. "
8. Termination or Reduction of Pa�ments: The Secretary of
the U. S. Department of Housing and Urban Development is empowered
by Section 111, Title I, Public Law 93-3a3, to terminate or reduce
paymants to the City, or to li.mit availability of payments to the
City should the Secretary f ind, af ter reasonable notice and
opportunity for hearing, that the City has failed to comply sub-
stantially with any provision of Title I of the Act. The City
agrees not ta do anything which will cause the Secretary to take

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
AGENCY AGREEMENT
THIS AGREEMENT, entered into this day of ,
1976, by and between the CITY OF SAINT PAUL, a municipal corpo-
ration of the State of i�iinnesota, hereinafter designated "City" ,
and the HOUSING AND REDEVFLOPMENT AUTHORITY OF THE CITY OF SAINT
PAUL, MINNESOTA, a public body corporate and politic created
pur�uant to Minnesota Statutes, Sections 462. 411, et seq. , here-
inafter designated "Authority" .
WITNESSETH:
WHEREAS, in compliance with the Federal Housing and Community
Dev�lopment Act of 1974 (Public Law 93-383) and Rules and Regu-
lations adopted pursuant thereto, the City has duly made application
to �he U. S. Department of Housing and Urban Development for
Community Development Grant Program; and
WHEREAS, the City has been awarded a grant for Community
Development Year II for the purpose of carrying on the program
approved by the City Council and submitted to the U. S. Department
of I�ousing and Urban Development; and
WHEREAS, the Authority has prepared, approved and submitted
for ratification to the City Council, its Redevelopment Plan for
Co.�unity Development, �rhich Redevelopment Plan was ratified by
the City Council and ��h?ch Redevelopment Plan is contained in and
nade a part of the City' s Federally-approved Community Developmer_t
Grant Program; and

WHEREAS, the City and Authority desire to enter into this Ii
Agreement for the purpose of setting forth their respective

responsibilities in carrying out to a successful conclusion the '
City' s approved Community Development Grant Program in accordance
�,►ith all applicable Federal, State and Local laws.
NOW, THEREFOP,E, THE CITY AND AUTHORITY DO HEREBY MUTUALLY
AGREE AS FOLLOT�lS:
1. Term of Agreement: This Agreement and activities author-
ized hereunder shall take effect and be in force from and after the
lst day of June, 1976, and shall be in force and effect for the
term of the City' s Community Development Program Year II as.
established and as may be extended by the U. S. Department of
Housing and Urban Development.
2. Scope of Service: The Authority shall perform all those
activities set forth in the City' s Federally-approved Community
Dzvelopntent Grant Program and Authority' s City approved Redevelop-
ment Plan which specifically provide for and require development
and implementation by the Authority. The program activities to be
undertaken or coordinated by the Authority are set forth in the
attached Exhibit A, and shall be undertaken by the Authority in
accordance with the proviszons contained in the City' s Federally-
approved Community Development Program. In carrying out its
activities under this Agreer,tent, the Authority shall report
periodically to the City on the status of the programs,

3. Funding: All funds required for these programs undertaken
by the Authority shall be provided by the City with funds derived �I
from its Federally approved Community Development Program Grant.
The Authority shall be entitled to receive advance of funds upon
subnAission of a request therefor. The request for payment of
advances shall be in such form as may be required by the City to
cor.►ply with all Federal, State and Local requirements. All i
requests for funds shall conform to the items contained in the
Buclget (HUD Form 7015. 5) attached to this Agreement and the
provisions of this Agreement. The City shall make such advance
payments to the Authority within three working days from the
rec�ipt of the Authority' s request.

All requests for funds shall conform to the items contained !
in the Budget attached to this Agreement, marked Exhibit A, and any
increases or transfers of funds contained in the Budget and Program
items �at forth therein sha11 first require the approval of the
City Council expressed by its resolution; provided, ho�vever, that
the Authority Board, with the prior written approval of the Niayor,
may increase any line sub-category by a total amount not to exceed
$10, 000 without the Council' s consent. Funds may not be trans-
ferred between the operating portion of the budget and the pr�gram I
portion of the budget without the City Council' s approval. Any
change in total budget amount shall require the prior approval
of the City Council expressed by its resolution, provided that

other operating expense, the Authority shall not expend in excess ,
of the amount of $2, 041, 666 without further approval of the City ',
Council expressed by its resolution. In addition to the quarterly �
report required under pa�agraph 6, of this Agreement, the Authority
shall report to the City on a monthly basis respecting all transfers !�
of f unds authorized hereunder. I

4. Independent ContractQr. For the purpose of this Agree- �
ment, the Authority shall be deemed to be an independent contractor, I
and not an employee of the City. Any and all ernployees of the
Authority or other persons, other than City employees, while
i
engaged in the performance of any work or services required by '�
�,
the Authority under this Agreement, shall not be considered !
employees of the City; and any and all claims that may or might
arise under the Workmen' s Compensation Act of Minnesota on behalf
of said em�loyees or other persons while so engaged, � hospitalization
insurance caverages, Social Security and pension payments and
benef its, other employee obligations and benefits, shall in no
way be the obligation or responsibility of the City. The
Authority s:nall pay as they become due all just claims for wark,
tools, machinery, skill, materials, insurance premiums, equipment �
and supplies, personnel and all other contractual oblic�ations 'I

entered into pursuant to and in the performance of this Agreement. �
5. Non-Discriminatio�: The Authority shall be deemed a �
contractor for the application of all provisions hereof and

ordinances and other laws against unlawful discrimination on I�!
account of race, creed, sex, age, disability, sexual preference,
or color.
This Agreement is subject to Title VI of tl�e Civil Rights
Act of 1964 (Public La�v 88-352) and the rules and reguiations
issued pursuant thereto, anc� the Authority shall comply with
Executive Order No. 11246, entitled "Equal Employment Opportunity",
as supplemented in Departmen-t of Labor Regulations (4 CFR, Part 60) .
The Authority agrees to comply with all the terms and conditions
set iarth in Chagter 238, Laws of Minnesota for 1941.
The Authority further agrees to com�ly with all the terms
and conditions of Chapter 74 of the Saint Paul Legislative Code
pertaining to non-discrimination, and specifically� Section 74.03A
thereof pertaining to affirmative action, the provisions of Chapter
74 are hereby incorporated herein by reference.
6. Regular Reporting: The Authority shall submit to the
Cit� on a quarterly basis a full account of the status of the
��ork outlined in the work program. This status report shall
record the activities of the previous quarter, as well as the
cumulative work and activities performed, and shall be submitted
using such format as the Community Development Coordinator may
prescribe.

7. Other Requirements: The Authority shall comply with all ��
req�irements imposed upon the City pursuant to the "Housing and
Comrnunity Development Act of 1974" (Public Law 93-383) and Ru�es
and Regulations adopted, and as may be amended from time to time,
pursuant to said Act by the Department of Hausing and Urban Develop-
inent (a copy of which Rules and Regulations, effective June 9,
1975 is hereto attached, marked Exhibit B, and incorporated herein
by reference) . The following Regulations shall specifically
govern the activities of the Authority as the same may be applic-
able:
(a) Section 570. 200 - "Eligible Activities. "
' (b) Section 570. 201 - "Ineligible Activities. "
(c) Section 570. 506 - "Program Income. " All program income
earned by the Authority shall not be retained by the Authority, but
shall be remitted to the City. The City reserves the option of
adding such Program Income to Community Development Programs i:n
accordance with the authority contained in Section �70. 50u .
(d) Section 570-509 - "Audit. "
(e) Sectiori 570. 510 - "Retention of Records. "
(f) Section 570. 601 - "Dlondiscrimination. "

able the Davis-Bacon Act to all laborers and mechanics employed

8. Termination or Reduction of Pa ents: The Secretary of
the U. S. Department of Housing and Urban Development is empowered
by Section 111, Title I, Public Law 93-383, to terminate or reduce
payments to the City, or to limit availability of payments to the
City should the Secretary find, after reasonable notice and
opportunity for hearing, that the City has failed to comply sub-
stantially with any provision of Title I of the Act. The City
agrees not to do anything which will cause the Secretary to take
such action, and the Authority shall be notified of any proposed
actian by the Secretary, and the Authority shall be given
opportunity to be represented at all such hearings. The City' s
obligations to provide funds to the Authority is deemed dependent
upon the City' s receiving funding from the Secretary, and all

De�aelo�ment Year I for the purgose of carrying cn the p�ogram
approved by the City Council and su3�mitted to the U. S. Depar�:nt
of Eousing and Urban Developrr�nt; and
WrEREAS, The Authority has prepared, appravea and submitted
�or rztification to t�ie City Council, its Redevelopm�nt �lan for
Cor.,;-�anity Development, which Redevelop�ent PI� was duly rat�i�d
by w:e Cit, Council and which Redevelopren� Pla.xi is cer.tair_ez in
a��d r.:ade a part o� th� City' s Fe�erally-apprav�c Cam.�aunity Develap-

1_ Term of Aqreeaaent: This �gr�►�^t and activitie� auta-
orized r�eseunder ��a11 take effect and b� in forc� fram and after
the lst day c�f July, 197�, and sha3.l be in fa� aad effect for
the term of the Citp's Couununity Development G.re�ai. Program Y�as I
as esta�lish+�d and as may be extended by the II. 5. DepaT-**-*!a�t of
Housing and IIrban D�velopment.
1 2. Sco�e of Service: The Authority shall gerform a31 thc>se
activities �et fort�i in the City's Federally-ap�roved Co�auaity
Developr.�nt Grant Program and Authority's City apprvved,
Reded�lopment Plan which specifically }�s�ovide fnr anrl r��tu.�
development and implementation by t�e �nth�ri�y. T'he pra�ram
activ:ties to be undertaken or coordi.nated �y the Aut3iori�ty �
set forth in the attached EXh.i.hit. A' �ad shal.3_ be undertaken i�y
the Autharity in accordance with the provisions contained in the
City' s r^�deral2y-approv�d Community Developr.ient Grant Prograic.
Zn carrying aut its act.ivities under this 3greement, the Aut�'iority
snall report periadically to the City on the status of th� pra+gra�as.

3. Funding: All fuads required for those programs ur_dertaken
by the Aut�.ority shall be provided by the City witiz funds deri�d '
frara its Federally-approved Co�tunity Develo�nt Pmgrarn �rant. '
The Authority shall be entitled to r�ceiv� advance of fsznds aa a 'i
waeekly basis. 'The request for payment of ac�vances shall be in su�ch
for�a as may b� requir�d by the City to comply with all Federal, '�i
stat� aad local requirements. All requ�sts for funds shall confo=m '
to the iteuz.s contain�d in the Budget attached to this Agreement,
ra$=ked Exhi.�it 1�, and any increases or transfers of funds contsined

ia the Budget and Program iterns set forth therein shall first
r�quire tiie approval of the City Coun�il e�r�ss�d by its resolution,
ar.d shall also require written aza.endment to this Agr�ea�nt. Ti1e.
City sh�ll make such advance payments to the Authority wit�in #�ree
working days from receipt af the Authority' s request.
4. Independent Contractor: For the purpose of this Agree�rent,
_ tt�e Authority shall be d��d to be an independsnt contractbr, and
nc�t an employee of the City. Any and all employees of the Authority
or other person�, other than City employees, w�ile engaged in th�
pe�foraance of aAy wark or s�ervi�s requirad 3�y Authority umder
this Agreement, shall not be considered employ��s of th� City; a.nd
any and all claims that may or r.i.i.ght arise Lnder th� �7ork�en' s
Conpensation Act of �•iinnesata on behalf of said empl�y��s nr r�ther

tions set forth i,n Chapter 2.38, Laws of Minnesota for 1941.

req�irements imposed upan the City pursuant to th� "Housiag and
Cor�zunity �eveiopaeent Act of 1974" (P.L. 93-383) aisd Rul.es nnd
I2�gulations adopted, and as mny b+e amend+ed frotn time tfl time,
p�rsuant to said Act by the Department of Housiag and IIrban
Developraent (copy of which �tules and Regulations, effective
Juae 9, 1975 is attached hereto, marked Exhibit B, and i.ncorporated

THIS AGREEMENT, entered into this � day of � ,
1976, by and between the CITY OF SAINT PAUL, a municipal corpo-
ration of the State of Minnesota, hereinafter designated "City" ,
and the HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF SAINT
PAUL, MINNESOTA, a public body corporate and politic created
pursuant to Minnesota Statutes, Sections 462. 411, et seq. , here-
inafter designated "Authority" .
tiVITNESSETH:
ti�]HER�AS, in compliance with the Federal Housing and Community
Development Act of 1974 (Public Law 93-383) and Rules and Regu-
lations adopted pursuant thereto, the City has duly made application
to the U. S. Department of Housing and Urban Development for
Community Development Grant Program; and
, t^7HEREAS, the City has been awarded a grant for Community
Development Year II for the purpose of carrying on the program
approved by the City Council and submitted to the U. S. Department
oi Housing and Urban Development; and
WHEREAS, the Authority has prepared, approved and submitted
for ratification to the City Council, its Redevelopment Plan for
Co_-amunity Development, ��hich Redevelopment Plan was ratified by
� the City Council an3 cohich Redevelopment Plan is contained in and
r.►ade a part of the City` s Federally-approved Community Developmer_t
Grant Program; and

WHEREAS, the City and Authority desire to enter into this
Agreement for the purpose of setting forth their respective
responsibilities in carrying out to a successful conclusion the
City' s approved Community Development Grant Program in accordance
with all applicable Federal, State and Local laws. .
NOW, THEREFOP.E, THE CITY AND AUTHORITY DO HEREBY MUTUALLY
AGREE AS FOLLOT�]S:
1. Term of Agreement: This Agreement and activities author-
ized hereunder shall take effect and be in force from and after the
lst day of June, 197G, and shall be in force and effect for the
term of the C.ity' s Community Development Program Year II as.
established and as may be extended by the U. S. Department of
Housing and Urban Development.
2. Scope of Service: The Authority shall perform all those
activities set forth in the City' s Federally-approved Community
Development Grant Program and Authority' s City approved Redevelop-
ment Plan which specifically provide for and require development
and implementation by the Authority. The program activities to be
undertaken or coordinated by the Authority are set forth in the
attached Exhibit A, and shall be undertaken by the Authority in
accordance with the provisions contained in ±he City' s Federally-
approved Community Development Program. In carrying out its
activities under this Agreer.ient, the Authority shall report
periodically to the City on the status of the programs.

3. Fundin : Al1 funds required for these programs undertaken
by tMe Authority shall be provided by the City with funds derived
from its Federally approved Community Development Program Grant.
The Authority shall be entitled to receive advance of funds upon
submission of a request therefor. The request for payment of �
advances shall be in such form as may be required by the City to
comply with all Federal, State and Local requirements. Al1
requests for funds shall conform to the items contained in the
Budget (HUD Form 7015. 5) attached to this Agreement and the
provisions of this Agreement. The City shall make such advance
payments to the Authority within three working days from the
receipt of the Authority' s request.
Al1 requests for funds shall conform to the items contained
in the Budget attached to this Agreement, marked Exhibit A, and any
increases or transfers of funds contained in the Budget and Program
items set forth therein shall first require the approval of the �
City Council expressed by its resolution; provided, hocaever, that
the Authority Board, with the prior �rritten approval of the l�iayor,
may increase any line sub-category by a total amount not to exceed
$10, 000 without the Council' s consent. Funds may not be trans-
ferred between the operating portion of the budget and the program
portion of the budget without the City Council' s aPproval. Any
change in total budget amount shall require the prior approval
of the City Council expressed by its resolution, provided that

other operating expense, the Authority shall not exnend in excess 'I
of the amount of $2, 041, 666 without further approval of the City I�
Council expressed by its resolution. In addition to the quarterly � I

report required under pa�agraph 6, of this Agreement, the Authority_ ��
shall report to the City on a monthly basis respectinq all transfers
of funds authorized hereunder_ . .
4. Independent Contractor. For the purpose of this Agree-
ment, the Authority shall be deemed to be an independent contractor,
and not an employee of the City. Any and all ernployees of the
Authority or other persons, other than City employees, while
engaged in the performance of any work or services required by
the Authority under this Agreement, shall not be considered
employees of the City; and any and all claims that may or might
arise under the Workmen' s Compensation Act of Minnesota on behalf
of said employees or other persons while so engaged, hospitalization
insurance coverages, Social Security and pension payments and
bene�its, other employee obligations and benefits, shall in no
way be the obligation or responsibility of the City. The
Authority shall pay as they become due all just claims for work,
tools, machinery, skill, materials, insurance premiums, equipmer.t
and supplies, personnel and all other contractual obligations
entered into pursuant to and in the performance of this Agreement.
5. Non-Discriminatio�: The Authority shall be deemed a
contractor for the application of all provisions hereof and

ordinances and other laws against unlawful discrimination on I�
account of race, creed, sex, age, disability, sexual preference, I

or color. �
This Agreement is subject to Title VI of the Civil Rights�
Act of 1964 (Public Law 88-352) and the rules and regulations
issued pursuant thereto, an� the Authority shall comply with
Executive Order No. 11246, entitl�d "Equal Employment Opportunity",
as supplemented in Department of Labor Regulations (4 CFR, Part 60) .
The Authority agrees to comply with all the terms and conditions
set iarth in Chapter 238, Laws of Minnesota for 1941.
The Authority further agrees to comply with all the terms
and conditions o� Chapter 74 of the Saint Paul Legislative Code
pertaining to non-discrimination, and specifically, Section 74. 03A
thereof pertaining to affirmative action, the provisions of Chapter
74 are hereby incorporated herein by reference.
6. Regular Reporting: The Authority shall submit to the
City on a quarterly basis a full account of the .status of the
work outlined in the work program. This status report shall
record the activi.ties of the previous quarter, as well as the
cumulative work and activities performed, and shall be submitted
using such format as the Comriunity Development Coordinator may
� prescribe. �

7. Other Requirements: The Authority shall comply with ail �
requirements imposed upon the City pursuant to the "Housing and I

Community Development Act of 1974" (Public Law 93-383) and Rules
and Regulations adopted, and as may be amended from time to time,
pursuant to said Act by the Department of Housing and Urban Develop- I

rnent (a copy of which Rules and Regulations, e�fective June 9, �
1975 is hereto attached, marked Exhibit B, and incorporated herein
by reference) . The following Regulations shall speci�ically .

able:
(a) Section 570. 2Q0 - "Eligible Activities."
(b) Section 570. 201 - "Ineligible Activities. "
(c) Section 570. 506 - "Program Income. " All program income
� earned by the Authority shall not be retained by the Authority, but
shall be remitted to the City. The City reserves the , option of
adding such Program Income to Community Development Programs in
accordance with the authority contained in Section 570. 50G .

8. Termination or Reduction of Payments�: The Secretary of �
the U. S. Department of Housing and Urban Development is empowered �
by Section 111, Title I, Public Law 93-3f33, to terminate or reduce
payments to the City, or to limit availability of payments to the
City should the Secretary find, af ter reasonable notice and
opportunity for hearing, that the City has failed to comply sub-
stantially with any provision of Title I of the Act. The City
agrees not �o do anything which will cause the Secretary to take
such actiori, and the Authority shall be notif ied of any proposed �
action by the Secretary, and the Authority shall be given
opportunity to be represented at all such hearings. The City' s
obligations to provide funds to the Authority is deemed dependent �
upon the City's receiving funding fror► the Secretary, and all
obligations of the City hereunder shall either terminate or be
reduc�d or limited in the event the Secretary should ta}:e such
action as authorized by said Section 111.
