the northwest-southeast alley lying westerly of a line from the northeast corner of
Lot 100, Union Park to the southeast corner of Lot 181 Hinkel's 3` Amendment,
and lying southeasterly of a line from the northwest corner of Lot 87, Union Park to
the southwest corner of Lot 193, Hinkel's 3` Amendment; and
the north-south dead-end alley, including cul-de-sac, extending southerly of a line
from the northeast corner of Lot 8'7 to the northwest corner of Lot 100, all in the
said Union Park.
19 This vacation shall be subject to the terms and condition of Chapter 130, codified March l, 1981, of the
20 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay a11 costs and expenses for any reconstruction of the
Dewey/LTniversity and Dewey/Feronia intersections that may be necessary to properly eliminate
the appearance of a public thoroughfare, including but not limited to costs for new curbs,
sidewalks, boulevuds, storm drains and street sign removal, all to the satisfaction of the
Department of Public Warks.
That the petitioner shall notify the Department of Public works regazding removal of street
lighting within the vacated area. All costs for the removal shall be the responsibility of the
petitioner.

1 4. That a permanent utility easement shali be retained on, over, under and across the vacated azea on
Z behalf of the City of Saint Paui, Department of Public Works to reserve the right of the City to
3 maintain and operate any sewer in or upon said easement and to enter upon said easement or any
4 portion thereof at any time and from time to time, for the purposes of future construction,
5 reconstrucuon, inspecting, maintaining or repairing the same or any part thereof. Use of the
6 property within said utility easement shall be subject to the following conditions:
8 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
9 other objects that will prohibit normal access to utility facIlities for maintenance purposes
10 will be pernutted within the easement area.

12 b. Improvements in or upon the above described easement that do not prohibit the City from
13 exercising its reserved rights may be allowed by obtaining written pernussion from the
14 Department of Public Works Sewer Division with the understanding that the restoration
15 and costs of such improvements shall be the sole responsibility of the petitioner, its
16 successors and assigns in the event the City exercises its reserved easement rights.

in any service pipe or connection in said reserved easement azising out of or resulting
from any action or negligence of the petitioner, its empioyees, agents, or business
invitees.

behalf of the Boazd of Water Commissioners of the City of Saint Paul, to reserve the right of the
Board of Water Commissioners to maintain and operate any water facility in or upon said
easement and to enter upon said easement or any portion thereof at any time for the purposes of
future constnxction, reconstruction, inspecting, maintenance or repair of the same, or any part
thereo£ Use of the property within said utility easement shall be subject to the following
conditions:

c. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operauons, all removal,
replacement or modification costs shall be bome solely by the petitioner.
d. The petitioner, its successors and assigns shall fully indemnify, defend and save harmless
the Board of Water Commissioners, its officers, agents, employees, and servants from all
suits, action or claims which sha11 azise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petitioner, its
empioyees, agents or business invitees.

26 because of any claims or liability arising from any violation of any law or regulaUOn made in
27 accordance with the law, whether by the petitioners or any of their agents or employees.

29 10. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
30 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
31 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in

1. The petitioner shall pay all costs and expenses for any reconsuuction of the Dewey/University and
Dewey/Feronia intersections which may be necessary to properly eliminate the appearance of a public
thoroughfaze, including but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and
street sign removal, all to the saUsfaction of the Department of Public Works.
2. That a full width permanent sewer easement, in favor of the City of Saint Paul, Department of Public
Works, shall be retained on, over, under and across all of Dewey Street between University Ave. and
Feronia St. and all of the alley abutting I,ot 100, Union Park and abutting L.ots 181 through 186,
Hinkel's 3` Amendment. See attached drawing. All of the usual restrictions shall apply.
3. The petitioner shall notify the Department of Public Works regarding removal of street lighting within
the vacated azea. All costs for the removal shall be the responsibility of the petitioner.

Dewey St. between University Ave. and Feronia Ave., Parcel 1; and

Saint Paul Regional Water Services (SPRWS) has completed its review of the subject vacation.
SPRWS has a six-inch water main, valves and one fire hydrant in that part of Dewey Street proposed
for vacation. To provide for continued access to our facilities, SPRWS requires an easement be
retained over the entire azea to be vacated.
We request that the following language be used in the grant of vacation resolution:
That a permanent utility easement shall be retained on, over, under, and across the vacated area on
behalf of the Board of Water Commissioners of the City of Saint Paul, to reserve the right of the
Boazd of Water Commissioners to maintain and operate any water facility in or upon said easement,
and to enter upon said easement at any time, for the purpose of future construcrion, reconstruction,
inspection, maintenance or repair of the same, or any part thereo£ Use of the property within said
utility easement shall be subject to the following restrictions:
1. No buildings, structures or trees aze permitted within the easement area, or any temporary
structure, material storage, fixture or other objects that may prohibit normal access to
water facilities for maintenance purposes without written permission from the Saint Paul
Regional Water Services.
2. No change from the existing grade or change in surfacing within the easement area is
permitted without written permission from the Saint Paul Regional Water Services.

3. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs shall be bome solely by the petitioner.
4. That the peritioner, its successors and assigns shall fully indemnify, defend and save
harmless the Board of Water Commissioners, its officers, agents, employees and servants
from alt suits, actions or claims which shall arise from any injuries or damages received
or sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resuiting from any acrion or negligence of the petitioner, its
employees, agents or business invitee.

19 This vacation shall be subject to the terms and condition of Chapter 130, codified March l, 1981, of the

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay a11 costs and expenses for any reconstruction of the
Dewey/LTniversity and Dewey/Feronia intersections that may be necessary to properly eliminate
the appearance of a public thoroughfare, including but not limited to costs for new curbs,
sidewalks, boulevuds, storm drains and street sign removal, all to the satisfaction of the
Department of Public Warks.
That the petitioner shall notify the Department of Public works regazding removal of street
lighting within the vacated area. All costs for the removal shall be the responsibility of the
petitioner.

1. The petitioner shall pay all costs and expenses for any reconsuuction of the Dewey/University and
Dewey/Feronia intersections which may be necessary to properly eliminate the appearance of a public
thoroughfaze, including but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and
street sign removal, all to the saUsfaction of the Department of Public Works.
2. That a full width permanent sewer easement, in favor of the City of Saint Paul, Department of Public
Works, shall be retained on, over, under and across all of Dewey Street between University Ave. and
Feronia St. and all of the alley abutting I,ot 100, Union Park and abutting L.ots 181 through 186,
Hinkel's 3` Amendment. See attached drawing. All of the usual restrictions shall apply.
3. The petitioner shall notify the Department of Public Works regarding removal of street lighting within
the vacated azea. All costs for the removal shall be the responsibility of the petitioner.

Dewey St. between University Ave. and Feronia Ave., Parcel 1; and
Adjouung aileys, Pazcels 2 and 3
Saint Paul Regional Water Services (SPRWS) has completed its review of the subject vacation.
SPRWS has a six-inch water main, valves and one fire hydrant in that part of Dewey Street proposed
for vacation. To provide for continued access to our facilities, SPRWS requires an easement be
retained over the entire azea to be vacated.
We request that the following language be used in the grant of vacation resolution:
That a permanent utility easement shall be retained on, over, under, and across the vacated area on
behalf of the Board of Water Commissioners of the City of Saint Paul, to reserve the right of the
Boazd of Water Commissioners to maintain and operate any water facility in or upon said easement,
and to enter upon said easement at any time, for the purpose of future construcrion, reconstruction,
inspection, maintenance or repair of the same, or any part thereo£ Use of the property within said
utility easement shall be subject to the following restrictions:
1. No buildings, structures or trees aze permitted within the easement area, or any temporary
structure, material storage, fixture or other objects that may prohibit normal access to
water facilities for maintenance purposes without written permission from the Saint Paul
Regional Water Services.
2. No change from the existing grade or change in surfacing within the easement area is
permitted without written permission from the Saint Paul Regional Water Services.

3. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs shall be bome solely by the petitioner.
4. That the peritioner, its successors and assigns shall fully indemnify, defend and save
harmless the Board of Water Commissioners, its officers, agents, employees and servants
from alt suits, actions or claims which shall arise from any injuries or damages received
or sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resuiting from any acrion or negligence of the petitioner, its
employees, agents or business invitee.

19 This vacation shall be subject to the terms and condition of Chapter 130, codified March l, 1981, of the

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay a11 costs and expenses for any reconstruction of the
Dewey/LTniversity and Dewey/Feronia intersections that may be necessary to properly eliminate
the appearance of a public thoroughfare, including but not limited to costs for new curbs,
sidewalks, boulevuds, storm drains and street sign removal, all to the satisfaction of the
Department of Public Warks.
That the petitioner shall notify the Department of Public works regazding removal of street
lighting within the vacated area. All costs for the removal shall be the responsibility of the
petitioner.

1 4. That a permanent utility easement shali be retained on, over, under and across the vacated azea on
Z behalf of the City of Saint Paui, Department of Public Works to reserve the right of the City to
3 maintain and operate any sewer in or upon said easement and to enter upon said easement or any
4 portion thereof at any time and from time to time, for the purposes of future construction,
5 reconstrucuon, inspecting, maintaining or repairing the same or any part thereof. Use of the
6 property within said utility easement shall be subject to the following conditions:
8 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
9 other objects that will prohibit normal access to utility facIlities for maintenance purposes
10 will be pernutted within the easement area.

1. The petitioner shall pay all costs and expenses for any reconsuuction of the Dewey/University and
Dewey/Feronia intersections which may be necessary to properly eliminate the appearance of a public
thoroughfaze, including but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and
street sign removal, all to the saUsfaction of the Department of Public Works.
2. That a full width permanent sewer easement, in favor of the City of Saint Paul, Department of Public
Works, shall be retained on, over, under and across all of Dewey Street between University Ave. and
Feronia St. and all of the alley abutting I,ot 100, Union Park and abutting L.ots 181 through 186,
Hinkel's 3` Amendment. See attached drawing. All of the usual restrictions shall apply.
3. The petitioner shall notify the Department of Public Works regarding removal of street lighting within
the vacated azea. All costs for the removal shall be the responsibility of the petitioner.

Saint Paul Regional Water Services (SPRWS) has completed its review of the subject vacation.
SPRWS has a six-inch water main, valves and one fire hydrant in that part of Dewey Street proposed
for vacation. To provide for continued access to our facilities, SPRWS requires an easement be
retained over the entire azea to be vacated.
We request that the following language be used in the grant of vacation resolution:
That a permanent utility easement shall be retained on, over, under, and across the vacated area on
behalf of the Board of Water Commissioners of the City of Saint Paul, to reserve the right of the
Boazd of Water Commissioners to maintain and operate any water facility in or upon said easement,
and to enter upon said easement at any time, for the purpose of future construcrion, reconstruction,
inspection, maintenance or repair of the same, or any part thereo£ Use of the property within said
utility easement shall be subject to the following restrictions:
1. No buildings, structures or trees aze permitted within the easement area, or any temporary
structure, material storage, fixture or other objects that may prohibit normal access to
water facilities for maintenance purposes without written permission from the Saint Paul
Regional Water Services.
2. No change from the existing grade or change in surfacing within the easement area is
permitted without written permission from the Saint Paul Regional Water Services.

3. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs shall be bome solely by the petitioner.
4. That the peritioner, its successors and assigns shall fully indemnify, defend and save
harmless the Board of Water Commissioners, its officers, agents, employees and servants
from alt suits, actions or claims which shall arise from any injuries or damages received
or sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resuiting from any acrion or negligence of the petitioner, its
employees, agents or business invitee.
