8 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
9 Saint Paul I,egislative Code as amended, and to the following conditions:

11 l. That the petiuoner's, their successors and assigns shall pay $500.00 as an administrative fee for
12 this vacation which is due and payabie within 60 days of the effective date of this resolution.

14 2. That the petitioner's, their successors and assigns shall dedicate a permanent drainage and utility
15 easement on, over, under and across the planned unit development area known as Wainut Ridge,
16 as outlined on the attached map Exhibit "B", to the City of Saint Paul, Department of Public
17 Works, for the purpose of maintaining and sustaining proper storm water run-off from abutting
18 properties and any public or private roadways or alleys in said Walnut Ridge or Block 8, Paul
19 Martin's Addition and Block 31, The West St. Paul Real Estate and Improvement Syndicate
20 Addition No. 2, that no structuzes or improvements shall restrict the enjoyment of said easement

3. That a permanent utility and drainage easement sha11 be retained across the south 15 feet of the
area to be vacated, in favor of the City of Saint Paul, Department of Public Works, for the
purpose of maintaining and sustaining proper storm water run-off from abutting properties and
the public portion of the alleys in Block 8, Paul Martin's Addition and The West St. Paul Real
Estate and Improvement Syndicate Addition No. 2, that no strnctures or improvements to said
vacated area shall restrict the enjoyment of said drainage easement rights.

1 4. That the petitioners, their successors and assigns agree to indexnnify, defend and save harniless
Z the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
3 brought as a result of injuries or damages received or sustained by any person, persons or
4 properry on account of this vacation or petitioners' use of this properry, including but not limited
5 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
6 because of any claims or liability arising from any violation of any law or regulation made in
7 accordance with the law, whethez by the petitioners or any of their agents or employees.

9 5. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
10 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
11 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in

The Department of Public Works has completed a review of the above-referenced proposal and has
no objections to this vacation subject to the following requirements:
1. That a permanent drainage and utility easement shall be retained across the south 15 feet of the area '�
to be vacated, in favor of the City of Saint Paul, Department of Public Works. See attached drawing.
All of the usual restrictions shall apply.
2. That the petitioners shall dedicate a permanent drainage and utility easement within their proposed �
private roadway to the satisfacdon of the Departrnent of Public Works.
3. We should receive approval from the City of West St. Paul since this is a border street. _

8 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the

11 l. That the petiuoner's, their successors and assigns shall pay $500.00 as an administrative fee for
12 this vacation which is due and payabie within 60 days of the effective date of this resolution.

14 2. That the petitioner's, their successors and assigns shall dedicate a permanent drainage and utility
15 easement on, over, under and across the planned unit development area known as Wainut Ridge,
16 as outlined on the attached map Exhibit "B", to the City of Saint Paul, Department of Public
17 Works, for the purpose of maintaining and sustaining proper storm water run-off from abutting
18 properties and any public or private roadways or alleys in said Walnut Ridge or Block 8, Paul
19 Martin's Addition and Block 31, The West St. Paul Real Estate and Improvement Syndicate
20 Addition No. 2, that no structuzes or improvements shall restrict the enjoyment of said easement

3. That a permanent utility and drainage easement sha11 be retained across the south 15 feet of the
area to be vacated, in favor of the City of Saint Paul, Department of Public Works, for the
purpose of maintaining and sustaining proper storm water run-off from abutting properties and
the public portion of the alleys in Block 8, Paul Martin's Addition and The West St. Paul Real
Estate and Improvement Syndicate Addition No. 2, that no strnctures or improvements to said
vacated area shall restrict the enjoyment of said drainage easement rights.

3 brought as a result of injuries or damages received or sustained by any person, persons or

5 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
6 because of any claims or liability arising from any violation of any law or regulation made in
7 accordance with the law, whethez by the petitioners or any of their agents or employees.

10 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution

The Department of Public Works has completed a review of the above-referenced proposal and has
no objections to this vacation subject to the following requirements:
1. That a permanent drainage and utility easement shall be retained across the south 15 feet of the area '�
to be vacated, in favor of the City of Saint Paul, Department of Public Works. See attached drawing.
All of the usual restrictions shall apply.
2. That the petitioners shall dedicate a permanent drainage and utility easement within their proposed �
private roadway to the satisfacdon of the Departrnent of Public Works.
3. We should receive approval from the City of West St. Paul since this is a border street. _

8 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
9 Saint Paul I,egislative Code as amended, and to the following conditions:

11 l. That the petiuoner's, their successors and assigns shall pay $500.00 as an administrative fee for
12 this vacation which is due and payabie within 60 days of the effective date of this resolution.

14 2. That the petitioner's, their successors and assigns shall dedicate a permanent drainage and utility
15 easement on, over, under and across the planned unit development area known as Wainut Ridge,
16 as outlined on the attached map Exhibit "B", to the City of Saint Paul, Department of Public
17 Works, for the purpose of maintaining and sustaining proper storm water run-off from abutting
18 properties and any public or private roadways or alleys in said Walnut Ridge or Block 8, Paul
19 Martin's Addition and Block 31, The West St. Paul Real Estate and Improvement Syndicate
20 Addition No. 2, that no structuzes or improvements shall restrict the enjoyment of said easement

3. That a permanent utility and drainage easement sha11 be retained across the south 15 feet of the
area to be vacated, in favor of the City of Saint Paul, Department of Public Works, for the
purpose of maintaining and sustaining proper storm water run-off from abutting properties and
the public portion of the alleys in Block 8, Paul Martin's Addition and The West St. Paul Real
Estate and Improvement Syndicate Addition No. 2, that no strnctures or improvements to said
vacated area shall restrict the enjoyment of said drainage easement rights.

1 4. That the petitioners, their successors and assigns agree to indexnnify, defend and save harniless
Z the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
3 brought as a result of injuries or damages received or sustained by any person, persons or
4 properry on account of this vacation or petitioners' use of this properry, including but not limited
5 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
6 because of any claims or liability arising from any violation of any law or regulation made in
7 accordance with the law, whethez by the petitioners or any of their agents or employees.

9 5. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
10 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
11 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in

The Department of Public Works has completed a review of the above-referenced proposal and has
no objections to this vacation subject to the following requirements:
1. That a permanent drainage and utility easement shall be retained across the south 15 feet of the area '�
to be vacated, in favor of the City of Saint Paul, Department of Public Works. See attached drawing.
All of the usual restrictions shall apply.
2. That the petitioners shall dedicate a permanent drainage and utility easement within their proposed �
private roadway to the satisfacdon of the Departrnent of Public Works.
3. We should receive approval from the City of West St. Paul since this is a border street. _
