Staff recomnended approval of the petition. The Current Plannjng and Zoning Committee, on a motion by Mrs. Norton and a second by Mr. Hummer, unanimously approved the rezoning request. The appellant was Fuel Oil Service Company, Inc. , 290 Atwater Street, the City of Saint Paul . The purpose of the rezoning (from 6-2 to B-3) was to allow the subject site to be developed as a used car operation. The Current Plannin,g & Zoning Committee heard this petition request on July 1 , 1976. A rec ar�nendation for approval of the rezoning carried unanimously on a motion made by Mrs. Norton and seconded by Mr. Humner. Sufficiencv: The appellant's request for rezoning was filed on a Short Form Rezoning Petition, subscribed and sworn to before a Notary Public on May 18, 1976, and received by the City Planning Office June 4, 1976. B. Pro osed Use: The appellant proposes to use the subject site for a used car ot operat on. C. Fronta e and Area: The subject site has a 116 foot frontage along West Sevent Street, and is approximately 35,500 square feet in area. D. Site Conditions: The subject site was once a gas station with a two bay service area. It is a five sided irregularly shaped property, bounded on the south by Otto Avenue and West Seventh Street, bounded on the north by Palmer Place, bounded on the west by Milton Street, and bounded on the east by the property line of the adjacent single family dwelling u�it. The site is at street grade and level in all directions. E. Area Conditions: The area is a mixture of comnercial and residential land uses, w ic inc ude Maurer's Patio Lounge, a bakery-- thrift store, a Holiday gas station and a fuel storage area. Single family dwelling units reflect the residential character of the area. The homes are of the pre-war con- struction period on medium size lots, maintained in good to excellent condition. There are a number of vacant lots in the immediate area. F. �Fi�ndin s�: The appellant is requesting that the subject site be rezoned from B-2 to B-3. This would allow the subject site to be legally zoned for new and used car sales purposes, which is not allowed under a 6-2 zoning status. Rezoning from B-2 to B-3 is a one step move within the graded intensity land use concept. Staff Recommendations: Staff recamiends that the appellant's request to rezone fran B-2 to B-3 be granted in accordance with the approved site plan (File Number 7826) which calls for the following: 1 . Removal of unused pump islands. 2. Remove or fill unused motor fuel tanks per Minnesota State Fire Code specifications. 3. Maximum of 30 cars, with wheel stops along all side street parking stalls. 4. Maintain landscaped area between the sub3ect site and the ad�acent single family dwelling units to the east. 5. Existing driveway to remain on the east end of West Seventh Street. 6. Existing driveway to remain on the east end of Milton Street. 7. No parking of cars in the clear areas or driveway. 8.
