That Section 62. 02a of the Saint Paul Legislative Code is here- by amended by adding a the end of the first pa.ragraph therein the following: For the purpos of this section, a preexisting use will be presume lawful or legally nonconforming if it can be demons ated by clear and convincing evi- dence that prior t the effective date of this Ordina.nce, the use as established, converted or enlarged pursuant to building permits issued by the City of Saint Paul; o if it can be demonstrated by clear and convincing e idence that the particular use had been in existen e continuously for twenty years prior to the effec 've date of this Ordinance; and if it can be demonstr ed by clear and convinc- ing evidence tha.t the reco version of the property to an otherwise conforming e would work an undue hardship on the property owne . In some cases the buildings were subsequently placed on the tax rolls as multi-family and are being so ta�ced today. The 1922 Zoning Code with the exception as noted prohibited the erection of more than a two-unit building in an "A" or "B" residential district and the 1975 code prohibits more than one unit within an R-1, R-2, R-3 or R-4 district. The Building Code requires all dwellings with more than two units to be certified for occupancy. The certificate �� inspection is for exit arrangement, struetural integrity, Tiousing Code violations and Zoning Code conformity. The subject buildings cannot be certified because of the zoning problem which may complicate ordering necessary rEpairs or alterations as the standards for apartments in some instances do not apply to one or two dwelling buildings. Ordering alterations on the multi-family standard on an illegally occupied building would seem to condone the usage of the structure. Some lending agencies are demanding certificates of compliance before a mortgage is granted. The same problems arise in these instances. The duty of the Zoning Administrator in these cases would be to order the non- Council approved buildings which were altered after 1922 to revert tq the usage legal. at the time of conversion or at the present time. This despite the fact that building permits were issued and the property has been taxed as three and four units for years. The real problem is that most of these buildings are not in the possession of the owuers at the time of alteration and many have been sold several times. The present owners long removed from the parties responsible for the conversions are confronted with the devasting problem: Owning or purchasing and letting a long�assum��-to-be-legal multi-family residence building. The mortgage payments are often based on the projected income from rents and reconversion to fewer units would make it impossible for the owner-purchaser to continue in a tenable financial position even disregarding costs of alterations. In some cases, the results could be more vacant and abandoned buildings which the City does not need. In general, because of the lapse of time these buildings have come to be accepted uses within neighborhoods; T.he proposed ordin�nce requires: 1. The arguments for aceeptance of this ordinance are that orders to reconvert to fewer units pose in many cases undue and severe hardship upon unsu�pecting and unprepared owners and, at one time the City Officials encouraged and condoned conversions. This report contains a proposed Ordinance correcting drafting errors on Sheets 9, 19, 27, 33, and 34 of the zoning map, and adds map 45, a Height District Map. 2. A proposed Ordinance adds the classification of "Mission" type uses to the B-5 and I-1 zoning districts and defines "Mission". 3. A proposed Ordinance deals with the problems of definition of long standing non-conforming and/or illegal use of property creating a "grandfather provision". 4. A proposed Ordinance removes redundent portions of the Zoning Code text, corrects errors in the published document, and corrects unworkable regulations regarding side yard projections; this should reduce the work load of the Board of Zoning Appeals by 25 or 30 percent. 5. A proposed Ordinance makes residential uses in the B-1 , B-2, and B-3 zones special condition uses, and provides the appropriate regulating language. INTRODUCTION The development of the new Zoning Code for the City involved change in the classification 'of over 50,000 parcels of land. The process was further complicated by expansion of the number of classifications from 7 to 21 zone types. Because the changes were complex, some errors were made in zone designation and in applied standards. During the past year, the combined staffs of the Building Department, the Office of the City Attorney, and the Planning Department have reviewed and evaluated the problems arising from these errors.
