described as follows:
A permanent easement for street and highway purposes on, ,

Como Prospect Addition bounded by the follawing described
lines: Beginning at the southwest corner of Lot 5;
thence easterly along the aouth line of Lot 5 a d.istance
of 23.46 feet to a point; thence northwesterly to a point
on a line 3 feet north of and parallel to the south line
of Lot �+, distant 22 feet easterly of �he west line of said
Lot �+; thence northwesterly to a point on the north line of
said Lot �+ distant 19.42 feet easterly of the northwest
corner of said Lot 4; thence west along the north line of
Lot �+ to the northwest corner of Lot �+; thence south along
the west lines o£ Lots 4 and 5 to the point of beginning
and there terminating�
for the sum of Thirty Na,ne Thousand ($39,000) Dollars, and the seller
will retain possession of the property until May l, 197? to allo�w
construction of a new building on the reax portions of said Lots �+
and 5, at which time the owners will wreck the existing building at
their own cost and expense; and
WHEliPAS, the Purchase Agreement setting forth the terms and conditions
between the City and the sellers of the cited real estate, H. Clif'ton
and Frances Y. Howard, has been prepared and is hereby recommended

RESOLVED, that the Council of the City of Saint Paul does hereby
concur in the recoarnnendation af the City Valuation E�igineer, and
the proper City Officers are hereby authorized and directed to
execute the Furchase Agreement, acquire the real property, and
make payment to the owners thereof in accordance with the
Purchase Agreement on behalf of the City, a copy of which
Purchase ,Agree,�nent is attaehed hereto and incorporated herein
by reference; and be it
FURTHER RE50LVED, that the sum of $39,000 to be paid by the City
for the hereinbefore described land be paid from PIR Fund
60000-711-000 (L-7835) to be reiznbursed from 1975 M.S.A. F'unds
and in the follawing manner: Thirty Eight Thousand ($38,000)
Dollars upon delivery of Warranty Deed conveying proper title in
the hereinbefore described land and remaining sum of One Thcytisarid
($1,000) Dollars upon completion of the terms cited in the purchase
a�reement.

PURCHASE AGREEMENT
THIS AGREEMENT, Made and entered into this �j �� day of
September, 1976, by and between the CTTY OF SATNT PAUL, a
municipal corporation established under the laws of the State
of Minnesota, here3nafter referred to as "City", and H. CLIFTON
HOWARD and FRANC�S Y. HOWARD, husband and wife, hereinafter
referred to as "Owners" ;
WHEREAS. Owners are the owners in fee sivaple of Lots 4
and 5, Block T4, Como Prospect Addition, in the Cit�r of Saint
Paul, Ramsey County, State of Minnesc�ta, upan which the Bwners
operate a hardware retail business; and
WHEREAS, The City is planning to widen Dale Street located
adjacent to the OwnersF property and in the widening of Dale
Street the City will require a portion of the Owners' property;
and
WHEREAS, The Owners desase to construct a new building on
the remaining portion of thezr property for the purpose af
continuation of the hardware retaii store and the Owners are
willing to ca�perate with the City in the acquisition of the
necessary ri,ght-of--way for the wideni,ng of Dale Street� and
WHEREAS, both the City and Owners desire to minimize the
damages to be caused from the street widening so as to permit
the OGmers to continue to operate their hardware retail store

a�xe:ements set £orth below, the Cit�r and Owners da hereby
mutua�llX ag�ee as follaws:
1. The City agrees to purchase and the Owners agree to
sell the �ollow�ing described property to the City for the
purpose o� widen3,ng Dale Street. The City agrees to pay anc�
the Owners agree to accept as full and complete gayment and
compensata.on for the property acquired by th.e City and far all
damages that may occur to the remainder of the property to be
retained in ownership' including the demoZition of the exist-
ing building and fi�tures and severance damages, the sum of
Thirty--ra.ne Thousand (�39, 000. 00) Dollars. The desc�iption of
the property to be conveyed to the City is as follows:

in paragraph 1 above free of all liens and encumbrances (subject
to street and utility easements that may exist of record; and

Owners shall have demolished the existing building an the
premises to the satisfaction of the City�s Director of Public
Works. Upon demolition of the existing building the Owners
shall notify the City' s Director of Public Warks by letter and
the City shall transmit the balance of the purchase price,

3. The Owners agree to pay all rea1. estate taxes and
sgecial a�sessments that may be due now or in the future as to
Lots 4 and 5, Block 14, Como Prospect Addition.
4. The Owners shall remain in possessian of the land and
building and shall demolish the existing building at their own
cost and expense no later than May 1, 1977. The Owners shall
be ent3tled to retain possession of the land and building until
the existing building has been demolished without the necessity
of paying rent to the City. The Owners shaZl immediately begin
construction of their new hardware retail business so that the
new building shall be completed and ready for occupancy on or
before April 1, 1977. The Owners shall on or be�o=e April 1,
1977, submit to the City' s Director of Public Works a copy of

contract for the demolition of the existing hardware building.
Owners shall demolish the existing building accarding to the
specif ications of the City which are attached hereto and made
a part of this agreement.
5. �t zs agreed by and between City and Owners that in
the event the existing building is not wrecked by the Ot�mers
prior to May 1, 1977, that the City shall retain the balance
of the purchase pr,ice in the amount of $ � t9Q�== ��t.

as liquidated damages and, further, that the City mag enter
upon the Owners� pxoperty for the purpose of wrecl�ing and
demolishing the exzsta.ng building. The City may proceed to
demolish the existing building after May I, 1977 withaut
giving �r�.or notice to the Owners, it being understood that
time is of the essence for the demolition of the existing
building to permit the construction in widening of Dale Street
contemplated by the City.
6. The Owners shall pay al1 utilitg expenses in a timely
manner and prior to the wrecking and demolishing of the existing
building shall notify all utility companies so that the utility
services may be properly discontinued and disconneeted.
7. The Owners shall during their term of occupancy of
the building, maintain insurance protection covering the
premises and protecting the same against all iosses, daznages or
claims whatsoever and shall provide the City with Certificate
of Insurance at the time of conveyance of title. In addition

SCOPE OF ti�TORK
The work required under this section of the specification
includes furnishing all lal�or, materials, equipment and
services necessary �or or reasonably incidental to the
wrecking of the structures, Lhe re�noval of steps or stoops
adja�ent to the structures, etc. as specified and the removal
of debris at the locations as listed in the applicable addendum.

building or structure in the City until satisfactory evidence is
furnished by a certificate from the Health Officer that a
licensed pest contrai company has extermirzated all nuisar�ee
pests from the structure and premi.ses.
WRECKING OPERATIOY�I.S
Structures shall be wrrecked at the sites.
Care must be taken during demolition work not to undermine
adjacent private property or the street or alley right-of-way.
Exterior foundation walls supporting or in contact with or in
public sidewalks or alleys which are ta remain in use, shall
be removed down to the respective grade. All basement fioar
sZabs shall be broken up so that water cannot collect. T'he
slabs shall be broken into pieces which cover no more than one
square yard. The f�oor slabs shalZ �e inspeeted prior ta th�
placing of any fill.
lhe Contractor as soon as he receives the notice to proceed with
the wark sha11. enter the premises and do any and ail things
necessary to protect the premi.ses f=om damage by persans who are
unauthorized to carry on wrecking operations. The structure
shall be wrecked in a proper and approved manner.
The Contractor shall exercise extreme caution in the wreckinq
operations to protect adjacent property.
No material shall be dropped or thro��rn from any great height_
All materials which are not rem�ved by derricks or other si.ini2ar
ectuipment shall be lowered by means of approved chutes and
shall be sprinkled and dampened with water to allay any dust.
Explosives shall not be used in the wrecking operations.

of not Iess than three (3) feet belo=� the level af the a�.iuttirtg

partitions and partition walls to the level of the basement
floors.
The Contractor shall remove all piping, conduit, heating
faci7.ities, tanks, furniture, rubbish, combustible materi.als,
etc. from the basement excavation.
The Contraetor shall remove steps or stoops adjacent to the
structux�e or other projecting obstructions in the yard. and
shall remove a],1 trash and debris.
Sufficient safety precautions shall be taken by the Contractor
and by the workmen at all times du=ing the wrecking operaticrn�
to safeguard life, limb and property.
PUBLIC UT ILIT IES
The Contractor shall take care of a11 gublic utilities
encountered du=ing the progress of the work. He shall send
praper natices, �nake the necessary arrarzgeme�ts and gravide aIl
services reauired to take care of gas mains, water pipes, sewer
pipes, electrical. wires, telephone and telegraph conduit and
cables, fire plugs, lamp posts, sign posts and any other item
of this character, assuming all responsibility and paying all
costs for which the City of St. Paul may be liable. All sewers
sha11 be pluqqed, caulked and sealed with concrete at the
property, line. The pluqqinc� of sewers shall be done in
�
accordance w.ith the requirements of the St. Paul. Se�sver Denartrnent.
The Contractor shall consult all public and service coinpany
records to inform himsel� of the locations of all. utili.ties.
Locations of water, gas, sewer and ather pipes shall be clearl.y '
marked so that they can be iocated at any fu�ur� time.
SHORING AND BFACING
The Contractor shall supply all necessary shoring and braeing
required for the support of walls of the buildings during the
wrecking operations.
PRO'�ECTION OF PUBLIC AND PRNATE PROPERTY'
In the work operations involved in wrecking of the buildings
the Contractor shall use every preeaution to protect the pubZic
from personal harm and protect all private and public property
from damage. The Contractor shall erect suitable barriers to
prevent people from getting inta the danger zone and to prevent
thera from falling into holes or depressions.

The work required under this section of the speci.fication shall
include all labor, materials, eauipnent and services necessary
for or reasona}aly incidental to the filling of the basement
excavation and all holes and depressians occasioned by the
wrecking or presentl.y existir.3 on the sites of the work.
FILLING
The Contractor shall not �lace any fill of any nature whatsoever
in the basement excavation unt:.l the excavation has been ins�ected
by the City Architect or hzs representative and his py ssion is
gzven to proceecl wztn tre fillinq. _.
The Contractar shall fill the basement excavation and all hole�
and depressions to the level of the a2autting ground I.ine with
cl.ean dirt. Where the ground line slopes, the Contractor shall
match the slope with the �op af the fill.
Fill shall be granular materzal. Clay material or any materia�
of which mo=e than`'20% passes the ;2�0 sieve will not be allowed
as fill material. F.ill shall be compacted to 90� of Standard
Proctor te�t.
Fill shall be placed and compacted with twa (2) foot maximum
lifts.
SAFETY
The Contractar shall use every precaution to protect the public
from personal harm. The Contractor sha11 erect suitahle
barriers to prevent people frors falling into h�les or depressi.ons_
CLEAi�I UP
Upon the completion of the work reauired under this speci�ication,
the Contractor shall remove all tools, equipment, scaffolding,
debris and other materials from the premises. The entire preznises
shail be Iett in a clea?z cor_dition to the sati�faction of the
City Rrchitect.
