WHEREAS, La.ura Ha.y has, under the provisions of Section 64.204
of the Saint Paul Legislative Code, appealed from the decision of
the Zoning Administrator and the Board of Zoning Appeals, denying
a grant of variance from the strict application of the "side yard"
and "projection into side yard" requirements of the zoning code; and
WHEREAS, the Saint Paul City Council conducted a public hearing
on September 9, 1976, in accordance with the requirements of Section
64.204; and
WHEREAS, the Saint Paul City Council found that the variance
was not primarily based on a desire to increase the value or income
potential of the property and that the variance will not impair or
unreasonably diminish adjacent property values or the public health,
safety and welfare; now, therefore, be it
RESOLVED, that the Saint Paul City Council hereby grants the
requested variance from the strict application ofi�.e zoning code.

Dear Madam:
This is written in response to the appeal of Laura Hay, who proposes to
divide one 81 foot lot into two 40-1/2 foot lots, for the purpose of
new single family construction.
This matter was heard by the Board of Zoning Appeals on July 6, 1976.
Staff recommended approval of the zoning variance. The matter was
tabled for lack of specific site plans.
The matter was continued on July 20, 1976 before the Board of Zoning
Appeals at which time the appellant submitted the requested site plans.
A motion to recommend denial of the appellant's request carried. Mr.
Fishman made a motion for denial of the request. It was seconded by
Ms. Morton and passed on a vote of 3 to 2.
The matter has been appealed on behalf of the appellant, and is scheduled
to be heard before the St. Paul City Council on September 9, 1976.

A. Proposal : The appellant proposes to divide one 81 foot lot into 2 40.5 foot
single family lots, for the purpose of new construction.
B. Frontage and Area: The proposed site has a 81 foot frontage along Old Hudson
Road and is approximately 750 feet in depth. The total area is 12,150 square
feet.
C. Variance: Section 61 .100 of the Schedu7e of Regulations requires a minimum lot
width of 50 feet in an R-3 sing7e family zoning district. Section 63.106,
projection into yards, states that architectural features, not including
vertical projections, may extend or project into a required side yard not more
than 2 inches for each one foot of width of such side yard; and may extend
or project into a required front yard or rear yard not more than 3 feet.
The appellant is requesting a 10 foot variance from the minimum lot width
on each ]ot. Since the appe7lant has not submitted site plans, there is no
accurate way to determine the amount of variance from Section 63.106
(projection into side yards) requested.
D. Sife Conditions: The subject site is currently vacant of any structure.
It is bounded by a calvasac to the South, old Hudson Road to the North, a
single family dwelling unit to the East, and a single family dwelling unit
to the West. The site is grass covered, at street grade, and level in all
directions.
E. Area Conditions: The area reflects a mixture of single family dwelling units
of both post and pre-war construction periods. The hames in the area vary
greatly in condition and maintenance. The area is bounded on the southern limit
by' I-94 which �uns east and west.
F. Findings: If the 81 foot lot were divided, it would produce two 40.5 foot lots.
Forty foot single family lots are allowed in an R-4 zoning district which is but
one step from the R-3 zoning district. The two 40.5 foot lots would exceed
the area in square feet required in the R-4 zoning district because of their
150 foot depth. The exact projection into side yard shcwld be determined.

G. Remarks: This matter was originally heard before the Board of Zoning
Appeals on July 6, 1976.
Mr. Horak moved to table the matter until specific drawings are
before the Board. The motion was seconded by Ms. Brooks, and '
passed unanimously.
The appellant has since submitted specific drawings (see attached).
The appellant is further requesting a variance of 1 ft. 4 inches
from Section 63.106 (projection into side yards).

MINUTES OF THE PUBLIC HEARING BEFORE THE B0:4RD OF ZONING APPEALS
AT A MEETING HELD ON TUESDAY, JULY 6,1976
PRESENT: Mmes. Brooks, Morton and Zachary, Messrs. Horak and Rupp, of the Board
of Zoning Appeals; Mr. Jerome Segal , Assistant City Attorney; Mr. Richard Amey
of the Division of Housing & Building Code Enforcement; Mr. Shelton and Mmes.
Jacobson and Fox of the Planning Department Staff.
LAURA HAY 7940 : A request to vary lot widths on property located on the south
side of 0 d Hudson Road between Hazelwood and Kennard.
The petitioner was present. There was no opposition.
Mr. Shelton read the Staff Report and showed slides of the subject site.
The petitioner came forward saying she resides at 265 Earl Street and had bought
the property last year. The frontage, she stated, was 40 feet, and she had
bought it with the stipulation of putting in two homes. She said she has sold
1/2 of the area already, and there is no way in which to build on the remaining area.
Mr. Rupp asked whether the appellant's intention was to retain ownership and
reside there herself, and whether the other lots would be used for single family
residences.
Mr. Horak then asked whether there were plans or drawings for the proposed structure.
The petitioner stated she needs 40 feet.
Mr. Rupp then stated that there are some specific regulations even on a 40 foot lot,
and even if a variance is granted to reduce the size of the lot, you would have a
design that would fit on a 40 foot lot with no additional variances needed.
Ms. Hay then mentioned that there would be a 2" overhang.
Mr. Rupp stated that once the Board grants the variance, especially on a matter like
this without even seeing plans, thereis no way of knowing whether other variances
are required.
Mr. Horak said it was his feeling that there may be variances on each lot to put in
homes that require more square footage, etc.
Ms. Hay stated that the only other variance would be the 2" overhang as far as she '
can foresee.
Mr. Amey stated that 2" per foot is required, and the side yard reguirement is 12 feet
for R-3 zoning, 4 feet on one side, 8 feet on the other, which would allow an 8°
overhang.
Mr. Rupp then asked whether the contractor is presently working on,�plans for the
construction.

Ms. Hay stated that she could get the plans, as they have another home exactly
like this one on McLean Street on a 40 foot lot.
Mr. Rupp then stated that he was disposed to grant the request, but that there
is a valid point that this matter ought to be laid over until plans are looked at '
by the Building Department to make sure that no further variances will be requested
further down the road.
Mr. Shelton stated that the appellant was asking for something the Board has no�
seen, and that his reaction is variance of what without site drawings?
At this point, Ms. Brooks agreed with Mr. Shelton's reaction.
Mr. Rupp said that the chair was disposed to grant the variance, but further
developments might change matters, and therefore he thought the matter should be
tabled. '
Mr. Horak moved to table the matter until specific drawings are before the Board.
The motion was seconded by Ms. Brooks, and passed unanimously.
A motion was then made for adjournment by Ms. Brooks, and seconded by Mr. Horak.

APPEALS AT A MEETING HELD ON TUESDAY, JULY 20, 1976
PRESENT: Mmes. Morton, Brooks and Zachary, and Messrs. Fishman and Rupp of the
Board of Zoning Appeals; Mr. Richard Amey of the Division of Housing and
Building Code Enforcement; Ms. Harriet Lansing, City Attorney; Mr. Shelton and
Ms. Fox of the Planning Staff.
LAURA HAY 7940� A request to relax lot frontage requirements and overhang
on property ocated on the south side of Hudson Road between Hazelwood and Kennard.
The petitioner was present.
Mr. Shelton read the Staff Report and showed slides of the subject site.
Mr. Fishman asked the minimum required side yard setback if 20.45 feet were allowed.
Mr. Amey replied a total of 12 feet, the smallest being 4. He said that an overhang
allowable is 8 inches.
Mr. Rupp then thanked the petitioner for the drawings she had submitted in compliance
with the request of the previous hearing.
The petitioner, Laura Hay, of 265 Earl Street, came forward and said she had nothing
much to add to the Staff Report and said if the overhang variance is not allowed,
the garage could be put in the back.
Mr. Amey said that the lot faces on two streets.
Mr. Rupp then said the committee was talking about a frontage of 50 feet down to
40.5, and an overhang.
Ms. Morton said she did not understand the R-3 and R-4 zonings. Mr. Shelton explained
that he used these references to show a difference in two adjacent zoning districts.
Ms. Morton then asked if two variances were being considered. Mr. Shelton replied
that one variance allows the lots to be divided. The rest would allow overhang.
Ms. Brooks wanted someone to refresh her memory on economic gain in this situation
from the last meeting.
Mr. Rupp remarked that splitting the lots was for economic gain, and therefore it
would be a violation for the comnittee to grant it.
The petitioner's response was that one lot would become her homestead and the other
would be sold, and thelot was just too large to build one home on.
Mr. Rupp said that the question was do we stick to one lot as flriginally plotted or
do we look at the advantage of two additional homes for the City of Saint Paul .

Ms. Brooks said it also struck her that with two designs, each with a 10 foot
driveway, the variance would not be necessary on one when one driveway was to be
used by both.
Mr. Fishman discussed the house to the East and the house to the West of the subject
site. He said he would rather see a driveway shared with the house on the east
rather than the one on the west, which would give 10 feet to the existing neighbors.
Mr. Rupp said that in regard to splitting the lots, several plots are quite large
and would run into the question of whether someone is going to come along six
months from now and decide that they are going to be spot zoning? Mr. Rupp said
that the question really is whether we are spot zoning.
Mr. Fishman said he had heard no testimony regarding exceptional hardship and
asked how hardship is distinguished from mere inconvenience.
Mr. Rupp said that the proper one to answer that question wou]d be the appellant.
He then asked her why she did not wish to develop the ]ot at its present 80 feet.
The petitioner answered that her husband is going to retire and they cannot afford it.
Mr. Fishman then asked if the taxes were an undue hardship. The answer was yes.
Mr. Rupp asked if the property would be owner occupied, and the petitioner said yes.
Mr. Rupp remarked that he had difficulty convincing himself not to support the rezoning.
Mr. Fishman asked if there were any testimony at the first hearing re opposition and
Mr. Rupp answered no. Mr. Fishman then made a motion for denial of the rezoning request.
It was seconded by Ms. Morton and passed on a vote of 3 to 2, with Ms. Zachary and Mr.
Rupp voting against the denial .
Mr. Rupp said he felt that the petitioner has shown the committee that to go ahead with
a single family home for herself and a second single family home would be all right.
However, the motion was to deny, and he would abide by it.
Mr. Fishman added that he wanted the appellant to know he wishes he could have found
something on which to grant the variance, but the committee is given strict guidelines
and it would have been against all legal guidelines to grant the variance. However, he
thanked the petitioner for her honesty.

WHEREAS, Laura Hay, owner of residential property situated on the South side
of Old Huctson Road between Hazelwood and Kennard in the City of Saint Paul
has applied for variance from the strict application of the provisions of
Section 61 .100 (Schedule of Regulations) pertaining to the minimum lot width
of 50 feet in an R-3 single family zoning district, and Section 63.106
(projection into side yards) , and
WHEREAS, The Saint Paul Board of Zoning Appeals conducted a public hearing on
July 20, 1976, pursuant to said appeal in accordance with the provisions of
Section 64.203a of the Saint Paul Legislative Code, and
WHEREAS, The Saint Paul Board of Zoning Appeals, based upon evidence presented
at said public hearing, as substantially reflected in the minutes attached
hereto as (Exhibit A) , made the following findings of fact:
1 . In the opinion of the majority of the board members, there
was no testimony to substantiate the appellant's undue hardship.
2. In the view of one of the board members, within the strict
guidelines, there are no legal provisions for granting the
appellant's request for variance.
NOW, THEREFORE, BE IT RESOLVED, by The Saint Paul Board of Zoning Appeals that
the provisions of Section 61 .100 (Schedule of Regulations) and Section 63.106
(projection into side yards) are hereby denied in accordance with the
appellant's application for variance (Exhibit B) and her site plan (Exhibit C)
hereto attached.

Re: Appeal of Zoning File 7940
Dear Councilmembers:
1 hereby ask for an appeal to the Council of the City of 5t. Paul from the
St. Paul Board of �oning Appeals, who on July 20, 1976 did hear the matter
brought before them in reference to splitting an ti0 foot lot located on
Old Hudson Road into two 40 toot lots.
The particular area in question is presently zoned R:i - District - single family,
with a minimum lot frontage of 50 feet. The lot in question 1s 80 x 160 feet
both fronting on Hudson and Uld Hudson Road.
The splitting of the lot to be 80 x 80 is totally acceptable under the present
zoning but not logical.
In talking to the St. Paul Board of Zoning, they also find that the logic is to
make two 40 x 160 foot lots. Secondly, we are asking for a relaxation of
Sec. 63.106 - projections into side yards to allow tor a reasonable overhang
on the home.

WHEREAS, Laura Hay, owner of residential property situated on the South side
of Old Hudson Road between Hazelwood and Kennard in the City of Saint Paul
has applied for variance from the strict application of the provisions of
Section 61 .100 (Schedule of Regulations) pertaining to the minimum lot width -
of 50 feet in an R-3 single family zoning district, and Section 63.106
(projection into side yards) , and
WHEREAS, The Saint Paul Board of Zoning Appeals conducted a public hearing on
July 20, 1976, pursuant to said appeal in accordance with the provisions of
Section 64.203a of the Saint Paul Legislative Code, and
WHEREAS, The Saint Paul Board of Zoning Appeals, based upon evidence presented
at said public hearing, as substantially reflected in the minutes attached
hereto as (Exhibit A) , made the following findings of fact:
l . In the opinion of the majority of the board members , there
..-� was no testimony to substantiate the appellant's undue hardship.
2. In the view of one of the board members, within the strict
guidelines, there are no legal provisions for granting the
appellant's request for variance.
NOW, THEREFORE, BE IT RESOLVED, by The Saint Paul Board of Zoning Appeals that
the provisions of Section 61 .100 (Schedule of Regulations) and Section 63.106
(projection into side yards) are hereby denied in accordance with the
appellant's application for variance (Exhibit B) and her site plan (Exhibit C)
hereto attached.

The meeting was called to order by President Sylvester at 10:08 A.M.
Present - Councilmen Hunt, Levine, Roedler, Tedesco, President Sylvester. . .5

C.F. No. 267825. RESOLUTION RATIFYING ASSESSMENT.
In the matter of the assessment for summary abatement for the period June lst,
thru June 30, 1976.
Mr. Eugene Virdick of the Public Works Department showed photos of 570 Concordia
and said they show the property before and after clean up.
Councilman Tedesco left the meeting at this point and returned later in the
meeting.
Councilwoman Hunt said it is clear that work has been done and she moved
approval of the resolution.
Adopted. Yeas - 4 Nays - 0
C.F. No. 267826. RESOLUTION RATIFYING ASSESSMENT.
In the matter of condemning an easement for slopes, cuts, and fills in
connection with the grading and surfacing of the alley in Block 7, Rice
Street Villas, from Hoyt to Wheelock, under P.O. 267303. �
Councilman Tedesco returned to the meeting at this point.
Councilwoman Hunt said the resolution was laid over and financing has now
been approved without the necessity to increase assessments and she moved
approval of the resolution.
Adopted. Yeas - 5 Nays - 0
Aearing on the appeal of Mrs. Laura Hay to a decision of the Board of Zoning
� Appeals regarding property on Old Hudson Road between Hazelwood and Kennard.
A letter of the Planning Staff was read transmitting the action of the Board �
of Zoning Appeals.
Mr. Ken Gervais representing Mrs. flay explained the appeal and the proposal
to divide the property into two 40 and one half foot lots and he said several
neighbors are present and they have no objection to the proposal.
Council President Sylvester asked if there is anyone in opposition to the
proposal and no one appeared.
At the question of Councilman Roedler, Mr. McGuire explained why the matter
was tabled at the Zoning Board Meeting for lack of a site plan and he said
denial was based on economic gain but he thinks the proposal puts the area in
proper perspective.
Councilman Roedler said he would support a motion for approval and it is
unfortunate that the matter got before the Council the way it did.
Councilman Levine said he will also support the matter after reviewing the
site plan.
Harriet Lansing, City Attorney, said economic gain can be a factor but it cannot
be the primary reason for granting an appeal.
Councilwoman Hunt moved approval of the appeal.
Adopted. Yeas - 5 Nays - 0
Hearing was held on the petition of Raymond L. Lemmons, Conservator of
Marguerite Kneip, to rezone property on the north side of West Seventh Street
between Rogers and May and described as Lots 24 thru 30, Block 9, Birmingham's
4th Addition.
Mr. Thompson, 1616 Race Street, said this problem is related to the 35E issue
and he is only 50 feet from the proposed freeway and the neighborhood cannot
endure anymore hardships.
