The Council of the City of Saint Paul does ordain: Sect ion 1 That the following Chapter be incorporated into the Saint Paul Legis- lative Code: XXX. Sprinkler Systems in Boulevards 233..01 Permit Required. Any person, firm or corporation desiring to install an underground sprinkling system in the sodded area of the City right-of-way between the curb or gutter line and their private property shall make application for and receive a permit from the Director of Public Works before commencing installation. � If the underground sprinkling system is to be supplied with water from the Saint Paul Municipal Water System, a permit must be ob- tained, prior to the installation, from the Saint Paul Water Utility in accordance with the City of Saint Paul Legislative Code, Section 253•03• 233 ,02 The fee required is $25.00. 23 3,03 Conditions. (b) That the permittee shall at his own cost and expense and in ac- cordance with all applicable ordinances of the City of Sairrt Paul and statutes of the State of Minnesota, construct, main- tain and operate said underground sprinkling system installation. (c) That the permittee shall during the term of the permit restore and repair all property, whether public or private, damaged or which may be damaged due to the installation, maintenance, opera- tion, and/or removal of the underground sprinkltng system. (d) That the permittee shall, at no cost to the City, repair any damage to the underground sprinkling system which occurs during the normal course of City Main�enance and/or construction of public facitities. (e) That public sidewalk or roadway areas shall not be included in the area served by the sprinkling system. 2 33.04 Permit Revocation. The permit issued hereunder may be revoked by the Director of Public Works at any time after its iesuance for failure to canply with permit requirements or with directions of the Director concerning the work or if a change in public need for the area requires it. Section 2. This ordinance shall take effect and be in force thirty (30) days from and after its passage, approval a�d publication.
