A motion to recommend approval of the rezoning petition carried unanimously, with the stipulation that there be no special use permit granted for nursery operation until the administration is satisfied that protection of the nursery playground is sufficient in relation to the adjacent alleyway traffic. SUFFICIENCY: The appellant 's request for rezoning was filed on a Short Form Rezoning Petition, subscribed and sworn to before a Notary Public on March L0, 1976, and received by the City Planning Office on March 31, 1976. B. PROPOSED USE: Establishment of a nursery school within a structure currently existing on the proposed site. See Section 60.423 (Principal Uses Permitted Subject to Special Conditions) , Paragraph C, Page 20, City of Saint Paul Zoning Ordinance. � C. FRONTAGE AND AREA: The proposed site has a 282 foot frontage along View Street and is 150 feet in depth along Randolph. The area is approximately 42,300 square feet. D. SITE CONDITIONS: The site is bounded by Randolph to the north, Juno to the south, View Street to the west and a single-family dwelling to the east. The site consists of St. James Church and St. James School. The site is approximately at street level in all directions. There is adequate off-street parking provided by a hard-top area to the rear of the church. E. AREA CO\DITIONS: The area is developed predominantly with single family residential dwelling units of the pre-war construction era, built on mediiim size lots. There are two multi-family units in the area builk during the past decade. There are two other churches in the area; St. Peter's Lutheran Church and Olivet Methodist Church. Near the St. James Church and School area is a Juvenile Justice Center (489 View Street) a restaurant and a combination liquor store and supermarket. There is � only one vacant lot in the immediate area. F, FINDINGS: 1. Rezoning of the proposed property wi� � �ot lower the property values of the adjacent neighbors. 2. The only structures on the property requegced for rezoning are the St. James Church, and the St. James School. ♦ ' �� / V / L1 Eugene Clemens (Cont'd) Page 2 3. The appellant 's request for rezoning is in association with establishing a nursery school within the current St. James School atructure. 4. A clean line of dimarcation exists between the proposed site and all other surrounding properties, There is only a one-step graduated difference between R-4 single family and RT-1 two family townhouse. G. STAFF RECOMMENDS that said request by the appellant for rezoning of the proposed property be granted. Granting of such requeat will not violate the intent and purpose of the City of Saint Paul Zoning Code. The reuse of the structure is very similar to the current use. The rezoning, if granted, would allow the appellant to seek a special co�tdition use permit for the nursery under a RT-1 zoning district. It is evident that the appellant is not going to convert the St. James School nor the church itself into a two-family townhouse. MINUTES OF THE PUBLIC HEARING BEFORE THE CURRENT PLANNING AND ZONING COMMITTEE AT A MEETING HELD ON THURSDAY, MAY 6, 1976 EUGENE CLEMENS (7902): A petition to rezone from R-4 to RT-1, property located on the East side of View Street between Randolph and Juno. Mr. Ted Zarembol, Principal of St. James School, was present to represent the petitioner. There was opposition present. Mr. Shelton showed slides of the site and presented the staff report, and stated that there was a letter on file from the Police Department stating that the granting of this rezoning would not create a traffic hazard in the area. Mr. Ted Zarembol, a resident of Northeast Minneapolis and Principal of the St. James School, stated that the purpose of the rezoning is to enable the school to operate a pre-school in the existing building, and stated that the only thing they are asking to be rezoned are the school and the church basement and the play area/parking lot; this should not include the rectory. The rezoning of this property will allow them to apply for a license for a day nursery for between 17 and 30 children, using only a portion of the school building. Mr. Shelton stated that since it is religious property, the rezoning of the entire lot as opposed to portions of the lot would make no difference. Mr, Adolph Gisch, 760 Randolph, stated that the alley adjoining the lot permits access to his residential property and asked if anything would be done to the alley. Mr. Zarembol stated that they would not build any structures, and they would rope off the alley. Mr. Rupp stated that Mr. Gisch was concerned about whether he would still have access to his garage off of the alley, and asked Mr. Erickson if it is a public alley. Mr. Erickson stated that it is shown on the map as a dedicated alley, and left the meeting in order to verify it. Mr. Rupp stated that if it is a public alley there would be no question but that it would have to remain open. Mr. Zarembol asked if the whole parking lot is considered alley. Mr. Rupp stated that there would be a designated amount alotted for the alley. Mr. Hummer asked if the school owns both sides of the alley in that place, but Mr. Zarembol stated that he didn't know. Mr. Hummer stated that if the alley was already vacated, the applicant wouldn't need anyone else's consent to use it. � . , , ,�� ��� , � Eugene Clemens (cont.) Page 2 , Mr. Rupp stated that the people are presently using that alley as access to their garages. Mr. Hummer stated that if it belongs to the residents they can maintain control over whether it can be vacated. Mr. Gisch stated that 12 years ago they wanted to vacate the alley and they wouldn't vacate it, and he asked if it could be marked with a yellow line to show where the alley is, as they now go across the playground because the alley is not designated. Mr. Rupp stated that if the alley is being used for something other than an alley that use will have to stop. Mr. Erickson stated that the alley is designated on the map as a T-whaped alley. Mr. Rupp stated that the problem is that there is no dema.rcation between the alley and the playground and they are driving over the playground as well as the alley. Mr. Erickson stated that there is platted a 20 foot alley. Mr. Rupp stated that they would have to get a demarcation; they don't want nursery school children playing on the lot which could be mistaken for alley. Mr. Erickson stated that if it is a City owned alley the Department of Pulalic Works would survey it. Ms. Norton said that it is all asphalt, which looks like the playground runs right up to the garages. Mr. Gisch stated that the St. James Men's Club blacktopped the lot 25 years ago with no consideration for where the alley and playground were located. Mr. Rupp stated that they want to make sure to identify the alley. Mr. Erickson asked if Mr. Rupp was suggesting that the Church place a fence on the property line. Mr. Rupp asked Mr. Zarembol what they intended to do to mark the alley and protect the children. Mr. Zarembol stated that the Licensing Committee suggested that they could rope off the area when they are using it, draw a yellow line to mark it, or post and wire the Church playground so nobody would drive through the property. Mr. Rupp asked what the best way other than a fence is to make sure the alley is separated from the playground area. Mr. McGuire stated that fencing off the site would be the safest way, or putting in curb stops, which would require that the alley be surveyed to establish correct alignment, and recommended that the facility be made safe for the occupants. Since the permit is administratively approvable after the rezoning is complete, it could be held until the applicant proved that the area was safe. . • . , � ' Eugene Clemens (cont.) Page 3 -� Mr. Willits asked the residents of the neighborhood which were present if their main concern is that they continue to have access to the alley, whether it is left as it has been, or whether it is designated as alley. Mr. Gisch stated that it didn't make any difference to them. Mr. Rupp stated that they also have to look at the fact that it must go to the City Council saying that the nursery school warrants demarcation and safety for the children from the alley. Ms. Norton asked if there were requirements of nursery school licensing for the protection of the children. Mr. Rupp stated that they should at least have it in the record so that the Board has done its part to bring it to the attention of the proper parties. Mr. Zarembol stated that he had spoken with Mr. Manning at the Licensing Department, who looked at the playground and said that because it is so large euen without the alley and for the number of children involved, just roping in the area would pass the licensing requirements. Mr. Rupp stated that even with supervision, it would be very easy for small children to go under a rope. Mr. Hummer made a motion for approval of the rezoning, stipulating that no Special Use Permit be granted until the administration is satisfied that adequate protection of the playground from alley traffic is sufficient. Ms. Norton seconded the motion. Ms. Showalter asked if this would be a nursery school or a day care center. Mr. Zarembol stated that the children will be 4 to 6 years old, and the same children will be there every day from 7:30 a.m. to 5 p.m., with more children arriving in the afternoon after a half day of kindergarten. Mrs. Norton then made a motion to further amend that sentence to read, "that the Planning Commission believes residential use is preferable although both comnercial and residential uses are valid land use arrangements for the site."
