WHEREAS, pursuant to resolutiqa,. C. F. No. 267145, approved
May 7, 1976, a public hearing was scheduled for 10:00 a.m. on
May Zq,1976, before the Council of the City of Saint Paul, said
: hearing pertaining to the candition vf the structure located at
436 Case Avenue, Saint Paul, Minnesota; and
WHEREAS, upon facts presented at said hearing consisting of
photographs, inspection reports and the recommendation of the
Division of Housing and Building Code Enforcement it is found and
determined by the City Council that according to the records and
f iles in the office of the Register of Deeds, the last record
owner of the property is Thoma.s Jennings; and that Lincoln Federal
Savings and Loan Association has an interest in the property;
and tha.t it is further determined that the above described building
constitutes a hazardous building within the definition of Minnesota
Statutes Section 463.15 for the following reasons:

a. The building is standing vacant, abandoned and '
is subject to being entered by unauthorized persons;
b. The condition of the building is as follows:
Because of age, deterioration and lack of proper ma.intena.nce,
the building is beyond feasible rehabilitation. The plumbing�
electrical and hot water heating systems are missing and
vandalized. The plaster is cracked and missing and the stair-
ways are broken and missing. Interior doors are broken and
missing, the exterior doors and windows are broken and missing,
the floors are sagging and in need of repair. The outside
stairs are leaning and hazardous and the exterior siding is -
missing and broken. The foundation is cracked and in need of:
repair. The roof is in very poor condition and needs replacing;,
the cornices are rotten and the front porch supports are miss�.ng.
c. The building is' unfit for human habitation in its
present condition;
d. The building constitutes a nuisance and a hazard to :
the public health, safety and welfare because of its physical
damage, dilapidation and inadequate ma.intenance;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463.15 through 463.26 and based upon the foregoing findings o� the '
City Council, the Council of the City of Saint Paul does hereby
ma.ke the following Order:
•- ORDER
1.
The owners of the above building shall make the same safe
and not detrimental to the public p�eace, health, safety and
welfare=:#�y having the said building razed and the ma:terials th�re-
from removed from the premises within thirty (30) days from thp
date of the service of this Order;
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of District Court of Ramsey
County, Minnesota, within twenty (20) days from the date of the
service of this Order, a Motion for Su.�nary Enforcement of this
Order to raze and remove the said building will be ma.de to the
Ramsey Coutity District Court; � .

3. In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Court,
all personal property or fixtures which ma.y unreasonably inter-
fere with the razin and removal of this building shall be
removed within ten �10) days from the entry of judgment; and if
not so removed� the City of Saint Paul shall remove and dispose
of such personal property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against th e above described real estate
and collected as other taxes; and be it �
FURTHER RESOLVED, That a certified copy of this resolution
and incorporated Order herein be served upon the last record
owners of the above described property in the manner provided
by law.

The Division of Housing and Building Code Enforcement is hereby submit-
ting its report on the condition of the structure at the locati�on re-
ferred to above.
The owner of record is Mr. Thomas Jennings, 1679 Payne Avenue , St. Paul,
Minnesota 55101.
The legal description of the property is :
Except West 53 feet, the fol.
Except S. 42 feet of Lot 14,
& All of Lot 15, Block 8,
Edmund Rice 's First Addition.
Because of age , deterioration and lack of proper maintenance, thi� build-
ing is beyond feasible rehabilitation and should be condemned and removed
as soon as possible. The plumbing, electrical and hot water hesting sys-
tems are missing and vandalized. The plaster is cracked and missing and
the stairways are broken and missing.
Interior doors are broken and missing, the exterior doors and windows are
broken and missing, the floors are sagging and in need of repair. The
outside stairs are leaning and hazardous and the exterior siding is miss-

Inasmuch as the conditions outlined above constitute a public ha�zard and
the owner has made no attempt to satisfactorily repair the damac�e despite
our warnings, and the continued vacant and boarded up condition cantrib-
utes a blighting influence on the neighborhood, it is the recommeridation
