WEIEREAS, Clarence Flood holds Class C-2 Restaurant and
Cigarette License No. 5078, expiring July 1, 1976, at the
licensed premises at 678 Concordia Street, Saint Paul, Minnesota;
and
WHEREAS, the License Inspector recommended to the License
Com�n.ittee of the City Council that the said licenses be revoked
at a public hearing June 2, 1976, on the following grounds:
1. Allowing the display and/or consumption of
intoxicating liquor on the premises located
at 678 Concordia.
2. Allowing the storing and/or using of gambling
devices on the premises located at 678 Concordia.
3. Allowing the illegal sale of intoxicating liquor
at the premises at 678 Concordia on March 6, 1976,
March 13, 1976, and Maxch 14, 1976;
and such grounds were communicated to the licensee by letters dated
May 13, 1976, and May 17, 1976; and
WHEREAS, such letters were received by the licensee and the
licensee was present at the public hearing before the License
Committee, June 2, 1976, at 9:00 a.m. , with his attorney, Paul Ra.y,
Esquire; and
WHEREAS, sworn testimony was taken by the License Committee,
taken down by court reporter, of the following witnesses: Joseph
F. Carchedi, License Inspector; Officers Clifford Kelly, Donald
Havel and Bruce Wynkoop, St. Paul Police Department; Sergeants

Police Department; Clarence Flood, licensee; and Alonzo
"Lukey" Lucas; and various exhibits numbered 1 through 8,
including a lab report of Thoma.s R. Burr, Criminalist, St.
Paul Police Department; arid
WHEREAS, the attorney for the licensee was permitted
full cross-examination and the right to argue the evidence;
and
WHEREAS, the License Committee voted unanimously to revoke
the licenses of the licensee based on the evidence received, and
based on the demeanor and credibility of all the witnesses; and

WHEREAS, a copy of this Resolution has been provided to the
licensee prior to its consideration by the Council; now, therefore,
be it
RESOLVED, that the aforesaid restaurant and cigarette licenses
are hereby �a�d-, effective at 12:OI a.m. on the day after publi-
c ation of this Resolution.
