Preliminary and Final Plat Approval for Northern Star Addition

WHEREAS, Northern Star Company has submitted for City Council approval the attached
preliminary and final plat for subdivision of property in the area northwest of the north terminus of
West Gate Drive, west to the Minneapolis - Saint Paul border and north to Burlington Northern
Railroad property, into two industrial lots and one outlot for the purpose of selling one of the lots to
CSM Investors II, Inc. for redevelopment as part of the Westgate Indushial Park; and
WHEREAS, staff in appropriate City departments have reviewed the proposed plat and have
found that it can meet the requirements set forth in Saint Paul Legislative Code Chapter 67 provided
that certain conditions recommended by staff are imposed; and
16 WHEREAS, notice of a public hearing on the proposed plat to be held before the City Council
17 was duly published in the official newspaper of the City, and notices of the public hearing were also
18 mailed to each owner of affected property including all property situated within 350 feet of the
19 subject property; and

21 WHEREAS, the City Council conducted a public hearing on the proposed plat on Apri125,
22 2001, where all interested parties were given the opportunity to be heard and the Council considered
23 all the facts and recommendations concerning the plat; NOW, THEREFORE,
24
25 BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
26 final plat for Northern Star Addition, for property northwest of the north ternunus of West Gate
27 Drive, subject to the following conditions:

29 1. Removal of the portion of the e�sting Northem Star freezer building located on and
30 within ten (10) feet of proposed Lot 1 following closing as specified in Section 13 of
31 the purchase agreement with CSM Investors II, Inc., a copy of which is on file with the

F. HISTOR'Y/DISCUSSION: Northern Star Company is proposing to subdi��ide this property to
sell proposed Lot 1 to CSM Investors II, Inc. for redevelopment as part of the Westgate Industrial
Park. Part of proposed Lot 1 is zoned I-1 and part is zoned I-2; the I-2 portion is bein� rezoned
I-1 to avoid creating a lot with split zoning. CSM has agreed under its purchase ageement with
Northem Star that following closing, CSM will remove that portion of the storage freezer facilit}•
located on and within ten (10) feet of Lot 1. Lot 2 and Outlot A, which ATorthern Star will
continue to own, have access from 5i St. SE in Minneapolis.

H. REQiTIRED FINDINGS:
1. All the applicable provisions of the Legislarive Code are being compIied with.
Subj ect to removal of the portion of the exisring Northem Star freezer building located
on and within ten (10) feet of Lot 2 following closing as specified in Secrion 13 of the
purchase agreement with CSM, a copy of which is on file with the City; subject to a
private easement on Lot 1 if water service to Lot 2 is ever required; and subject to the
proposed rezoning from I-2 to I-I, the proposed ptat is in compliance with al1 applicable
provisions of the Legislative Code.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed subdivision is consistent with the surrounding
industriaI deveiopment, and will not be dehimental to present and future use of adjacent
property.

3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision. This subdivision is to .
provide for sale, cleanup and redevelopment of vacant, polluYed and underused ]and by
CSM in coordination and comparibility with surrounding Westgate Industrial Park
property, much of which CSM also owns and has developed.
4. The subdivision is in conformance with the Comprehensive Plan. This condition is
met. The City's land use plan caIls for redevelopment of sites with contaminated soil as
rapidly as funding for soil cleanup and site prepararion permit, and the General Land Use
Plan Map shows this site as part of an industrial area. In addition, the subdivision is
consistent with redevelopment plans for Westgate IndustriaI Park.
5. The subdivision preserves and incorporates the site's important natural features,
whenever possible. This is a lazgely altered, polluted industrial site; the purpose of the
subdivision is to provide for sale of part of the site for cleanup and redevelopment.
6. All land intended for building sites can be used safely without endangering
residents by peril from flood, erosion, continuousl} high water table, severe soil
conditions or other menace. The site and grading are being designed to meet this
requirement.
7. The subdivision can be economically served with pubGc facilities and senices. The
subdivision can be served with public facilities and services from �Vest Gate Drive and
from Fifth Street SE in Minneapolis. °

STAFF RECOMNI�NDATION: Based on required findings 1 through 7 above, staff
recommends approval of the final plat for Northem Star Addition in the azea northwest of the
north terminus of West Crate Drive, north to Burlington Northem Railroad property and west (o
the Minneapolis - St. Paul border, subject to the following conditions:
1. Removal of the portion of the existing Northem Star freezer building located on and

WHEREAS, Northern Star Company has submitted for City Council approval the attached
preliminary and final plat for subdivision of property in the area northwest of the north terminus of
West Gate Drive, west to the Minneapolis - Saint Paul border and north to Burlington Northern
Railroad property, into two industrial lots and one outlot for the purpose of selling one of the lots to
CSM Investors II, Inc. for redevelopment as part of the Westgate Indushial Park; and
WHEREAS, staff in appropriate City departments have reviewed the proposed plat and have
found that it can meet the requirements set forth in Saint Paul Legislative Code Chapter 67 provided
that certain conditions recommended by staff are imposed; and
16 WHEREAS, notice of a public hearing on the proposed plat to be held before the City Council
17 was duly published in the official newspaper of the City, and notices of the public hearing were also
18 mailed to each owner of affected property including all property situated within 350 feet of the
19 subject property; and
20
21 WHEREAS, the City Council conducted a public hearing on the proposed plat on Apri125,
22 2001, where all interested parties were given the opportunity to be heard and the Council considered
23 all the facts and recommendations concerning the plat; NOW, THEREFORE,
24
25 BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
26 final plat for Northern Star Addition, for property northwest of the north ternunus of West Gate
27 Drive, subject to the following conditions:

29 1. Removal of the portion of the e�sting Northem Star freezer building located on and
30 within ten (10) feet of proposed Lot 1 following closing as specified in Section 13 of
31 the purchase agreement with CSM Investors II, Inc., a copy of which is on file with the

F. HISTOR'Y/DISCUSSION: Northern Star Company is proposing to subdi��ide this property to
sell proposed Lot 1 to CSM Investors II, Inc. for redevelopment as part of the Westgate Industrial
Park. Part of proposed Lot 1 is zoned I-1 and part is zoned I-2; the I-2 portion is bein� rezoned
I-1 to avoid creating a lot with split zoning. CSM has agreed under its purchase ageement with
Northem Star that following closing, CSM will remove that portion of the storage freezer facilit}•
located on and within ten (10) feet of Lot 1. Lot 2 and Outlot A, which ATorthern Star will
continue to own, have access from 5i St. SE in Minneapolis.

H. REQiTIRED FINDINGS:
1. All the applicable provisions of the Legislarive Code are being compIied with.
Subj ect to removal of the portion of the exisring Northem Star freezer building located
on and within ten (10) feet of Lot 2 following closing as specified in Secrion 13 of the
purchase agreement with CSM, a copy of which is on file with the City; subject to a
private easement on Lot 1 if water service to Lot 2 is ever required; and subject to the
proposed rezoning from I-2 to I-I, the proposed ptat is in compliance with al1 applicable
provisions of the Legislative Code.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed subdivision is consistent with the surrounding
industriaI deveiopment, and will not be dehimental to present and future use of adjacent
property.

3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision. This subdivision is to .
provide for sale, cleanup and redevelopment of vacant, polluYed and underused ]and by
CSM in coordination and comparibility with surrounding Westgate Industrial Park
property, much of which CSM also owns and has developed.
4. The subdivision is in conformance with the Comprehensive Plan. This condition is
met. The City's land use plan caIls for redevelopment of sites with contaminated soil as
rapidly as funding for soil cleanup and site prepararion permit, and the General Land Use
Plan Map shows this site as part of an industrial area. In addition, the subdivision is
consistent with redevelopment plans for Westgate IndustriaI Park.
5. The subdivision preserves and incorporates the site's important natural features,
whenever possible. This is a lazgely altered, polluted industrial site; the purpose of the
subdivision is to provide for sale of part of the site for cleanup and redevelopment.
6. All land intended for building sites can be used safely without endangering
residents by peril from flood, erosion, continuousl} high water table, severe soil
conditions or other menace. The site and grading are being designed to meet this
requirement.
7. The subdivision can be economically served with pubGc facilities and senices. The
subdivision can be served with public facilities and services from �Vest Gate Drive and
from Fifth Street SE in Minneapolis. °

STAFF RECOMNI�NDATION: Based on required findings 1 through 7 above, staff
recommends approval of the final plat for Northem Star Addition in the azea northwest of the
north terminus of West Crate Drive, north to Burlington Northem Railroad property and west (o
the Minneapolis - St. Paul border, subject to the following conditions:
1. Removal of the portion of the existing Northem Star freezer building located on and
within ten (10) feet of proposed Lot 1 following closing as specified in Section 13 of the
purchase agreement with CSM Investors II, Inc., a copy of which is on file with the City;
2. A future private easement on Lot 1 for water service to Lot 2 if a water service
connection is ever required for Lot 2.
3. Rezoning of the portion of proposed Lot 1 currently zoned I-2 to I-1; and
4. The applicant shall file a copy of the Council Resolution approving the plat with the
Ramsey County Recorder's Office.

WHEREAS, Northern Star Company has submitted for City Council approval the attached
preliminary and final plat for subdivision of property in the area northwest of the north terminus of
West Gate Drive, west to the Minneapolis - Saint Paul border and north to Burlington Northern
Railroad property, into two industrial lots and one outlot for the purpose of selling one of the lots to
CSM Investors II, Inc. for redevelopment as part of the Westgate Indushial Park; and
WHEREAS, staff in appropriate City departments have reviewed the proposed plat and have
found that it can meet the requirements set forth in Saint Paul Legislative Code Chapter 67 provided
that certain conditions recommended by staff are imposed; and
16 WHEREAS, notice of a public hearing on the proposed plat to be held before the City Council
17 was duly published in the official newspaper of the City, and notices of the public hearing were also
18 mailed to each owner of affected property including all property situated within 350 feet of the
19 subject property; and
20
21 WHEREAS, the City Council conducted a public hearing on the proposed plat on Apri125,
22 2001, where all interested parties were given the opportunity to be heard and the Council considered
23 all the facts and recommendations concerning the plat; NOW, THEREFORE,

25 BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
26 final plat for Northern Star Addition, for property northwest of the north ternunus of West Gate
27 Drive, subject to the following conditions:

F. HISTOR'Y/DISCUSSION: Northern Star Company is proposing to subdi��ide this property to
sell proposed Lot 1 to CSM Investors II, Inc. for redevelopment as part of the Westgate Industrial
Park. Part of proposed Lot 1 is zoned I-1 and part is zoned I-2; the I-2 portion is bein� rezoned
I-1 to avoid creating a lot with split zoning. CSM has agreed under its purchase ageement with
Northem Star that following closing, CSM will remove that portion of the storage freezer facilit}•
located on and within ten (10) feet of Lot 1. Lot 2 and Outlot A, which ATorthern Star will
continue to own, have access from 5i St. SE in Minneapolis.

H. REQiTIRED FINDINGS:
1. All the applicable provisions of the Legislarive Code are being compIied with.
Subj ect to removal of the portion of the exisring Northem Star freezer building located
on and within ten (10) feet of Lot 2 following closing as specified in Secrion 13 of the
purchase agreement with CSM, a copy of which is on file with the City; subject to a
private easement on Lot 1 if water service to Lot 2 is ever required; and subject to the
proposed rezoning from I-2 to I-I, the proposed ptat is in compliance with al1 applicable
provisions of the Legislative Code.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed subdivision is consistent with the surrounding
industriaI deveiopment, and will not be dehimental to present and future use of adjacent
property.

3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision. This subdivision is to .
provide for sale, cleanup and redevelopment of vacant, polluYed and underused ]and by
CSM in coordination and comparibility with surrounding Westgate Industrial Park
property, much of which CSM also owns and has developed.
4. The subdivision is in conformance with the Comprehensive Plan. This condition is
met. The City's land use plan caIls for redevelopment of sites with contaminated soil as
rapidly as funding for soil cleanup and site prepararion permit, and the General Land Use
Plan Map shows this site as part of an industrial area. In addition, the subdivision is
consistent with redevelopment plans for Westgate IndustriaI Park.
5. The subdivision preserves and incorporates the site's important natural features,
whenever possible. This is a lazgely altered, polluted industrial site; the purpose of the
subdivision is to provide for sale of part of the site for cleanup and redevelopment.
6. All land intended for building sites can be used safely without endangering
residents by peril from flood, erosion, continuousl} high water table, severe soil
conditions or other menace. The site and grading are being designed to meet this
requirement.
7. The subdivision can be economically served with pubGc facilities and senices. The
subdivision can be served with public facilities and services from �Vest Gate Drive and
from Fifth Street SE in Minneapolis. °

STAFF RECOMNI�NDATION: Based on required findings 1 through 7 above, staff
recommends approval of the final plat for Northem Star Addition in the azea northwest of the
north terminus of West Crate Drive, north to Burlington Northem Railroad property and west (o
the Minneapolis - St. Paul border, subject to the following conditions:
1. Removal of the portion of the existing Northem Star freezer building located on and
within ten (10) feet of proposed Lot 1 following closing as specified in Section 13 of the
purchase agreement with CSM Investors II, Inc., a copy of which is on file with the City;
2. A future private easement on Lot 1 for water service to Lot 2 if a water service
connection is ever required for Lot 2.
3. Rezoning of the portion of proposed Lot 1 currently zoned I-2 to I-1; and
4. The applicant shall file a copy of the Council Resolution approving the plat with the
Ramsey County Recorder's Office.
