1 WHEREAS, The City of Saint Paul, Division of Parks & Recreation, provides a variety
2 of special events for youth including track & field meets; and
4 WHEREAS, Saint Paul Parks & Recreation is in need of facilities for its Youth Track &
5 Field Meets; and

7 WHEREAS, Macalester College of Saint Paul owns land at 1600 Grand Avenue which
8 includes an athletic track, stadium seating, concession area, restrooms and field space; and
9
10 WHEREAS, Macalester College is willing to give permission for Parks & Recreation to
11 use the stadium and tract for its Youth Track & Field Meet on Friday, June 22, 2001, but wishes

to have the City indemnify and hold the College hannless from claims related to the City's use of
the facilities; and
WHEREAS, provision of track & field opportuniries seroe a legirimate public purpose
by serving the youth of the City; and
WHEREAS, the expenditure ofpublic funds, which includes the promise of
indemnification and defense, for such a purpose will facilitate and allow the City to provide such
opportunities, now therefore, be it
RESOLVED, that the City Council of the City of Saint Paul on behalf of the City of
Saint Paul hereby agrees to defend, indemnify and hold Macalester College harmless from any
and all damages it may be required to pay as a result of suits, claims, actions, or judgments
arising out of the use of Macalester's athletic facilities at 1600 Grand Avenue on June 22, 2001,
which are attributable to the negligent act or omission by the City of Saint Paul, its employees,
agents or contractors.

1 FURTHER RESOLVED, that this indemnification does not include: 1) injuries or B �_S �q
2 damages arising from hidden traps or dangerous conditions of the facilities and tract itself as to
3 which the College had actual or construcrive notice; and 2) damages or injuries arising out of
4 occurrences or events which are not part of the authorized use of the premises or which do not
5 take place on the premises being used as part of the event. Furthermore, nothing in the foregoing
6 provisions shall be construed as a waiver of the municipal tort liability limits and defenses set
7 forth in Minn.Stat. § 466A1 et. seq.
