Segal City Attorney SUBJECT: Trust Fund 50035 - Litigation Trust Fund - Fund Balance 12/3�-/75 - ��75 , 341.92 In response to your memorandum of April 5, 1976, we make the following proposal for closing out the balance in the fund. �� � �� �, Cl� With respect to the moneys collected under City of St. � Paul v. Harper & Row Publishers , et al. , of the sum of #A�S°� �28,6'75. 00, it is proposed that half be remitted to ��, Independent School District No. 625 . I have discussed �!/'� oN the matter with Mr. Richard Battis , attorney for the ��3 School District , and he agrees to this settlement for � (�(, recovery on the part of the School District. When this � law suit was pursued and settlement agre�d upon, there �I11 was no separation of the amounts sought for recovery on behalf of the district and on behalf of the city. Be- cause of the immense complexitt�r of the suit and the time involved, it would seem that this division of the settle- ment figure is a fair one , an.d we recommend that the sum of �14, 337. 50 be remitted to the school district as its recovery under the law suit . In answer to your questions , be advised that we are un- aware of any unpaid obligations incurred in prosecuting suits of this type as listed in the resolution, C. F. No. 243606. The City Attorney' s office presently has a "Mediation Expense Account, " No. 09073, which is designed primarily for unforeseen legal expense, such as for hiring outside counsel in cases where there is a conflict of interest as between City departments , where the City Attorney City Hall, Saint Paul, Minnesota 55102 612 29$-5121 ` ' g'z �'F" ,.�; r, ,�',�; !' �.. 3 �•n t.J_'i Mr. Horrisberger Page Two April 27 , 1976 cannot represent all departments or agencies involved. For instance , there is pending a suit involving one of our own employees where it was necessary to hire outside counsel. When we asked for an appropriation for this account, we of course had no real idea of what would be expected as to expenditures , and the amount of �4, 000 was appropriated by the council to cover these expendi- tures in 1976. Expenditures have already exceeded the appropriation, and based on our experience in the first quarter and to date , we respectfully request that of the balance in the Litigation Trust Fund Account , the sum of �24,000 be appropriated to the Mediation Expense Account. We further propose that of the remaining balance in the fund, approximately the sum of �5,000 be appropriated to the capital expenditures account of the City Attorney' s office for the purchase of certain equipment and furniture needed by the office .
