WHEREAS, The Council has heard all persons, objections and recommendations pertaining to said proposed improve-
ment and has fully considered the same; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does hereby order that the above-described improvement
be made, and the proper City officers are hereby directed and authorized to proceed with the improvement; and be it
FURTHER RESOLVED, That upon the completion of said improvement, the proper City officers shall calculate
all expenses incurred therein and shall report the same to the City Council in accordance with Chapter 14 of the City Charter.

Condemning artd taking an. easement in the land necessary for slopes, cuts and
fitts including right of removal of lateral support from subject tand or re-
mainder thereof, occasionad by excavations thereof or construction of slopes
in the grading of Lenox Rvenue from l,finthrop Street to approximately 500 feet
north, and relocated 6•lildview from Allston to Lenox and Allstan from relocated
'rJitdview Street to Springside Drive.
Atso construct sanitary sewer in Lenox from Winthrop to relocated t-Jildview, in
relocated Wildview from Allston to Lenox, in Atiston from relocated t�lildview
to Springside and in Springside Drive fron Allston to Point Douglas Road (City
Project G-2021 , S-1563A, S-1510R) .
St. Paut l-/ater Utility Staff has revietived the proposed imprQVement and recommends
the instaliation of a water main and its appurtenances in conjunction with the
proposed street improvement; such instal ]ation to extend from the end of the •
existing main on Allston Street at a point 30C� feet south of Springside Drive to
4/ildview Avenue and on 4Jildview Avenue from A1 'ston Street to Lenox Avenue, and, "
on Lenox Avenue from !Jildview Avenue to tne exi.�ting main on tJinthrop Street.
This project is before the Council based on the request of three abutting prop-
erty owners. One person is requesting that 4litdview be constructed and t�vo
people are requesting that Lenox be constructed. The presentation given here
is a compromise of tne two requests (approximately four other alternatives have
been studied}.
The existing right-of-�vay of Wildview and Lenox is in a natural state and is
untravelled. Alston is an oiled trail varying from 12' to 18' in width, and
is the anly access to this area.
I MPROVEl4EPaT
Allston is being presented because construction of sewer, water, and gas mains
would obliterate the existing oiled trail .
The sanita ry sewer project was initiated by the Department of Pubiic '�forks as a
companion project to the proposed grading and paving of Lenox, t•Jildview, and
Allston (City Project tdo. G-2021 ) . This area is nat presently served by aither
storm or sanitary sewers. Building the se�rers now in conjunction �rith the street

paving will avoid the necessity of future trenching through the new pavement
for ultimately certain sewer installation.
The water proposal was initiated by a petition signed by two property o�rners.
Tnis will provide domestic water service to all of the above prop�rties and
will provide for a circulatory system and afford better fire protection.

The petition to grada and surface rliTdview Avenue requested "Improvement of
:Jildview east of the now platted road through the pond, in order to maintain
the ponding area", and by Administrative Order i1o. D-36$, the Department of
Public Works was authorized to make the required investigations " . . so as to
preserve the ponding area on �Jildview between (Lenox Avenue and Allston Street)

The prooerty to be acquired is situated between platted 1di }dview Avenue and the
proposed relocation of t•Jiidview Avenue as proposed for actual street construction.
The pond is intended to serve as a retention/detention basis for storm water
drainage from a 31-acre drainage area to the east. There are no plans in the .
near future to construct the required storm sewer system to p+pe the storm runoff
to this pond because the drainage area is almost totally undeveloped:- The drain-
age area is not platted with a street system in which to construct the sewers so
the Department proposes to await development of the area and the necessary street
systen before proposing the sewer construction or any storm sewer assessment.

fills including right of removal of lateral support from subject land or re-
mainder thereaf, occasionad by excavations thereof or construction of slopes
in the grading of relocated Wildview � Lenax Avenue from Winthrop Street to
Lenox and Allston from relocated Wildvie�v Stre�t to Springside Drive.
Aiso construct sanitary sewer in Lenox from Winthrop to relocated Wildview, in
relocated Wildview from Allston to Lenox, in Allston from relocated 4lildview
to Springside and in Springside Drive from Allston to Point Douglas Road (City
Project G-2021 , S-1568A, S-1510R) .
St. Pau1 Water Utility Staff has reviewed the proposed improvement and recorrrnends
the installation of a water main and its appurtenances in conjunction with the
proposed street improvement; such installation to extend from the end of the
existing main on Allston Street at a point 300 feet south of SPringside Orive ta
Wildview Avenue and on Wildview Avenue from Allstan Street to Lenox Avertue, and
on Lenox Avenue from Wildview Avenue to the existing main on Winth rop Street.
This project was before the Council on April 13, 197b, and the Council laid the �
order over to May 25, 1976, and directed the Department of Public tJorks to com-
plete a more detailed design of Alternate Plan "C".
, The existing right-of-way of Wildview and Lenox' is in a naturat state and is
untravelled. Allston is an oiled trail varying from 12' to 18' in width, and is
the only access to this area.
IMPROVEMENT
Allston is being presented because construction of sewer, water, and gas mains
would obliterate the existing oilPd trail .
The sanitary sewer project was initiated by the Department of Public Works as a
companion project to the proposed grading and paving of Lenox, 1�ild�iew, and
Allston (City Project No. G-2021) . This area is not presently served by either
storm or sanitary sewers. Building the sewers now in conjunction with the street
paving wilt avoid the necessity of future trenching through the new pavement for
ultimately certain sewer installation.

Since construction of ths sanitary sewer in the proposed new Witdview right-
of-way would be extremeiy deep, the Departr�nt proposes to run the sewer from
Lenox to Aiiston on an easement bordering the pond proposed for acquisition.
This easement may be described as follows:
Except for the proposed relocated Wildview Avenue right-of-way,
the westerly ten feet of Lot 3 and the westerly tert feet of the
southerly 100 feet af Lot 19, Block 9, Burlington Heights
Division No. l .
The proposed sanitary sewer in Lenox Avenue wi)1 run through those parts of
Lots 384, Black 9, Burlington Heights Division No. 1 , lying between tha platted
Lenax Averrue right-of-way and the proposed relocated rights-of-way of Lenox and
Wildview Avenues.
The water proposal was initiated by a petition signed by twa property awners.
This will provide domestic water service to ali of the above properties and wili
provide for a circulatory system and afford better fire protection.

all those parts of Lots 17-23 inclusive, Block 7, Burlington Heights
Division �lo. 1 , lying southeastsrly of the following described line:
Beginning at the most southerly corner of said Lot 17; thert north-
easterly to a point on the nortfi easterly line of Lot 17, a distance
of 35 feet northwesterly to the most easterly corner of said Lot 17; .
thence northeasterty, to a point on the northeasterly line of said Lot
18, a distance of b0 feet northwesterly of the most easterly corner
of said Lat 1$; thence no rtheasterly to a point on the northeasterly
line of said l.ot 19, a distance of 70 feet northw�sterly of the most

This proposed acquisition is known as the IJILDVIEbd PQAlD EASEMENT, City Project
No. S-1510R.
The petition to grade and surface Wildview Avenue requested "Improvement of :
Witdview east of the now platted road through ttre pond, in order to maintain
the ponding area", and by Administrative Order No. D-868, the Departm+ent of Public
Works was authorized to make the required investigations ". . . so as to preserve
the ponding area on Wildview between (Lenox Avenue and Allston Street) ..."
The property to be acquired is situated between platted Wildview Avenue and the
proposed relocation of 4lildview Avenue as proposed �For actual street construction.
The pond is intended to serve as a retention/detention basis far storm water
drainage f rom a 31-acre drainage area to the east. There are na plans in the
near future to construct the required storm sewer system to pipe the storm runoff
to this pond because the drainage area is almost totally undeveloped. The drain-
age area is not ptatted with a street system in which to construct the sewers sa
the Department p roposes to await development of the area and the necessary street
system before proposing the sewer construction or any storm sewer assessment.
