3 Fund 09070-0511 to Ruth Pazker, the suxn of $43,000.00 in full and final settlement of her claim
4 for damages sustained on May 7-� 1998, as a result of an automobile accident in the City of St.
5 Paul with a police squad car driven by Police Officer Gnia Dua Kong.

Dua Kong. Officer Kong was eastbound on W. 7`" Stteet when he xeceived an em�gency ca11 and made a U-tum in front of the plaintiffs,
' who were westbound on W. 7`" Street. Mrs. Pazker struck the squad caz.
Mrs. Pazker brought suit for injuries, lost wages, damages for the impaiiment of her future eaiving capacity, and pain and suffering. Mr.
Pazker made a loss of consortium cla'un.
�T'fie mattei progressed tluough prehial discovery. The City determined that Officer Kong had not acrivated his emergency ligJ�ts prior
to maldnghis U-huu. The piainriffs produced an expert in accident reconshuc6on who concluded that the accident was unavoidable given
5heclaseproximityberiveentheplaintiffsandtheOfficer'ssquadattherimeofthetum. Mrs.Pazkex'sphysicianopinedtt�atshesuffered
permanent soft tissue to her neck, shoulders, and upper anns. The plainriffs claim $33,233.91 in medical expenses and $15,656.00 lost
wages. Whffe ffie City's expert disagreed with the diagnosis made by Mrs. Pazker's doctor, he did conclude that the medical e�cpenses
were reasonable and necessary.
After an objective review of the above evidence, and based upon our assessment of the potential liabiliry at hial, our office has entered
into a proposed settlement agreement wluch contemplates the payment by the City of $43,000.00 to the plainriffs in exchange for their
full and final release of all clauns and rights against the City and its employees arising from the accident. Council approval of tlus
settlement is recommended.
