above improvement, and the award of damages therefor, and also upon the assessment of benefits therefor, and the
Council having duly considered the same, now therefore be it
- RESOLVED, That the taking and condemnation of the lands described in the annexed assessment roll, identified
by the signature of the Director of Finance and made a part hereof, and the awards of damages to the owners of such
lands for said taking and condemnation as set forth in said assessment xoll, be and the same is hereby in all respects
ratified and confirmed.
RESOLVED FURTHER, That the said assessment of benefits, be and the same is hereby in all respects ratified,

Dear Mr. Webber:
� This project was bafore tfie Gity Council on July 31 , 1974 and was
laid over until the W. Seventh Street Association could canvas ail the
property owners.
The canvas indicated 13 in favor, 10 opposed and one absterrtiaR.
The matter was rescinded by the Council.
A new canvas was requested in tfi� spring of 1975, an� indicated ?;
in favor, 8 opposed. This petition was maided to the City Clerk, wfio -
forwarded� it to th� PUb1�C WOCICS Co�rnnittee. A public hearing was hetd �
before the Publ ic Works Ccxnmittee on October 17, 1975 and th+� Ccm�ni tte,e
recommended that the matter be brought before the Coanci l. - On Qec,en�ber
9, 1975 the Council passed the final order for constructing th� altey�.
Anotfier hearirtg on this matter is scheduted on May 1$, fi976. Fhis
hearing is for the purp�s� of awarding damages, but in thi5 case there
does not appear to be arty. At this hearing you may ask the Cou�rcit to �
reconsider their decision of D�cember 9, 1975.
Since the date of the final hearing we have red�signed tfie propased
drainage of this alley to reduce the constructiort costs.

We have not as yet let a contract to construct alleys this year, but I
would anticipate that constructian of your aliey would begin late this
surtxne r. .
The assessments for improvements generally are levied one year after
completion of the project.
There has been a considerable amount of gravel placed on this ailey in
an attempt to eliminate the puddles. When the puddles dry up, the
gravel becomes the root of a dust problem.
Because of the severe drainage and dust problems of this alley, the
Department of Public Works would prefer that this project not b�
�econsidered.

City Council Members,
This is to inform you that we are totally opposed to the taking of
any of our property for easements in the alley in B:1ock 1, Michel
and Robertson' s Addition from T�iilton Street to Victoria �tr�et.
We've been opposed to this expensive and unnecessary improvement
from the beginning. This will benefit only a very few families and
could have been handled in a much less expensive manner. Those
opposed are in the rnajority and we can prove it with their
signatures. You were given �roof of this majority in December, but
it was obviously ignored. We feel this was handled in an undemocratic
way and we've all lost faith in our city �overnment.
If the easements take our fence and evergreens along the f�nce, we
s�all expect the city to pay for a privacy fence to take the p�a,ce of
the trees.
