SUBJECT: Claim of Roxanne Manke The claim of Roxanne Manke arose out of an incident when she was swinging on a swing at Cherokee Park and one of the chains supporting the swing seat broke as she was at the height of her backswing. She fell to the ground suffering fractures of three fingers and also spraining both ankles. One of the fingers is permanently deformed which she claims causes her embarrassment, and she complains that the fingers that were broken are weak. Also, she was unable to walk without assistance for about four days after the accident and she was unable to function normally for a period of about three weeks due to the splints on her fingers. As a result of the accident, Miss Manke incurred medical bills in the amount of $173 . 30, and she was unable to take a job that she was training for. My investigation showed there was no negligence on the part of Miss Manke, but possible negligence on the part of the City. I would recommend that you approve the settlement of $800. 00 which, after payment of all costs incurred, leaves her with about $200 . 00 for pain and suffering and loss of earnings.
