TFiIS INDENTURE, made this „;�y�day of March 1976, by and between the HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF SAINT PAUL, MINNESOTA, a public body corporate and politic, under the laws of the State of Minnesota, hereinafter the "Authority" and the CITY OF 5AINT PAUL, MINNESOTA, hereinafter the "City" . WITNESSETH: WHEREAS, the Authority is the owner in fee simple of that parcel of land situated in the County of Ramsey, State of Minnesota, described as follows, to-wit: That part of Lots 7 and 8, Block 5, Bazil and Guerin' s Addition to �t. Paul, described as f�llows: Commencing at the Northeasterly corner of said Lot 8; thence Westerly along the Northerly line of said Lots 7 and 8 to the Easterly line of St. Peter Street; thence Southerly along the Easterly line of St. Peter Street to a point 6 inches South of � the Southerly line of the North 1/3 of said Lots 7 and 8; thence ' Easterly and parallel with the Northerly line of said Lots 7 and 8 to . the Easterly line of said Lot 8; thence Northerly along the Easterly line of said Lot 8 to the point of beginning; together with that part of St. Peter Street vacated by the Common Council of the City of St. Paul by resolution dated July 28, 1926 , a certified copy of which said resalution is recorded in the office of the said Register of Deeds in Boak 111 of Miscellaneous on page 123; and WHEREAS, the City desires an easement on, under, across and through a portion of that land; and WHEREAS, the Authority desires to grant unto the City a certain easement as set forth more particularly hereinafter to satisfy the needs of the Ci ty. . The City agrees for itself and its successors to or of the easement desc:ribed herein or any part thereof, that the City a�nd such successors and assigns shall not discriminate upon the basis of race, color, religion, sex or national origin in the use of said easement. It is intended and agreed that the foregoing agreement sha11 be a covenant running with the 1and, and that said agreement shall be binding to the fullest extent af law and equity for the benefit and in favor af and enforceable by the Authority, its successors and assigns, and the United States of America against the City, its successors and assigns. It is further intended and agreed that said agreement and covenant shall remain in effect without limitation as to time.
