An administrative ordinance approving the terms and conditions
of the 1976 Memorandum of Agreement between the City of Saint Paul,
Independent School District No. 625, and the Pipefitters° Local 455.
WHEREAS, the Council, pursuant to the provisions of Section 12. 09
of the Saint Paul City Charter and the Public Employment Labor Relations
Act of 1971, as amended, recognizes that for the purpose of ineeting and
negotiating the terms and conditions of employment, the Pipefitters' Local
No. 455 is the exclusive representative for City employees falling within the
unit as certified by the Bureau of Mediation Services under Case Number
73-PR-480-A; and
WHEREAS, the City through designated representatives, and the
exclusive representative have met in good faith, negotiated conditions and
terms of employment for the year through May 31, 1977, for such personnel
as are set forth in the Agreement between the City and the exclusive repre-
sentative; now, therefore, '

y THE COUNCIL OF THE CITY OF 5AINT PAUL DOES ORDAIN: i
Section 1. That the agreement created as of the effective date of this
ordinance, between the City of Saint Paul, Independent School District No. �
625, and the above-designated representative, on file in the office of the �
City Clerk, is hereby approved, and the authorized administrative officials
of the City are hereby authorized and directed to execute said Agreement on
behalf of the City.
Section 2. That the wage schedules indicated in the Agreement with the �
Pipefitters' Local 455 shall take force and effect retroactively to the dates
set forth in the Agreement, in accordance with the expressed intent of the
agreement of this Council contained in Council File Number 2664].�.

Section 3. That the early retiree benefits provided in 12. 26 of the
Agreement shall not become effective until the first day of tlie first month
following the effective date of this ordinance.
Section 4. That any other ordinance, rule or regulation in force when
said Agreement takes effect, inconsistent with any provisions of the terms
or conditions of said Agreement, is hereby repealed.
Section 5. This ordinance shall take effect and be in force thirty days
after its passage, approval, and publication.

This Memorandum of Agreement by and between the City of Saint Faul, Indepen3ent
School District No. 625 and the United Association of Pipefitters, Loc.ai 455.
In full settlement of 1976 negotiations, the parties hereto have a�reed as
follows: �
1. Except as herein modified, the Agreement between the parties,
entered into October 28, 1976, shall be the basis of the
forthcoming Labor Agreement.
2. Article 8 shall be amended by adding the following subpar-
agraph im�+ediately after subparagraph 8.7.
8.8 STANDBY - Any Refrigeration, Gas and Oil
Serviceman who is required to be available
for emergency service work on weekends and
holidays shall be guaranteed work or wages
and fringes equivalent to:
40 minutes for Friday nights
80 minutes for Saturday and Saturday night
$0 minutes for Sunday and Sunday night
or
80 minutes for any holiday and holiday
night or such 24 hour shift
All of the above at time end one-half rate.
If the employee is called in f or work, the
above time shall be a part of, not in addition
to, the time worked.
3. Article 12.2 shall be amended by striking out subparagraph
12.25 which reads as follows:
12.25 Severance benefits as estabZished by
Ordinance No. 11490.
and substituting in lieu thereof the following subparagraph:

Ordinance No. 11490 with a maximum
payment of $�+,000.

12.26 The EMPLOYER wi11 for the period of this
AGR�EMENT provide for EMpLOYEES �.�ho are
eligible for the City's Health and Welfare
benefits and who retire after the time of
execution of tYais AGREEMENT ar wY�o have re-
tired since April l, 1g15, and until such
EMPLOYEE9 reach sixty-five (65) years of
age such health insurance benefits as are
provided by the EA+lPLOYER.
12.27 In order to be eligible for the benefits under
the provision of 12.26 the EMF'LOYEE must:
l. Be receiving benefits from a public ea;ployee
retiree act at the time of retirement.
2. Have severed his relationship with the City
of Saint Paul under one of the early retiree
plans.
5. Appendix C and D of said AGREEMENT shall be replaced with
Appendix C and D Which are attached hereto and made a part
hereof.
6. It is elso agreed that the duration of the 1976 AGREEMENT
shall be through May 31, 1977, and that said termination
date shall be set forth in Article 28.1 of the r,e� CollectivE
Bargaining Agreement.
It is understood that tlae above settlement shall be recommended by the City
Ne�otiator, but is subject to approval by the City Administration and adoption
�y the Civil Service Commission and the City Council.

The EMPIAYER shall establish Worl�an's Compensation and Unemploymer.t
Campensation programs as required by Minnesota Statutes.
Tne EI�LOYER'S fringe benefit obligation to participa�ing employee�
as de°ined in Articles 1�.3, 12.4 ar.d 12.5 is limited to tne contributi::.::
�r.d;�cr deductions established by this AGREEMENT. The actual level of benefit�
provided to employees shall be the responsibility cf the Trustees of tre
variou� funds to which the EMPLOYER has forwarded cor�tributicns a:,d;`cr

ACTION REQUESTED:

PURPOSE AND RATIONALE FOR THIS.ACTION; •
This ordinance approves a 1976 Memorandum of Agreement between the
Ciiy, Independent 5chool District No. 625, and the Pipefitters Local No. '
455. This Agreement increases the ma,xi.muxn severance pay from $3,000
to $4, 000 a,nd provides health i.nsurance for early retirees. , It also iacludes
a provision for sta.n.dby pay and a wage rate �.ncrease of $. ?6 per hour
which is based on the outside Union rate.
