of Appeals and Review pertai.ning to the following listed property

PROCEEDINGS : `
Ms. �latau explained that she was ner�r in the field of property owner-
slii:p, but had been told before she bought the building tha� there were
certain de�iciencies needing correction. Since the lighting and ventila-
tion requirements were very nearly met in the basement unit, she aske d
for a waiver on that item.
Frank Staffenson stated that his department would ordinarily not oppose
a waiver in this situation, but a second exit for use in an emergency
� was needed. In order to provide one, a slightly larger window opening
was: necessary. It r�ras his recommendation that the opening be widened
b� xemoving one course of cement block and lengthened by removing one
coux��e, and tFiat a steel plate be placed at the top of the opening
and a ��r-ing-out. type of window installed.
lvj$, Flatau asked if she might have automatic sprinklers installed over
tIie heating plant as an alternative to a one-hour fire rated enclosure,
and Mr. Staffenson replied that either method was acceptable . •
Ms . Flatau noted that the inspector had cited "open bare wiring" in the
Survey Letter, so she had asked an electrician to come out to look at �
it. He determined that the wires were telephone wires , not electric -

Mr. Glassman reported that the property appealed by rirs . May Goldberg at
the July meeting had been sold. Mrs . Goldberg would therefore not need
to appear before the Board in October, since sale of the property made
further cansideration unnecessary.

SUBJECT:
Request Waivers of St. Paul Legislative Code rec{uirements pertaining to
shared bathrooms , because of lack of space , and upgraded electrical
service , Items #56 and #70 , respectively, as designated in Survey Letter
of 7/26/77, so as to obtain a Certificate of Occupancy, because of
financial hardship to tenants if rents must be raised to cover costs .

PROCEEDINGS :
. Mr. Sandellrelated that there �rere two apartments on each of the two
floors of his building, Tfi_e dowristairs units each had its o�n bathroom,
but the two upstairs apartments sh.ared a bathsoom. An older couple had
lived in one of the upstairs units for 35 years and t�i:ey sIiared a fiath
t�rith a single girl �vho occupied the other apartment. He said there was
no space for another bathroom on that floor.
Chairman Wozniak asked Mr. Sandell what he proposed to do about the
electrical work required. Mr. Sandell said he had held ug on it pending
a decision by the Board on the shared bathroom, since he saw that as a
large problem. If he had the wh.ole house rewired, he realized th.at most
of the smaller electrical items on the list would be elimin ated, but the
cost of rewiring and the possibility he might be required to install
ano�her bathroom would be more than he could manage financially. He
told the Board that he was not interested in making a fortune fram his
rentals, that the older couple paid only $75 per month, but if h.e had
to spend large amounts of money, it could mean a Iarge increase in rents
he would have to charge.
Mr. Glassman asked Mr. Sandell if he would be willing to do aIl the work
required by the city if he were allowed to continue the shared bathroom
arrangement . Mr. Sandell said he would first have to find out the cost
and then see if he could get the financing. If he could not obtain a
large enough loan, he would have to return to the Board to request an .
. extension of time . . - = •
Chairman Wozniak asked Mr. Staffenson if the number of convenience outlets
could be waived if 200-amp service was installed to make sure there was
no overfusing.

Frank Staffenson replied that this would be reasonable in a one or two-
family house, but in a multi-family building, there was no way to predict
how much current would be drawn at a given time and there could easily be
a problem with overloading. In this case, i�rith only _two convenience outlets
in each apartment, no one knew how many extensions there we re an one outlet,
�rhich made the situation even more dangerous . He felt that additional
convenience outlets were necessary in this b uilding.
Chairman Wozniak asked Mr. Sandell if he felt a restriction an the number
of occup ants in the units w�re the bathroom was shared would make it more
difficult to rent. Mr. Sandell answered that he did not believe it would.
Mr. Staffenson said that if the Board allowed the shared h athroom, his
department . would be agreeable if two conditions were met: (1) Upgrade
the electrical service , and (2) Complete Item No. 8, both (a) and (b}
. immediately. (a) was a requirement that the water heater be replac�d
by a shorter one of the same or greater capacity, to permit proper flue
installation to the chimney, and (b) referred to the furnace which needed
a correction of backpitching of the flue pipe . The furnace should also
�� separated from the other areas of the building by a one-hour fire rated
enclosure or a sprinkler system installed, and tfiere were other speci-
fications of a detailed nature that should be met to eliminate the danger
of carbon monoxide spillage.
Mr. Sandell asked whether the �raiver of the shared bathroom would be for
the period of his ownership or for the life of the building. Chairman
t'�ozniak said it was his personal feeling that the waiver should run with
the building, provided Mr. Sandell put the building into good condition
and the upstairs apartments were restricted to two persons in each.
�80ARD ACT�ON:
Mr. Glassman moved to grant a waiver of St. Paul Legislative Code
requirementpertaining to shared bathrooms, said waiver to be effective
for the life of the structure, provided that Item No. 8,� as designated
in the Survey Letter of 7/26/77, be completed by October 9 , 1977, and
the remainder of the Iisted deficiencies be corrected by January 26,
1978, as per schedule set up by the St. Paul Division of Code Enforce-
ment . Mrs . Peake seconded. MOTION CARRIED AND S0 ORDERED.
