An Ordinance amending Chapter 3¢5 of
the Saint Paul Legislative Code pert�ining
to the regulation of the locations o� news
stands.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: -
Section l.
That Chapter 365 of the Saint Paul Legislative Code be and
is hereby amended to read as follows:
365. 01. Permit Required. No person, firm or
corporation shall, within the limits of the City of
Saint Paul, install or maintain' any news stand on
any of the public streets and highways therein without
obtaining a permit so to do, as hereinafter provided.
_ 365. (32. .- Definition. The term "news stands, ° as.
usecY 3�ere•��:, shall include automatic newr�epaper vending
machines and so-called "honor boxes" , more particularly
described as metal containers mounted on posts, the
. plans of the intended materials and manner of instal-
laticr�of which shall be approved by the Director of
the Department of Public Works.
365. 03. Application. Persons desiring to maintain
news stands on any public street shall make application
to the Department of Public Works. The applicant shall�
specify the proposed locations of news stands. The
locations shall be examined and if the Director is

satisfied that the proposed sites will not constitute
a serious hazard or obstruction to pedestrian or
motor vehicle traffic, the permit shall be issued
upon the applicant' s furnishing the surety bond
specified in this ordinance.
365. 04. Conditions. The application form shall
contain an agreement to be signed by the applicant,
which agreement shall provide:
(1) That the applicant will furnish such
stand or stands at his own expense, and
that such stands shall not exceed 18 inches
in width, 48 inches in length, and 48 inches
in height. However, a permit may be granted
for an enclosed news stand on the west side
of Wabasha Street between Seventh Street,
and Eighth Street, eight feet north of the
building line of Seventh Streets, and the
dimensions of said stand shall not exceed
55 inches in width, 31 inches in depth, and
79 inches in height.
(2) To maintain and keep such stand or stands
at the outer edge of the sidewalk, unless
otherwise directed by the Director of Public
Works.
(3) To maintain at all times said stand or
stands in an orderly condition, and to remove
all twine, rope, waste paper and other debris
and place same in proper paper containers.
(4) To remove such news stand at once when
the Director of Public Works should determine
that it constitutes a serious hazard or
obstruction to traffic.

(5) To use such news stand for the sale of
newspapers only.
365.05. Issuance. Permittee shall notify the
Department of Public Works in writing specifying
additional locations or relocations of news stands
within 48 hours of placement by the permittee, and
shall remove any of them in the event the Director
of Public Works should determine that the new stands
constitute a serious hazard or traffic obstruction.
365. 06. Bond. The applicant shall furnish a
bond to the City of Saint Paul, in the sutn of
$5, 000.00, provided that where application is made
for more than one stand, such bond shall be deemed
to cover all news stands for which permits are
given. The bond shall be conditioned to save the
City of Saint Paul harmless from any and all
liability, judgmen.ts, damages or expense that may
arise or grow out of the installation, maintenance,
use, presence or removal of said news stand or
stands.
365. 07. Revocation. In the event the Director
of Public ti�7orks shall order tlie removal of a news
stand, or should deny a proposed location of a news
stand, based on a finding that the location con-
stitutes a serious hazard or traffic obstruction,
the permittee may appeal -the decision to the City
Council. The Council shall, upon due notice to
the permittee, hold a public hearing and after hear-
ing from the permittee and the Public Works Depart-
ment, shall make a final determination as to whether
or not the proposed location shall constitute a
serious hazard or traffic obstruction.
