adopting a new zoning ordinance for the City
of Saint Paul, repealing Chapters 60, 61, 62,

and the zoning map of the City of Saint Paul. °
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
" Section l.
That the Zoning Map of the City of Saint Paul, Sheet No. 17,
as incorporated by reference in Section 60.401 of the Saint Paul
Legislative Code, is hereby amended as follows:
The property owned by George J. and Faye E. Kraemer
on the North side of Grand Avenue between Cleveland
Avenue and Finn Street, more particularly described as,
"Lot 23, Block l, Groveland Addition, "
is rezoned from RM-2 to OS-1.
Section 2.
This ordinance shall take force and effect in thirty (30) days
from and after its passage, approval and publication.

Dear Madam:
This is written in response to the petition of George Kraemer, Jr. (Steve
and Nancy Hendrickson) to rezone property on the north side of Grand Avenue
between Cleveland and Finn from RM-2, a multi family residential district,
to OS-1 , an office service district. 7he property is described as Lot 23,
Block 1 , Groveland Addition.
This matter was heard by the Current Planning and Zoning Committee on
July 21 , 1977 at which time Staff recommended approval of the petition.
A motion to recommend approval was made by Mr. Hummer and seconded by Mr.
Willits. The motion passed on a 7 to 0 roll call vote.
On July 22, 1977 the Planning Commission recommended that this request to
rezone to OS-1 be approa�ed. The motion was made by Mr. Bryan and seconded
by Mrs. McGinley. It carried on a roll call vote of 17 to 0.
This matter is scheduled to be heard before the St. Paul City Council on
August 25, 1977.

Division of Housing and Building Code Enforcement; Mr. Roger Ryan and Mnes. Fearnside
and Fox of the Planning Staff.

RM-2 to OS-1 property ocated on the nort�i�e of�rand between Cleveland & Finn.
The appellant was present. There was no opposition.
Mr. Ryan showed slides of the subject site and read the staff report.
Mr. Hummer questioned the procedure which had been used in petitioning fpr the
rezoning. Mr. Pangal agreed that there was a question about using the_ short form
for this particular rezoning request . Mr. Ryan` said that in his opinlon the short
form was appropriate, and Mr. Willits expressed his agreement with the Staff's opinion.
Mr, Amey read from a portion of state law whe�^e th�. words "substantially equivalent"�
were used, and said it was his opinion that office use is substantially equivalent
because the use was permitted under the old zoning district in this particular case.
Mr. Bryan then agreed to hear testimony in the case.
Mr. Steve Hendrickson, the appellant, said he had checked on whether to use the
short or long form petition, and that his wife had been told to use the short
form. He said there is little traffic involved, and only his auto is involved in
parking, although there is also some parking space in back of the site. He said
he is the sole owner of the business, and has no employees. He added that he
would do nothing to destroy Grand Avenue and that he wants to be in Saint Paul .
Mr. Hummer then made a motion to recommend approval of the rezoning, provided that
the City Attorney rules that the petitioning procedure in this case is correct.
The motion was seconded by Mr. Willits and passed unanimously, on a 7 to 0 roll
call vote.

A. SUFFICIENCY: The applicant's petition for rezoning was filed on a short form
rezoning petition which was notarized on June 29, 1977 and received by the City
Planning Office on June 29, 1977.
B. PROPOSED USE: The applicant proposes to rezone the site from RM-2, Medium Density,
u tip e am� y Residential , to OS-1 , Office-Service, and to convert an existing
one-family dwelling into a photographic studio.
C. AREA & FRONTAGE: The site has 40 ft. of frontage on Grand Avenue and is 160
eet eep, wit an area of 6,400 sq, ft.
D. SITE CONDITIONS: The site is level with Grand Avenue. There is a single family
wel ing on t e site in good condition.

E. AREA CONDITIONS: The surrounding areais mkxed use. To the east is a new 17-unit
apartment ui ing including two dentist offices. The four corners of Grand
and Cleveland are developed with comnercial uses. To the south are one and two
family dwellings and an apartment building. To the west are three one-family
dwellings and three office uses. To the north are school buildings of St.
�� Thomas College. �
F. FINDINGS:
1 ) In general , Grand Avenue is a mixture of multiple family, office, and
business zoning.
2) Office use is about the same intensity of use as multiple family use.
3) There is office use and zoning on the same block to the west:
G. STAFF RECOMMENDATIONS: Staff recommends approval of the petition to rezone to
OS-1 . The proposed zoning and use is in character with present development
of Grand Avenue as a mixed commercial residential street.
