The attached letter of the License Inspector transmitting the applicatian
of Applebaum's Food Markets, Inc, for transfer of Off Sale Liquor License
from 400 N. Western Avenue to 2023 Marshall Avenue was referred for
committee recommnendation by the City Counci.l at its July 19, 1977 meeting.

I move that the Merriam Park Community Council go on record as being
oPPosed to any request to issue or transfer���E��l���i�qucirulicenses
to 2023 Marshall Avenue or to the surrounding area, for the following
reasons:
a) we have enough liquor stores within accessible distances.
b) if a liquor license is transferred to a $ite on the north side of
Marshall Avenue, there could be no prohibition against an
off-sale site on the south side consistent with historical
experience on Grand, Snelling, University, etc.
c) A large off-sale liquor establishment in elose proxi.mity to
churches, schools residences, colleges etc, does not comport
to the rest of the community.
d) the B3 zoning restriction, pages 35 8 36 section C5 of the
Zoning Ordinances for the City of Saint Paul notes: . . . .impact
on adjoining property by use of the site may not result in the
following:
1) loud, boisterous, and disturbing noise levels'
2) hazardous traffic conditions
3) offensive, obnoxious and disturbing orders
4) excessive litter
5) excessive artificial lighting
6) substantial decrease in adjoining property values
7) any other condition inconsistent with the reasonable use
and enjoyment of adjoining property and inconsistent �ith
the health, safety, morals, and general welfare of the
adjoining community.

Oear Members of the Council :
I am a lifelong resident of Merriam Park; 1 have been the assistant
principal at St. Mark's Elementary School for three years and have taught
and coached there for seven years. i am opposed to the proposed off—
sale liquor store to be located at 2023 Marshall Avenue.
The proposed site is very close to my school and very close to Merriam
Park. For the past several yeers we have had some drinking probtems fil—
tering down into our 7th and 8th grades. My con cern is that the presence
of a liquor store so close to St. Mark's wilt make it that much easier for
our grade school youngsters to obtain alcoholic beverages, especialty through
another buyer who is of drinktng age. Then it becomes an easy matter to
move up the block to the park for a drinking party, with the possible noise
and vandalism arising therefrom.
Merriam Park is a good community, and St. lN�rk's is a strong parish. I
believe that a liquor store in this location would place just one more ob—
stacle in the path of parents and teachers who are trying to form our young—
sters' values.

As Pastor of First-Trinity United Methodist Church� 1849 Marshall Avenue,
I am writing to register mq protest against the groposed location of thQ
Applebaum Off Sale Liquor Store at 2a�3 I�arshall Ave.
I have some basic convictions underlying my opinion regarding this.
Having dealt first hand with individuals and families who suffer the
consequencea of the use of alcoholic beverages, I have strong feelings
about any advance in the promotion of such. Obviously the relocatioa of
this Liquor Store is for the purpose of more sales of liquor.
All of us have read the atatistics of the alarming use of liquor on the
part of youth. Many objective sociologists feel that this is far greater
threat than the use of drugs.
The location of an off sale liquor store near to a Burger Chef provides
a good place for youth to obtain liquor. 4ie all �aer that the law is
sometimea circumvented; youth must be getting liquor from some source
and the greater the sources and the more available they are, the greater the
danger to youth.
Our Merriam Park Community ia concerned about this. In fact, lay persons
have initiated opposition to this propase�d liquor store. We are all con-
cerned abouC the welfare of our citq aad our communities and many �oin me
in feeling that this proposed liquor store would not advance the well being
of Merriam Park Community or the city of St. Paul, but would contribute to
negative results that break down our community family and individual life.

Applebaums Food Mart, Inc. , has applied for the transfer of a liquor license authorizing
' the operation of an off-sale retail liquor store f rom its present location at 400 North
Western Avenue to 2023 Marshall Avenue, both in the City of St. Paul. The Marshall Avenue
location is within the patrol limits. This application is made possible by the application
of Howard Johnson's to move the license formally held by Slinger's Bar to the east side
' where it will operate as the Ground Round.
The zoning at 2023 Marshall Avenue is proper to support the application. It .is zoned B-3.
, There appear to be no other legal impediments. The Licensing Committee unanimously recom-
mended approval of the resolution for transfer.
' Premises
In the event the Council acts favorably upon this application, Applebaums intends to clear
the premises at the corner of Wilder and Marshall Avenues. The residential building at
' 253 North Wilder will be removed. Hopefully, the building can be sold and moved. With
renovation, it should provide excellent family housing. The garage type building will be
torn down: Photographs of the two structures are attached hereto as Exhibits 1 - 6.
, Once the property is cleared, a new structure containing approximately 7,000 square feet
will be erected. While the final design has not yet been determined, the building will
, resemble the structure erected by Applebaums at its Cedarvale location. Photographs of
the Cedarvale structure are included herein as Exhibits 7 and 8. It is anticipated that
the building will be a single story structure compatible with neighboring buildings. I
respectfully submit that the building wiil contribute to the esthetics of the neighborhood .
' and will. make a positive contribution to the appearance of Marshali Avenue between Cleveland
and Wilder.
' When considering the question of esthetics, Applebaums will certainly strive to achieve
compatib.ility with the neighborhood and also to erect a building that will minimize the
source of complaints from neighbors. The Council should be aware that the resolution for
' transfer will become effective only upon the issuance of a certificate of occupancy by the
Building Department of the City of St. Paul. Off-sale retail liquor stores constitute a
regulated industry. Not only will the Council have control in this instance over the oper-
ation of the iiquor store but the initial design will be subject to control through the
, certificate of.occupancy procedure. The City will have the opportunity to review in advance
the proposed design of the building, lighting, parking and other matters identified in the
site plan. Finally, it should be emphasized as a regulated business, the hours of operation
' of an off-sale retail liquor store are closely governed. Off-sale retail liquor stores must
close each evening at 8:00 p.m. with the exception of Saturday. On Saturday's these estab-
lishments may operate until 30:00 p.m. They must be closed all day Sunday.
' The License Committee
The License Committee unanimously recommended passage of' the resolution before the Council.
' There was a full hearing before the Licensing Committee in which a number of objections
to the application for transfer were raised. Essentially they can be broken into two
categories: First, there is apprehension over what may happen. Secondly, there is a
, distinct anti-liquor sentiment present in the neighborhood motivating potential neighbors
to qppose the approval of this application.

' The residents expressed apprehension that the presence of an off-sale retail liquor
store might increase the drinking by juvenilles, increase litter and other forms of
debris in the neighborhood and might encourage improper behavior. The testimony pre-
' sented consisted of a series of younger people testifying that they had for years en-
gaged in unlawful drinking and professing fear that their younger brothers and sisters
would continue in this pattern if the Applebaums application was acted upon favorably.
In at least one instance a father and his twenty year old son appeared to express this
' concern. It was obvious that the source of the i1li:cit liquor was still present in
the neighborhood (they conceded that this juvenille drinking continues to the present
time) and that most of the liquor was available at a service station selling 3.2 beer
' located on the same lot as the proposed Applebaums store. It was also apparent that
in the era of the automobile, liquor was available to �uvenilles whether from the immedi-
ate neighborhood or other locations in the ltain Cities on a rather convenient basis.
' The Applebaum family has operated retail grocery establishments in the 7.t,�in Cities for
many years. They have a reputation for service to the community and competence as business
people.. This reputation speaks for itself. I strongly suggest that their presence as
' operators ot an off-sale retail liquor store will not aggravate or contribute to ttiis pre-
existing problem. It is their intention to operate a store that provides a commodity much
in demand by the adult population both in this community and elsewhere throughout the City
' of St. Paul. �
The litter and debris problem relates directly to other businesses presently operating in
the neighborhood. Complaints of beer cans being strewn across neighborhood lawns and up
' and down alleys evidences the earlier problem of juvenille drinking. Most of the beer cans
were identified as 3.2 beer. Other complaints were voiced against a local eating establish-
ment. -
' Again, I think it appropriate to note that Applebaums has operated many gr.ocer stores across

the yIetropolitan Twin City area. They are a St. Paul based, family orientated business.
' They have contributed to the growth and stability of neighborhoods throughout St. Paul.
The problems. that are cited are not problems that have been precipitated by Applebaums nor
problems that they have caused in other neighborhoods. Rather than aggravate the existing
problems, I .respectfully submit that Applebaums may be a mitigating influence upon the other
tbusinesses operating in this vicinity.
The second general eategory af opposition can only be characterized as anti-liquor. The
' alleged evils of liquor cannot he addressed in this application for transfer of a license :
from Western Avenue to Marshall Avenue. Those concerned about the availability of this
commodity lost the argument with the repeal of prohibition. Liquor is recognized as a
' legitimate business. Were the application in this instance for a fast food operation,
many of the complaints would be identical.
I respectfully submit in light of the well known record of competence in community service
' established by the Applebaum s Food Mart,. Inc.. , that this application .is proper. . I request
that it be acted upon favorably by this Council.
