WHEREAS, The Council of the City of Saint Paul in granting
the petition of the Housing and Redevelopment Authority to vacate
a portion of Kent Street by Resolution C. F. 265528 adopted
February 8, 1977, required the Housinc� Authority to dedicate a
utility easement; and
WHEREAS, The Housing Authority has now presented for
dedication the required easement �or utility purposes; now,
therefore, be it
RESOLVED, That the Council of t1�e City of Saint Paul does
hereby accept the said dedication of easement for utility purposes
made and delivered �y the Housing and Redevelopment Authority of
the City of Saint Paul, Minnesota, and the City Attorney is hereby
directed to record this grant of easement in the Office of County
Recorder.

GRANT OF Et3SEMENT FOR UTILITY PURPOSES
THIS INDENTURE made this 9th day of March, 1977, by and between
the HOUSING AND REDEVELOPP�IENT AUTHORITY OF THE CITY OF SAINT PAUL,
I�IINNESOTA, a public body corporate and politic, organized and existing
under the laws of the State of Minnesota, hereinafter the "HRA" , and
the CITY OF 5AINT PAUL, MINPIESOTA, hereinafter the "City".
WITNESSETH:
WHEREAS, the HRA is the owner in fee simple of that property
situated in the County of Ramsey, State of Minnesota, described as
follows, to-wit:
Lot 14, Block 3, Mackubin & Marshall 's Addition
to St. Paul;
Lot 15, B1ock 3, Pdackubin & Marshall's Addition
to St. Paul; _
and
WHEREAS, the City desires a sewer and water utility easement
on, under, across and through a portion of that land; and
WHEREAS, the HRA desires to grant unto the City a certain
utility easement as set forth more particularly hereinafter to
satisfy the needs of the City.
NOW, THEREFORE, IT IS HEREBY MUTUALLY AGR.EED to, by and between
the parties to this instrument as follows :
1. The HRA, in consideration of the sum of One Doll.ar ($1.00)
and other good and valuable consideration, to it in hand paid by
the City, receipt and sufficiency whereof is hereby acknowledged,
does hereby 'grant unto the City a perpetual utility easement in, on,
under, across and through the following described parcel of land:
Those portions of Lots 14 and 15, Block 3, Aiackubin and
Pdarshall 's Addition to St. Paul, described as follows :
Commencing at the intersection of the center line of"
Kent Street and a line 60. 00 feet south of and parallel _
to tne north line of the southwest quarter af Section 36,
T29i1, R23W (said quarter line being an assumed bearing
of east) ; thence south 00 degrees , 06 minutes, 40 seconds
west, a distance of 18. 00 feet as measured along the
center line of Kent Street; thence south 35 degrees,
5.9 minutes, 49 seconcs east, a distance o£ 56. 00 feet to
the inters�ction with the west line of Lot l5, Elock 3,
Mackubin and Marshall 's addition to Saint Paul, said
intersection being the point of beginning of the center

line to be described; thence continuing on the prolonga-
tion of the last described line, a distance of 41. 52
feet to the north line of Lot 2, Block l, Central Village
Addition and there terminating;
The side lines of said easement are to be prolonged or
shortened to terminate on the east line of Kent Street,
and to terminate on the north line of Lot 2, Block 1,
Central Village Addition.
2. It is further mutually agreed upon by and between the parties
to this instrument that �the following conditions and reservations,
as to the above described utility easement area shall be maintained:
a) That no buildings , permanent structures or trees will be
allowed within the easement area.
b) That no change in grade or surfaCing will be allowed
without written permission of the Department of Public
Works and the Water Utility.
c) That the easement includes the perpetual right of the
Public Works Department to construct, maintain, operate
and repair the underground sewer together with a
perpetual easement for ingress and egress to said ease-
ment.
d) That the petitioners , their successors and assigns
shall fully indemnify, defend and save harmless the
Board of Water Commissioners, its officers , agents ,
employees and servants from all suits, actions of
claims which shall arise from any injuries or damages
received or sustained by any break or leak in any
service pipe, water main or connection in said
dedicated easement.
IN WITNESS WHEREOF, the parties have hereunto set their hands
and seal�• on the day and year first above written.
