WITNESSETH: WHEREAS, the HRA is the owner in fee simple of that property situated in the County of Ramsey, State of Minnesota, described as follows, to-wit: Lot 14, Block 3, Mackubin & Marshall 's Addition to St. Paul; Lot 15, B1ock 3, Pdackubin & Marshall's Addition to St. Paul; _ and WHEREAS, the City desires a sewer and water utility easement on, under, across and through a portion of that land; and WHEREAS, the HRA desires to grant unto the City a certain utility easement as set forth more particularly hereinafter to satisfy the needs of the City. NOW, THEREFORE, IT IS HEREBY MUTUALLY AGR.EED to, by and between the parties to this instrument as follows : 1. It is further mutually agreed upon by and between the parties to this instrument that �the following conditions and reservations, as to the above described utility easement area shall be maintained: a) That no buildings , permanent structures or trees will be allowed within the easement area. b) That no change in grade or surfaCing will be allowed without written permission of the Department of Public Works and the Water Utility. c) That the easement includes the perpetual right of the Public Works Department to construct, maintain, operate and repair the underground sewer together with a perpetual easement for ingress and egress to said ease- ment. d) That the petitioners , their successors and assigns shall fully indemnify, defend and save harmless the Board of Water Commissioners, its officers , agents , employees and servants from all suits, actions of claims which shall arise from any injuries or damages received or sustained by any break or leak in any service pipe, water main or connection in said dedicated easement.
