Resolution Establishing a Policy;,$fohibiting Racial Profzling by City of Saint Paul Police Depar[ment
2 WIIEREAS, the City of Saint Paul believes that a11 residents deserve equal proteclion under the law and will
3 continue to enforce fair, equitable and constitufional policing practices. This belief is expressed in the Human Rights
4 Chapter of the Saint Paul Legislative Code (Chapter 183); and
5 WIiEREAS, there is strong community concem and belief that racial profiling is happening in the City of Saint Paul;
6 and
7 WHEREAS, racial profiling may not be seen in documented numbers, but how residents aze treated after they are
8 pulled over based on their sldn color or the neighborhood they live in; and
9 WI3EREAS, historic and cultural norms concerning race and ethnicity may contribute to today's attitudes and beliefs
10 about groups of people; and
11 WIIEREAS, communities throughout the United States have begun to address the issue of racial profiling; and
12 WHEREAS, the Saint Paul Police Departnnent voluntarily collects data on all traffic stops although complexities in
13 documenting racial profiling in the Saint Paul Police Department has raised more quesfions than answers; and
14 WHEREAS, the Police Executive Reseazch Forum recommends that police chiefs and administrators demonsh
15 leadership in supervision, training, recruihnent, education and minority community outreach; and
16 WHEREAS, the Minnesota Peace Officers Standards and Training Boazd recognizes the need for developing an anti-
17 profiling policy for cadets and specific training surrounding this issue; and
18 WHEREAS, the Saint Paul Police Deparhnent has prohibited all acts of racial profiling since July 1996, which is
19 articulated in an internal policy docuxnent ritled Palicy and General Orders. Specifically, General Order 230.13,
20 Conduct Unbecoming a Peace Officer: Principle Three and General Order 23013, Conduct Unbecoming a Police
21 Officer: Policy, Scope and Principles One through Five; and
22 WHEREAS, the NAACP and the Saint Paul Police Department have engaged in discussions mediated by the U.S.
23 Department of Jusfice Community Relations Service from March through June 2001; and
24 WIIEREAS, the ensuing formal agreement resulting from these discussions provides for, among other things, that the
25 Saint Paul Police Department will provide a"consent search advisory" in order to ensure citizens' right to remain
26 secwe in their personal effects; and
27 WIIEREAS, the City of Saint Paul seeks to demonstrate leadership by adopting an anti-racial profiling policy; and
28 therefore be it
29 RESOLVED, that the City of Saint Paul hereby expressly prohibits all City employees from applying the law based
30 on race, color, ereed, religion, national origin, sex, marital status, status with regazd to public assistance, disability,
31 sexual orientarion or age; and be it

32 RESOLVED, that the Saint Paul City Council hereby requests the Saint Paul Police Deparhnent continue to develop
33 and implement proactive measures and steps, including, but not limited to, training, review, reporting and monitoring
34 to ensute that all Saint Paul Police Officers perform their duties equitably, consfiturionally and fairly regazdless of
35 race, ethnicity or color; and be it
36 RESOLVED, that the Saint Paul City Council hereby requests the Saint Paul Police Department to provide it updates
37 twice annually on data compiled (absent individual officer idenrification), as well as efforts to develop and
38 implement stcategies and practices to prevent racial profiling beo nning with a report to the City Coimcil for the first
39 six months of 2001 on September 12, 2001; and be it finally
40 RESOLVED, that the Saint Paul City Council hereby requests the City Attomey's Office and City Council Reseazch
41 to: 11 review the negotiated agreement between the Saint Paul Police Department and the local chapter of the
42 NAACP: and 21 monitor on-eoina discussions between these parties and other interested erouros in the communities
43 such as Southeast Asians and Hisnanics which have ioined the discussions in order to determine the feasibility and
44 advisability of making the statements contained therein City policy, via codification or other means by September 12,
45 2001; and
46 RESOLVED, that the Saint Paul City Council and all City Departmentg continue to strive for equitable and
47 constitutional practices that are inclusive and sensirive to the needs and perceprions of all constituents.

27 WIIEREAS, the City of Saint Paul seeks to demonstrate leadership by adopting an anti-racial profiling policy; and

29 RESOLVED, that the City of Saint Paul hereby expressly prohibits all City employees from applying the law based
30 on race, color, ereed, religion, national origin, sex, marital status, status with regazd to public assistance, disability,
31 sexual orientarion or age; and be it

33 and implement proactive measures and steps, including, but not limited to, training, review, reporting and monitoring
34 to ensute that all Saint Paul Police Officers perform their duties equitably, consfiturionally and fairly regazdless of
35 race, ethnicity or color; and be it
36 RESOLVED, that the Saint Paul City Council hereby requests the Saint Paul Police Department to provide it updates
37 twice annually on data compiled (absent individual officer idenrification), as well as efforts to develop and
38 implement stcategies and practices to prevent racial profiling beo nning with a report to the City Coimcil for the first
39 six months of 2001 on September 12, 2001; and be it finally
40 RESOLVED, that the Saint Paul City Council hereby requests the City Attomey's Office and City Council Reseazch
41 to: 11 review the negotiated agreement between the Saint Paul Police Department and the local chapter of the
42 NAACP: and 21 monitor on-eoina discussions between these parties and other interested erouros in the communities
43 such as Southeast Asians and Hisnanics which have ioined the discussions in order to determine the feasibility and
44 advisability of making the statements contained therein City policy, via codification or other means by September 12,
45 2001; and
46 RESOLVED, that the Saint Paul City Council and all City Departmentg continue to strive for equitable and
47 constitutional practices that are inclusive and sensirive to the needs and perceprions of all constituents.

2 WHEREA5, the City of Saint Paul believes that all residents deserve equal protecrion der the law and will
3 continue to enforce fair, equitable and consfitutional policing practices. This belief i expressed in the Human Rights
4 Chapter of the Saint Paul Legislative Code (Chapter 183); and
5 WHEREAS, there is strong community concem and belief that racial profiling ' happening in the City of Saint Paul;
6 and
7 WHEREAS, racial profiling may not be seen in documented numbers, but ow residents are h'eated after they are
8 pulled over based on their sldn color or the neighborhood they live in; a
9 WHEREAS, historic and cultural norms concerning race and
10 about groups of people; and
ll WI communities throughout the United States have
12 WHEREAS, the Saint Paul Police Deparhnent voluntarily
13 documenting racial profiling in the Saint Paul Police Dep�
14 WHEREAS, the Police Executive Research Forum
15 leadership in supervision, training, recruihnent, edi
16 WHEREAS, the Minnesota Peace Officers Stas
