R �. � Ei � � '� ��i�� 2 i977 c�� a�€�T����� � Telephone612/298-5317 286 City HaII, Saint Paul, Minnesota 55102 � Ma.rch l, 1�'�°����,<:, REPORT ON PROP'ERTY AT 1697 FORD PARKWAY ALLEY MAINTE[�ANCE ASSESSMENT The subject property is located on the northeast corner of the intersection of Ford Pa.rkway and Davern Avenue and is legally described as: Lot 16, Block 3, Ha.rdenbergh Heights Ford Parkway abuts said property on the south, Davern Avenue on the west, a platted aLley on the north and privately owned residential property on the east, as shawn outlined in red on the attached plan. The property described above was included in the plat of I�.rdenber�h Heights, which was approved by the St. Paul City Council on May 28, 1920 and filed of record on June 7, 1920. The aFrners of the property at that time, William A. Hardenbergh and Ella G. Ha.rdenbergh, platted all those lands between Snelling Avern�.e, Da.vern Street, Hi�hland Pa.rkway and Bohland Avenue as Ha.rdenbergh Heights, and included in said plat the dedication to the public in the sub�ect Block 3, a 20 foot wide alley easement for the particular benefit of all the platted lots in said Block 3. Each of the va.rious owners of the property ad�oining said platted a]1ey retain the basic fee interest in the land. Alleys are norma.11y platted by awners or developers of the la.nd to benefit or serve the adjoining lots for such items as access, block storm draina�e, fire and police protection, trash collection, utility location and connections, etc. as each lot awner or builder intends to utilize at their discretion. The records indicate that the City of Saint Pa.ul, Depaxtment of Public Works improved sa.id a11ey in 1928, pursuant to Final Order C.F. 75538, aPProved April 12, 1928. The impravement consisted of grading and construction of a 6-inch concrete pavement over the prepared base. The costs of this alley improvement were assessed aga.inst each and every lot in sa.id Block 3 in proportion to the abutting foota.ge adjoining the a11ey at an approximate $2.�-6 per assessable foot rate, or a total cost of $90.40 for the sub�ect 40 foot lot. N�intenance and cleaning of this alley are performed annually and, like�wise, assessed to each and every lot in the block. The residence improvement on the property was built in 1932, where the awner or builder opted to include a basement garage with the home and utilize Davern Street as access to said garage. This was strictly the option of the owner at that -time. The alley serves the block including the sub�ect property for run- off drainage. The residence located on the property has electric and telephone service lines connected to a pole and main located in the alley, and the property is served with traeh collection directly from the alley. Rosenblum sub- mitted the attached "Application for Relief" to abate street maintenance assessments levied against property located at 1697 Ford Parkway. His application states he has no access to, or bene- ficial use o� the alley which abuts his property. The matter was referred to this office, and upon consideration, the application is recommended for denial by the Council. This recommendation is based upon a factual report sub- mitted by Mr. Roy Bredahl, Valuations Division of the Finance Department. Mr. Bredahl' s report indicates the property is benefitted, notwithstanding absence of direct access to the alley by the owner. Mr. Bredahl ' s report, toget�er with a draft resolu- tion, is also attached for your examination and con- sideration.
